I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5298 APPROVING SDP 00-16(A), based on the findings and subject to the conditions contained therein. II. INTRODUCTION The proposed addition of 14 storage closets enclosed within the attic space above garage units and the addition of a 39' long retaining wall would result in very minor physical changes to the approved project, make storage space available to residents of the apartment complex, and improve pedestrian circulation. As designed and conditioned, the project is consistent with the General Plan and relevant chapters of the Zoning Ordinance. III. PROJECT DESCRIPTION AND BACKGROUND On October 16, 2001, the City Council denied an appeal of a 16 unit apartment project known as Pirineos Pointe and approved a 14 unit apartment project subject to the applicant's agreement to remove two units and obtain Planning Director approval of a revised 14 unit apartment project. The Planning Director was directed by the City Council to ensure the removal of the two units while retaining the basic site and architectural design. The applicant subsequently received Planning Director approval of a 14 unit project with 3 three-story buildings containing 4 apartments each (Buildings 1 -3), 1 three-st01y building containing 2 apartments (Building 4), and 1 two-story building containing three single-car garages with attic space above the garages (Building 5). The proposed amendment consists of the addition of 14 storage closets and a 39' long retaining wall along the western property line. The 14 storage closets would occupy the attic space above the garages in Building 5 where they would be completely enclosed within the approved architectural design. Each closet is approximately 58 square feet in area. Access to the closets is proposed by an exterior staircase located between Buildings 4 and 5 that necessitates a wider separation between buildings. The wider separation between buildings results in a reduced building width for Building-5. This narrowed building width would no longer accommodate three 12' wide single-car garages; therefore, the applicant proposes to replace the three single-car {' •fi ( SDP 00-16(A) -PIRINEOS POINTE OCTOBER 16, 2002 PAGE2 ( garages with one 12' wide single-car garage and one 23' wide two-car garage. These garages are not required parking since each apaiiment unit will satisfy the parking standard with a two-car garage designed as part of the unit and required guest parking is provided at another location on the site. The proposed storage closets and garages in Building 5 would be available to residents of the apartment project who choose to lease additional storage and/or garage area. The applicant is also proposing to eliminate retaining walls and restraining walls (foundation walls) previously approved along the western building elevation and to add a 39' long retaining wall that ranges in height from 3.5 feet to 5.33 feet along the western property line near the front of the property. This revision will enable excavation of soil to construct a sidewalk between the western building elevation and the prope1iy line that will extend from the clubhouse to the access driveway in front of Building 5. The retaining wall addition will not be visible to the adjacent property, however, a 42" iron safety railing required above the retaining wall at that location will be visible. The proposed project is subject to the following adopted land use plans and regulations: A. General P Ian B. Carlsbad Municipal Code, Title 21 (Zoning Ordinance) including: (1) Chapter 21.24-Residential Density-Multiple (RD-M Zone) (2) Chapter 21.06-Qualified Overlay (Q) Zone IV. ANALYSIS The recommendation of approval for this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of these regulations/policies in table and project specific discussions. A. General Plan A. The approved 14-unit apartment project is consistent with the applicable Residential High (RH) land use designation. The proposed storage closets are accessory to the apartment units and are entirely enclosed within an approved two-story building. As such, the storage closets would not increase the density or intensity of the approved development. The removal of retaining/restraining walls and addition of a retaining wall will not negatively impact the adjacent property in that the additional wall will only be visible from the interior of the project. B. Chapter 21.24 -RD-M Zone The proposed accessory storage closets are consistent with uses permitted in the zone and are located within a building that meets or exceeds all development standards specified by the RD-M Zone in that no changes to required parking, setbacks, or architecture are required. ENVIRONMENTAL REVIEW ( The proposed storage closets are accessory structures that qualify as a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303).
