AGENDA OF: August 15, 2001 Application complete date: May 7, 2001 Project Planner: Greg Fisher Project Engineer: David Rick SUBJECT: CDP 01-15 - BURNS RESIDENCE - Request for approval of a Coastal Development Permit to allow for the construction of a single-family residence within the City's Coastal Zone located near the terminus of Navigator Circle in the Rosalena subdivision of the Poinsettia Shores Master Plan, within Local Facilities Management Zone 9. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5009 APPROVING Coastal Development Permit CDP 01-15 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single- family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and with all applicable requirements of the Poinsettia Shores Master Plan, which is the implementing ordinance of the LCP for the project site. The proposed residence is consistent with the West Batiquitos Lagoon/Sammis Properties Local Coastal Program Segment. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infill lot located near the terminus of an existing street (Navigator Circle) as shown on the attached location map. The site is located within the appeal area of the coastal zone. The lot area is .18 acres (8,119 square feet). Proposed Residential Construction: New 4,335 square foot residential structure with 600 square foot attached garage. The two story residence will be constructed of wood framing with stucco siding and a decorative Red Mission Tile Roof. Proposed Grading: No grading is proposed. Impact on Coastal Resources: None. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 5009. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the West Batiquitos Lagoon/Sammis Properties Local Coastal Program Segment. The project proposes the construction of a new two story single-family residence in an area designated for single-family residential development. As discussed below, the project complies with the applicable Local Coastal Program provisions. The LCP Land Use Plan designates the subject site for RM (Residential Medium) density development. The proposed project is in compliance with the Certified Local Coastal Program and complies with all applicable requirements of the Poinsettia Shores Master Plan, which is the implementing ordinance of the LCP. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. The subject site is located between the nearest public road and the sea or shoreline body of water within the Coastal Zone. The proposed project is in compliance with the Certified Local Coastal Program in that the project complies with all applicable requirements of the Poinsettia Shores Master Plan, which contains implementation measures for compliance with Chapter 3 of the Coastal Act. Specifically, the Poinsettia Shores Master Plan requires the construction of a minimum 10 foot wide public bluff top trail along the north side of Batiquitos Lagoon. This trail as proposed would extend along the rear of this lot. Consistent with the provisions of the Master Plan, the project applicant has been conditioned to dedicate a 10 foot wide trail easement prior to the issuance of a building permit for this residence. Additionally, there exists a 45 foot open CDP 01-15 - BURNS RESIDENCE August 15, 2001 Page 3 space easement over the rear portions of the subject property. The proposed residence will not encroach into this open space easement. 3. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, because the site was previously graded and no proposed development will occur within 30' feet of the slopes steeper than 25% inclination and/or native vegetation, no impacts to coastal resources will occur. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: 1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single- family residences in urbanized areas from environmental review.
