AGENDA OF: January 16, 2002 Application complete date: November 27, 2001 Project Planner: Don Neu Project Engineer: Frank Jimeno SUBJECT: CDF 01-23 - KELLY CORPORATE CENTER - Request for approval of a Coastal Development Permit to subdivide into 4 parcels a 15.04 acre property located on the south side of Palomar Airport Road between Hidden Valley Road and Aviara Parkway in the Coastal Zone and Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5133 APPROVING CDP 01-23, based on the findings and subject to the conditions contained therein. II. INTRODUCTION The requested Coastal Development Permit is associated with a Minor Subdivision and Non- residential Planned Development Permit to allow a 15.04 acre lot to be subdivided into 4 parcels. The Minor Subdivision will be acted on administratively by the City Engineer and the Non- residential Planned Development Permit will be acted on by the Planning Director subsequent to the Planning Commission taking an action on the Coastal Development Permit. The proposal involves the creation of a 6.67 acre, 7.15 acre and two 0.61 acre parcels. The parcels will have common access and two of the parcels will have common parking. The parcels are proposed for financing purposes associated with the three two-story office buildings previously approved for the site. III. PROJECT DESCRIPTION AND BACKGROUND The Kelly Corporate Center project was approved by the Planning Commission on September 1, 1999. The approval allowed for the construction of four two-story multi-tenant office buildings with a total area of 250,093 square feet with at-grade parking on 25.28 acres. Individual building areas are 72,593 square feet, 50,000 square feet, 50,000 square feet, and 77,500 square feet. The first building having an area of 72,593 square feet located on the west side of Hidden Valley Road, south of Palomar Airport Road has been completed in conformance with the approved Site Development Plan (SDP 97-25) and Coastal Development Permit (CDP 97-52). The second building located near the southeast corner of Palomar Airport Road and Hidden Valley Road is currently under construction. Grading of the developable area of the entire site has been completed. The proposed Coastal Development Permit is needed to allow for the subdivision into four parcels of the project area south of Palomar Airport Road extending between Hidden Valley Road on the west and Aviara Parkway on the east. The project area west of Hidden Valley Road o CDP 01-23 - KELLY CORPORATE CENTER January 16, 2002 Page 2 is currently on a separate parcel. The minor subdivision will create separate parcels for each of the two 50,000 square foot buildings as well as an additional lot for all required parking and landscape areas for each of these buildings. The final parcel will create a separate legal parcel for the 77,500 square foot building and contain all required parking and landscaping for the structure. Reciprocal access easements will be provided between the lots. All site improvements and design issues have been approved as part of the previously issued Site Development Plan and Coastal Development Permit. The project site is designated as Planned Industrial (PI) on the General Plan Land Use Map and is zoned Planned Industrial, Qualified Development Overlay Zone (P-M-Q). The associated Minor Subdivision and Non-residential Planned Development Permit will be acted on administratively. Applicable Regulations The proposed project is subject to the following plans, ordinances and standards as analyzed within the following section of this staff report: A. Mello II Segment of the Local Coastal Program B. Coastal Agricultural Overlay Zone - Carlsbad Municipal Code, Chapter 21.202 C. Coastal Resource Protection Overlay Zone - Carlsbad Municipal Code, Chapter 21.203 IV. ANALYSIS The recommendation of approval for this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. Therefore, this section will cover the project's compliance with each of the regulations listed above in the order in which they are presented. A. Mello II Segment of the Local Coastal Program The project site is located in the Mello II Segment of the Local Coastal Program. The proposed subdivision involves no site improvements beyond those previously approved as part of the prior project entitlements. The Local Coastal Program Land Use Plan designates the site as Planned Industrial. The Local Coastal Program Zoning Map designates the site as Planned Industrial, Qualified Development Overlay Zone. These designations are consistent with the General Plan and zoning for the site. The proposed subdivision complies with the required design standards of Title 20 of the Carlsbad Municipal Code in addition to the provisions of the Non-residential Planned Development Chapter. The project complies with all applicable policies of the Mello II Segment of the Local Coastal Program such as the buffer zone required by Policy 3-8. B. Coastal Agricultural Overlay Zone - Carlsbad Municipal Code, Chapter 21.202 The project site is subject to the Coastal Agricultural Overlay Zone. The Coastal Development Permit issued concurrently with the Site Development Plan required the payment of the Agricultural Conversion Mitigation Fee prior to the issuance of the grading permit. The required fee has been paid. There are no additional requirements of the overlay zone applicable to the proposed project. CDP 01-23 - KELLY CORPORATE CENTER January 16,2002 Page 3 C. Coastal Resource Protection Overlay Zone - Carlsbad Municipal Code, Chapter 21.203 The proposed Minor Subdivision and Non-residential Planned Development Permit are in compliance with all provisions of the Coastal Resource Protection Overlay Zone. No additional grading of the site is proposed. Native vegetation has been preserved onsite by limiting the boundaries of the development area. Necessary drainage improvements are being made on the site. V. ENVIRONMENTAL REVIEW The proposed project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315, Minor Land Divisions. The project qualifies for this exemption as it is the division of property in an urbanized area zoned for industrial use into four or fewer parcels that are in conformance with the General Plan and zoning, and all services and access to the proposed parcels to local standards are available.
