AGENDA OF: September 5, 2001 ItemNo.@ Application complete date: NIA Project Planner: Christer Westman Project Engineer: Skip Hammann SUBJECT: PCD/GPC 01-04-VETERANS MEMORIAL PARKLAND DISPOSITION -Request for approval of a Planning Commission Determination of General Plan Consistency for the disposition of City-owned property to the Kelly Land Company for the purpose of acquiring right-of-way for Whitman Way. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5049 APPROVING PCD/GPC 01-04, based upon the findings contained therein. II. INTRODUCTION This project consists of the acquisition of a portion of property within the City-owned Veterans Memorial Park by the Kelly Land Company. It is being presented to the Planning Commission for a determination of General Plan Consistency. This property would be acquired with the intent of using it as right-of-way for Whitman Way and associated slopes. Section 65402(a) of the California Government Code requires that if a general plan has been adopted, no real property shall be disposed of if the adopted general plan applies thereto until the location, purpose and extent of such disposition have been submitted to and reported upon by the planning agency as to conformity with said adopted general plan. Staff has reviewed the proposed Kelly Land Company acquisition and is recommending that the acquisition of the subject property for the anticipated use is consistent with the General Plan. III. PROJECT DESCRIPTION AND BACKGROUND The location of the property is at the extreme southwest comer of the Veterans Memorial Park adjacent to Faraday Avenue and the Kelly Ranch "Core" project. The amount ofland in question is 0.65 acres. The City has been the owner of the Veterans Memorial Park land since the early 1980's. The property would be used for the construction of Whitman Way and adjacent project slopes. That part of the property which is right-of-way will be dedicated back to the City. Although no formal plan has been developed for the park, preliminary studies have considered park access off of the future Whitman Way. Given the location and size of the property in question, no active park use could be considered. The property would more likely be used for street adjacent landscaping. The developer has agreed to purchase the 0.65 acres from the City for the land cost established in the current Park-in-Lieu Fee schedule for the Northwest Quadrant ($400,00 per acre or approximately $260,000 for the subject land). ( ( PCD/GPC 01-04 -VETERANS MEMORIAL PARK LAND DISPOSITION September 5, 2001 Pa e2 Sale of the park land will not impact the ability of the City to meet it's park standard or to develop Veteran's Memorial Park in the future. IV. ANALYSIS General Plan Consistency The project is consistent with the goals, objectives, policies, and implementation programs contained in the General Plan. The subject site has a General Plan designation of Open Space (OS). Of the five categories of Open Space in the General Plan, this park site is within Category 3, which is Open Space for Outdoor Recreation (Programmed or Unprogrammed). Accordingly it is expected that the entire property will be developed as a public park with both active and passive uses. A subsection of the expected Public Park use within this category is " Areas for access to park and recreation sites, ... " In addition, the Circulation Element describes a road system which delivers sufficient access to all parts of the City through all of the various land uses of the Land Use Element. Roads in and through Open Space is an established acceptable use. V. ENVIRONMENTAL REVIEW It has been determined that the project is categorically exempt from the California Environmental Quality Act, pursuant to Section 15312 of the CEQA Guidelines. Section 15312 exempts the sale of surplus government property if the property does not have significant values for wildlife habitat or other environmental purposes and the property is of such size and shape that it is incapable of independent development. Per the Kelly Ranch Environmental Impact Report, the land considered for purchase by the Kelly Land Company does not have significant habitat value.
