I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5187
APPROVING a retroactive five year extension of CUP 96-17 based upon the findings and
subject to the conditions contained therein.
II. INTRODUCTION
This proposed five year extension of CUP 96-17 would allow the continued operation of a
cellular telecommunications facility consisting of six fa9ade-mounted panel antennas and two
roof mounted equipment cabinets at 5962 La Place Court from November 21, 2001 through
November 20, 2006.
III. PROJECT DESCRIPTION AND BACKGROUND
On November 20, 1996 the Planning Commission approved CUP 96-17 to allow the installation
of six fa9ade-mounted panel antennas and two roof mounted equipment cabinets at 5962 La
Place Court. The project site is north of Palomar Airport Road, west of El Camino Real and
south of Faraday Avenue. The antennas and the equipment cabinets are mounted on and within
the existing roof screen structure, respectively. Condition No. 3 of the approving CUP
Resolution No. 4015 specifies that CUP 96-17 is granted for a period of 5 years but may be
extended upon written application of the permittee (Pacific Bell Wireless/Cingular Wireless).
The applicant, Cingular Wireless, is requesting a five-year extension of CUP 96-17 to allow the
continued operation of the wireless telecommunications antennas at this site.
IV. ANALYSIS
A. The fa9ade-mounted panel antennas continue to be consistent with all applicable plans,
policies and regulations described below:

B. The adopted project findings for CUP 96-17, which are contained m Planning
Commission Resolution No. 4015 still apply to this project (CUP 96-17xl).
C. The adopted project conditions for CUP 96-17, which are contained in Planning
Commission Resolution No. 4015 still apply to this project (CUP 96-17xl) with the
exception of Condition No. 3 which is amended by Condition No. 4 in Planning
Commission Resolution No. 5187 to extend CUP 96-17xl for 5 years from November
21, 2001 through November 20, 2006, and Conditions No. 6, 7, 8, 10, and 11, which have
been satisfied.
D. No formal written complaints regarding CUP 96-17 have been submitted to the City.
E. Annual reviews have been conducted for CUP 96-17 and the project is in compliance
with all conditions of approval.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.
