AGENDA OF: January 15, 2003 ItemNo.@ Application complete date: September 9, 2002 Project Planner: Greg Fisher Project Engineer: Taniya Barrows SUBJECT: CDP 02-35 -HENDRIX SECOND DWELLING UNIT -Request for approval of a Coastal Development Permit to allow for the construction of a 554 square foot, detached second dwelling unit located above a proposed two car garage within the City's Coastal Zone located at 470 Chinquapin Avenue within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5340 APPROVING Coastal Development Permit CDP 02-35 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a second dwelling unit within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. The proposed second dwelling unit is consistent with the Mello II segment of the City's LCP. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Existing single-family lot and residence located at 470 Chinquapin Avenue on the north side of Chinquapin Avenue between Long Place and Linmar Lane as shown on the attached location map. The site is generally level and sits slightly above street grade. The lot area is .18 acres (8,085 square feet). Proposed Residential Construction: New 554 square foot second dwelling unit located above a proposed 616 square foot two car garage. The proposed structures will be architecturally compatible with the existing residence and will be constructed of wood framing with stucco siding and a decorative composition shingle roof. Proposed Grading: No grading is proposed which would require a grading permit. Impact on Coastal Resources: None. CDP 02-35 -HENDRIX sf oND DWELLING UNIT January 15, 2003 Pa e2 IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 5340. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a second dwelling unit in an area designated for single-family residential development. As discussed below, the project complies with the applicable Local Coastal Program provisions. The LCP Land Use Plan designates the subject site for Residential Low Medium (RLM) density development, which allows 3.2 du/ac. Affordable Housing Policy 1-1 of the Mello II LCP allows for development of second dwelling units subject to compliance with all applicable LCP provisions, with the exception of base density. The proposed second dwelling unit is architecturally compatible with the primary unit and is consistent with the surrounding development of one-and two-story structures. The second-story unit will not obstruct views of the coastline as seen from public lands or the public right-of-way or otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the developed property. The property is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The residentially designated site is not suited for water-oriented recreation activities. CDP 02-35 -HENDRIX sf oND DWELLING UNIT January 15, 2003 Pae 3 2. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. The project does not require a grading permit. Construction of the project will adhere to the City's Master Drainage, Storm Water Ordinance, Grading Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased runoff and soil erosion. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: Section 15303 of CEQA exemptions (Class 3) exempts the construction of second dwelling units in urbanized areas from environmental review.
