AGE:t\1DA OF: January 15, 2003 Item No. Application complete date: August 29, 2002 Project Planner: Sanna Qureshy Project Engineer: John Maashoff SUBJECT: CUP 02-20/CDP 02-38 -LEGOLAND VEHICLE STORAGE -Request for approval of a Conditional Use Permit and a Coastal Development Permit for the use of excess parking spaces located in an existing parking lot at the LEGOLAI\1D theme park, for the storage of vehicles as needed by car dealerships of Car Country Carlsbad. The subject site is located at 1 Legoland Drive. east of Arn1ada Drive, west of Hidden Valley Road, north of Palomar Airport Road and south of Cannon Road in Planning Area 4 of Carlsbad Ranch Specific Plan and within Local Facilities Management Zone 13. I. RECOl\11\IENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5341 and 5342, APPROVING CUP 02-20 and CDP 02-38, based on the findings and subject to the conditions contained therein. Il. INTRODUCTION The applicant, LEGOLAND Estates, is requesting authorization for use of 999 excess parking spaces located at the LEGO LAND parking lot for the storage of new vehicles as requested by the Car Country Carlsbad Dealership Association. The LEGOLAND theme park has excess parking spaces. whereas car dealerships located on Paseo Del Norte and Car Country Drive are experiencing a shortage of parking area to store new vehicles arriving from car manufacturers. Pursuant to the Carlsbad Ranch Specific Plan, the required number of parking spaces for LEGOLAND was 4160 with an overflow of 1150 spaces for future expansions. The LEGOLAND parking lot is currently developed with 5318 parking spaces which are in excess of the needed parking. The joint use of existing facilities and capacity will improve the parking shortage as experienced by the car dealerships and there will be no impact on operation and use of LEGO LAND due to the proposed project. III. PROJECT DESCRIPTION AND BACKGROUND The applicant, LEGOLAND Estates, is requesting authorization for use of 999 excess parkmg spaces located at the LEGOLMTD parking lot by the Car Country Carlsbad Dealership association for the storage of vehicles. Through this joint use of existing facilities and capacity, the parking situation will greatly improve on Paseo Del Norte and on Car Country Drive. The car delivery trucks will enter the subject site through Legoland Drive at a time when the LEGOLMTD theme park is closed and the entrance is not used by LEGOLAND visitors. The trucks will enter the designated area and unload the vehicles which will be parked in lined spaces with no change in access and egress of the parking lot. Additionally damaged vehicles or vehicles waiting repairs will not be allowed to park at the subject site. There will be no impact on the current parking lot lighting plan and security will be provided by the dealerships and LEGOLAND. Individual withdrawal of cars is proposed to be allowed during operating hours of the Park. The car dealership employees will enter the park through the Hidden Valley Road entrance, pick up the car and exit the subject site the same way. The entrance at Hidden Valley Road is not used by Park visitors and there will be no conflict with visitor traffic. IV. ANALYSIS The proposed project is subject to the following plans, ordinances, and standards as analyzed within this section of the staff report: A. A. Carlsbad Ranch Specific Plan (SP 207(A)): B. Tra\'el/ Recreation Conm1ercial (TR) General Plan Land Use Designation: C. Commercial-Tourist, Qualified DeYelopment Overlay Zone (C-T-Q); D. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); E. Comprehensive Land Use Plan for McClellan-Palomar Airport; F. Ivlello II Segment o:f the Local Coastal Program, Coastal Development Procedures, and the Coastal Resources Protection Overlay Zone (Chapter 21.201, 21.203 ); and G. Growth Management (Chapter 21.90 of the Carlsbad :Municipal Code). Carlsbad Ranch Specific Plan The Carlsbad Ranch Specific Plan establishes the permitted uses for the site as well as the development standards and design guidelines. The proposed project is in compliance with the requirements of the specific plan. The permitted uses for the project site include parking and any other uses as detem1ined by the Planning Director to be of the same general character. The proposed use of existing excess parking spaces to be used for the storage of cars as needed by the Car Country Carlsbad Dealerships is a use consistent with the Specific Plan. The subject parking area and LEGOLAi"'\TD theme park were approved by the Planning Commission under SDP 96- 14/ CDP 96-16. The project was found to be consistent with the deYelopment standards and design guidelines contained in the specific plan which included among other standards. parking requirement. The total number of parking spaces required by the Specific Plan for LEGOLA.i""\T]) was 4160 spaces with an additional 1.150 spaces for future expansion of LEGOLAND. The subject site is currently improved with 5318 spaces. The entire visitor attraction area (Inner Park) of LEGOLA.i'\T]) has not been developed. The proposed project is proposing to use 999 spaces for storage of new vehicles as needed by the Car Country Dealerships. There are no physical improvements or alterations proposed with this project. General Plan and Zoning The existing General Plan and Zoning designations for the site were adopted concurrently ,vi.th the Carlsbad Ranch Specific Plan to achieve consistency. The Travel/Recreation Commercial (T-R) General Plan Land Use Designation provides for the use as the category addresses commercial uses that provide for visitor attractions and commercial uses. The Specific Plan implements the General Plan on the project site and includes required circulation improvements and provisions for alternative modes of transportation such as public bus, bicycle, and pedestrian facilities. Zoning for the site is Commercial -Tourist, Qualified Development Overlay Zone (C- T-Q). The specific plan list of uses modifies the permitted uses allowed for the site. The Q- Overlay designation on the zoning map requires the approval of a site development plan. This is consistent with the specific plan which was established with the requirement that each site require approval of a Site Development Plan (SDP). A SDP was approved by the City Council for the establishment of LEGOLA.i"'\TI in 1996. Since no modifications to the project site are proposed an amendment to the SDP is not required for this temporary use. D. Conditional Use Permit Regulations Conditional uses such as a large assemblage of cars possess unique and special characteristics which make it impractical to include them as pemutted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. The following required conditional use permit findings for the proposed project can be made: 1. The proposed use is: a) necessary and desirable for the development of the community in that the community benefits of shared use of existing excess parking include providing parking spaces to solve a critical shortage of vehicle storage area as faced by the car dealerships, without impacting the operation of LEGOLAND and the surrounding community; b) consistent with the General Plan in that the Travel/Recreation Commercial land use designation does not preclude the use of existing excess parking spaces for the storage of vehicles as needed by the car dealerships; 2. The proposed site is adequate in size and shape to accommodate the use in that the parking lot is existing and the proposed project does not include any new improvements or physical changes on-site. There will be no impact on operations of LEGO LAND due to shared use of excess parking capacity; 3. All features necessary to adjust the requested use to the existing use are provided in that the proposed use comprised of the use of an existing parking lot and there will be no physical changes at the site; and 4. The street system serving the proposed use would not be impacted by the proposed conditional use in that the delivery of vehicles will take place from Cannon Road through Legoland Drive at times when the private drive is not in use by LEGOLMTD visitors. Individual draws of vehicles during LEGO LAND operating hours will take place through the entrance on Hidden Valley Road. Should the parking become necessary for LEGOLAND as a result of development of the Inner Park expansion area, all or part of the vehicle storage use will be required to cease. E. Comprehensive Land Use Plan for McClellan-Palomar Airport The project site is located within the Airport Influence Area for McClellan Palomar Airport. The site is approximately 4,900 feet west of the airport. The Airport Land Use Plan identifies the use as being compatible with the noise levels for the site. At the time of approval of LEGOLAND theme park, the project was sent to SANDAG staff and the Palomar Airport Manager for review. SANDAG staff reiterated their comments on the Carlsbad Ranch Specific Plan (SP 207(A)) in which they determined the LEGOLAND use and associated parking to be consistent with the CLUP. F. Mello II Segment of the Local Coastal Program The proposed conditional use is consistent with the relevant policies of the Mello II Segment of the Local Coastal Program and the Coastal Resources Protection Overlay Zone. The project site has been previously disturbed and is developed with LEGOLAND and its associated parking facilities. The proposed project will not obstruct views of the coastline as seen from public lands or the public right-of-way or otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the developed property. The proposed project is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. There are no steep slopes or natural vegetation on the subject site. The project will not have drainage impacts on coastal resources. G. GrmYth Management Ordinance The proposed project is located within the Local Facilities Management Zone 13 in the northwest quadrant. The proposed project will not result in increased public facilities demands; therefore. the proposal will not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The operation or minor alteration of existing facilities involving negligible or no expansion of use beyond that existing use is a Class 1 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15301).
