AGENDA OF: February 6, 2002 Application complete date: March 14, 2001 Project Planner: Michael Grim Project Engineer: David Rick SUBJECT: CDP 01-06 - GILBERT RESIDENCE - Request for approval of a Coastal Development Permit to allow for the construction of a single-family residence within the City's Coastal Zone located on the west side of Pio Pico Drive, north of Yourell Avenue, within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5141 APPROVING Coastal Development Permit CDP 01-06 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single- family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infill lot located on the west side of Pio Pico Drive, north of Yourell Avenue, as shown on the attached location map. The lot area is 0.11 acres (5,100 square feet) and is not located in the appeals jurisdiction of the California Coastal Commission. Proposed Residential Construction: New residential structure totaling 3,552 square feet. Proposed Grading: No grading is proposed and, therefore, a grading permit will not be required for this project. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 5141. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a single-family residence in an area designated for single-family development. The LCP Land Use Plan designates the subject site for low-medium density development (0.0 - 4.0 dwellings per acre). There are no steep slopes, agricultural lands, or sensitive resources within the subject property, therefore no impacts to such will occur as a result of this project. No grading is proposed therefore no erosion or geologic instability issues exist. The project is located within a developed area and no scenic vistas or floodways exist within or near the property. The project site is located approximately one mile from the Pacific Ocean and is separated from Buena Vista Lagoon by steep slopes and a collector street, therefore no coastal access opportunities or requirements apply to the property. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. The proposed single-family residence is not located between the first public road and the ocean and does not possess any coastal access opportunities. 3. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. ENVIRONMENTAL REVIEW This project is exempt from CEQA pursuant to Section 15303 of CEQA exemptions (Class 3) which exempts the construction of single-family residences in urbanized areas from environmental review.
