AGENDA OF: February 5, 2003 Item No. Application complete date: November 25, 2002 Project Planner: Eric Munoz Project Engineer: John Maashoff SUBJECT: CDP 01-43 -THOMPSON PARCEL MAP -Request for approval of a Coastal Development Permit to allow for the subdivision of one lot into two lots; and the construction of a single-family residence within the City's Coastal Zone located at 3940 Alder Avenue, east of Monroe Street in Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5346 APPROVING Coastal Development Permit CDP 01-43 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the subdivision of land from one lot into two lots, and the construction of a single-family home, within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. The proposed lot split and single-family residence is consistent with the Mello II segment of the City's LCP. There are no unresolved issues. This CDP entitles the lot split and single-family house construction. The lot split also requires the processing and approval of a Minor Subdivision (MS 01-15) which is approved adminis- ratively by the Public Works Director (based on approval of this CDP). In addition, a Hillside Development Permit (HDP 02-12) is required (for the lot split only) which is also reviewed and approved administratively by the Planning Director based on approval of this CDP. Staff has reviewed MS 01-15 and HDP 02-12 and can make the administrative approvals based on the approval of this CDP by the Planning Commission. Staff, therefore, recommends approval of CDP 01-43 with the conditions contained in Planning Commission Resolution No. 5346. The project is depicted on Exhibits "A" -"D" dated February 5, 2002. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Existing lot and residence at 3940 Alder Avenue are located within the R-1- 15 zoning district, which requires a minimum of 15,000 square feet per lot. The subject site is 30,922 square feet. The lot split proposes two lots each over the 15,000 square foot minimum CDP 01-45 -THOMPsoilARCEL MAP February 5, 2003 Page2 - (15,474 and 15,448 square feet, respectively). The site is a hillside lot with some slopes and HDP 02-12 ensures the lot split complies with all applicable development standards. Proposed Residential Construction: New 2,105 square foot residential structure plus an attached 529 square foot two-car garage. The two-story "Contemporary" style structure will be constructed of wood framing with stucco and a decorative tile roof. The structure complies with all setback, building height and lot coverage development standards. Proposed Grading: Grading is proposed which would require a grading permit to be issued. hnpact on Coastal Resources: None. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 5346. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes a lot split (MS 01-15 and HDP 02-12) and the construction of a new two story single-family residence (CDP 01-43) in an area designated for single-family residential development. As discussed below, the project complies with the applicable Local Coastal Program provisions. The LCP Land Use Plan (and City's General Plan) designates the subject site for RLM (Residential Low Medium) density development, which allows 3.2 du/ac up to 4.0 du/ac. Based on the RLM range, the lot split can accommodate two lots; and each lot can develop with one dwelling unit. CDP 01-45 -THOMPSON" ARCEL MAP February 5, 2003 - Page 3 2. 3. The two-story residence is consistent with the surrounding development of one-and two- story structures. The two-story residence will not obstruct public views of the coastline as seen from public lands or the public right-of-way or otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are any sensitive natural resources located on the undeveloped property. The proposed residence is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. Coastal Overlay Zones The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location ( away from the shoreline) and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. General Plan Compliance The General Plan designation of RLM allows the subdivision and density proposed by this project. Furthermore, the project complies with all the development standards of the R-1-15 zone which implements the RLM designation in this area. This project is consistent with the applicable Elements of the City's General Plan. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15303(a) of CEQA exemptions (Class 3) exempts the construction of single- family residences in urbanized areas from environmental review. (2) Section 15315 of CEQA exemptions (Class 15) exempts the division of property in urbanized areas zoned for residential use into four or fewer parcels from environmental review.
