I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5050 APPROVING CUP 01-08 for a period of five years based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The applicant is proposing to site a satellite antenna on the roof of an existing single-story industrial building on Aston Avenue in the Carlsbad Research Center Specific Plan. This proposed antenna will be installed next to an existing satellite antenna, previously approved by Satellite Antenna Permit SA 01-01. This Conditional Use Permit application is being processed in compliance with the Satellite Antenna Ordinance (Chapter 21.53.140 of the Municipal Code). As discussed below, the project complies with all applicable regulations and standards. III. PROJECT DESCRIPTION AND BACKGROUND The applicant, Astor Communications, operates radio stations KFSD, KSPA and KCEO. The proposed 1 O' tall roof-mounted satellite antenna will be placed on an existing single-story industrial building. The existing building is located in the CM zone (Heavy Commercial/Light Industrial) and has a General Plan designation of PI (Planned Industrial). This industrial building is one of two buildings on the site and is located at the rear of the property, away from Aston Avenue. This will be the second roof-mounted satellite antenna for this site. The first antenna was approved administratively by Satellite Antenna Permit No. SA 01-01, on May 17, 2001. Per Chapter 21.53.140 of the Municipal Code, an approved Conditional Use Permit is required to place two or more satellite antennas on a single lot in the CM zone. The existing and proposed satellite antennas will be located next to each other, towards the center of the building and will utilize the same screening. The antennas will be completely screened from College Boulevard and Aston Avenue. The project is subject to the following regulations: A. Conditional Use Ordinance (Chapter 21.42 of the Municipal Code) C. Carlsbad Research Center Specific Plan (SP 180) D. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). IV. ANALYSIS Staff recommends approval of this project based upon the following analysis of the project's consistency with the applicable regulations and standards listed above. The following analysis section discusses compliance with each of these regulations to show consistency with standards. A. Satellite Antenna Ordinance In addition to requiring a Conditional Use Permit for more than one satellite antenna on a single lot, the Satellite Antenna Ordinance also requires specific development standards for height and screening. The required findings and satisfaction of these findings are contained in Table 1, below. Conditional Use Ordinance The Satellite Antenna Ordinance allows roof mounted satellite antenna subject to certain limitations in the CM zone. However, the ordinance requires approval of a Conditional Use Permit for more than one satellite antenna per lot. Conditional uses are generally allowed if the use is necessary and desirable for the development of the community, compatible with surrounding uses, and consistent with the General Plan. Additionally, the site must be adequate to accommodate the use and the design must be integrated into the neighborhood. The aforementioned standards set forth by the Satellite Antenna Ordinance generally ensure that satellite antennas will be compatible with and integrated into the surrounding area through size limitations and requirements for screening. The required findings and satisfaction of these findings are contained in Table 2, below. ,. . Carlsbad Research Center Specific Plan The Carlsbad Research Center Specific Plan requires that roof equipment be completely screened from adjacent streets and surrounding development at ground level within 500 feet of the satellite antenna.
