AGENDA OF: April 2, 2003 Item No.@ Application complete date: December 11, 2002 Project Planner: Barbara Kennedy Project Engineer: David Rick SUBJECT: CUP 02-21/SUP 02-10/ CDP 02-40 -HOFFMAN CINGULAR -Request for approval of a Conditional Use Permit, Special Use Permit, and Coastal Development Permit to allow the replacement of a mono-pole for an unmanned telecommunications facility with a new mono-palm structure and twelve (12) panel antennas. The site is located at 4901 El Camino Real in the R-A-10 zone in Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 5386, 5387 and 5388 APPROVING CUP 02-21, SUP 02-10, and CDP 02-40 for a period of five (5) years, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a Conditional Use Permit, Special Use Permit, and Coastal Development Permit to allow the replacement of a monopole for an existing unmanned telecommunications facility with a new mono-palm structure with 12 panel antennas. The equipment area will remain in its current location. Quasi-public utility facilities are permitted in residential zones by a conditional use permit and all required findings for the Conditional Use Permit, Special Use Permit, and Coastal Development Permit can be made for the proposed facility. HI. PROJECT DESCRIPTION AND BACKGROUND Cingular Wireless has been authorized by the Federal Communications Commission (FCC) to construct and operate a digital Personal Communications Services (PCS)· network in the United States. In order to provide adequate coverage for their users, Cingular Wireless proposes to expand and reconstruct their existing facility at the top of the slope behind the Marja Acres (Country Store) commercial center. The project site is surrounded by agricultural fields to the south, a palm nursery to the west, a mobile home park to the east, and the County Store is located north of the site. The property also supports sites for two other unmanned telecommunications facilities. Nextel received approval for a mono-palm with 12 panel antennas in April 2001 (CUP 00-32). The existing Sprint site consists of 6 pole/antenna structures. Sprint obtained approval of CUP 01-24 in April 2002 to remove the pole/antennas and co-locate their facility within the trunk of the existing Nextel mono-palm, however, the relocation has not yet been completed. CUP 02-21/SUP 02-10/ CL~ 02-40-HOFFMAN CINGULAR April2,2003 Pa e2 Cingular Wireless (formerly Pac Bell) currently leases a small portion of a residentially zoned property which supports the existing 30-foot high monopole with six antennas and an equipment area. This site was approved by CUP 96-01 which expired in 9/18/01. The applicant has been working with staff to develop a proposal that would meet the new "stealth" design criteria and that would also accommodate a second carrier within the trunk of the mono-palm. The proposal consists of the removal of the existing monopole and installation of a new 40-foot tall mono- palm with 12 panel antennas located within the fronds. The increased height for the mono-palm is necessary to provide adequate separation between Cingular's and the future carrier's antennas. The antennas, which are 12 inches wide by 42 inches tall, will be arranged on 9 poles which radiate out from the "trunk" at staggered lengths of 4 feet and 6.5 feet. The faux fronds are about 8 feet long and will help to screen the antennas. Two 35' tall Canary Island Date Palm trees will be planted around the mono-palm so that the "stealth" installation blends into the natural landscape. A new equipment/slab area is proposed inside the existing equipment enclosure area and the existing equipment/slab area will be removed. The existing 12' x 22' enclosure area is surrounded by a 6-foot high chainlink fence and a number of small trees and shrubs effectively screen the equipment area. IV. ANALYSIS The proposed project is subject to the following regulations: A. Residential Agriculture (R-A-10) Zone (Chapter 21.08 of the Carlsbad Municipal Code); B. Scenic Preservation Overlay Zone (Chapter 21.40 of the Carlsbad Municipal Code); C. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); D. City Council Policy Statement: Policy 64 -Wireless Communication Facilites; E. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). F. Coastal Development Regulations (Chapter 21.201 of the Zoning Ordinance); The recommendation for approval of this conditional use permit, special use permit, and coastal development permit was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. CUP 02-21/SUP 02-10/ d._~ 02-40-HOFFMAN CINGULAR ( April 2, 2003 Pae 3 A. Residential Agriculture (R-A-10) Zone Chapter 21.42.010(2)(J) (Conditional uses) allows accessory public and quasi-public buildings and facilities in all zones, including the R-A-10 residential zone, with approval of a Conditional Use Permit. The proposed mono-palm will replace an existing monopole located on a residentially zoned, but undeveloped site. The project complies with all applicable regulations of the R-A-10 zone. B. Scenic Preservation Overlay Zone The proposed mono-palm will be located approximately 300 feet from El Camino Real, which has been designated a Scenic Roadway by the City's General Plan. Consequently, the project is subject to the requirements of the El Camino Real Scenic Corridor Development Standards and requires a Special Use Permit. The view of the mono-palm will be fairly distant since it is located slightly over 300 feet away from the roadway. The surrounding natural view shed is not considered significant due to the fact that it has been partially degraded by existing development between the project and El Camino Real, a mobile home park development to the east, utility poles and lines along El Camino Real, and SDG&E transmission towers to the west. To reduce the visibility of the facility, it has been designed as a "stealth" mono-palm and it will be surrounded by mature palm trees that will blend in with the palms located along the driveway and within the adjacent nursery. Since there are no tall structures in the vicinity on which to locate a facility, staff encouraged Cingular to redevelop this site with a stealth installation and to remove the existing monopole. The mono-palm has also been designed so that a second carrier can co-locate within the trunk of the mono-palm. Cingular has also been working with Verizon to ensure that the design ,and location of the proposed mono-palm will be suitable to meet the needs of both of these carriers. Given that the mono-palm is a stealth design and will blend into the landscape through the addition of other mature palms, and that the mono-palm has been designed to accommodate a second carrier, staff has concluded that the proposal conforms to the requirements of the Scenic Preservation Corridor Overlay. C. Conditional Use Permit Regulations Conditional uses such as wireless communications facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. Staff has reviewed the proposed project and found that all CUP 02-21/SUP 02-10/ CL~ 02-40-HOFFMAN CINGULAR April 2, 2003 Page4 the necessary findings can be made to approve the conditional use permit. The required findings and supporting facts are contained in Table 1, below. Table 1 -CONDITIONAL USE PERMIT FINDINGS AND RESPONSES FINDING That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, including, if applicable, the certified local coastal program, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. That the site for the intended use is adequate in size and shape to accommodate the use. That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. D. Coastal Development Regulations PROJECT CONSISTENCY The requested use is necessary and desirable for the development of the community because of the benefit and demand for mobile voice and data transmissions for businesses, individuals, public agencies and emergency service systems. The proposed use is consistent with the General Plan in that the residential land use designation does not preclude the provision of quasi-public utility uses, nor is it detrimental to existing or permitted uses in the R-A-10 zone. The site is adequate in size and shape to accommodate the use and the proposed mono- palm can be located on the site without the need for variances from development standards. The existing equipment area will remain and is adequately screened by existing landscaping. The mono-palm will be surrounded by mature Canary Island Date Palm trees so that it blends in with the natural landscape. It has been designed so that it can accommodate a second carrier in the future to redw;;e the visual impact of multiple carriers on the site. The use generates very little traffic, requiring only routine maintenance visits twice monthly and occasional visits in response to operational problems. The existing driveway will be used to access the equipment area. The site is located within the Mello II segment of the City's Coastal Zone and is subject to the corresponding land use policies and implementing ordinances. These policies and ordinances emphasize topics such as preservation of agriculture and scenic resources, protection of environmentally sensitive resources, provision of shoreline access, and the prevention of geologic instability and erosion. The mono-palm will be located on a small portion of the Residential-Agricultural zoned land however, these lands are not designated as coastal • agricultural lands. The facility will not affect the existing agricultural and residential uses on the site. No environmentally sensitive lands exist on site. Since the project site is located over two CUP 02-21/SUP 02-10/ CL_ 02-40-.HOFFMAN CINGULAR ( April2,2003 Pae 5 miles from the Pacific Ocean, no shoreline development regulations apply. Since the project site is located within 300 feet of El Camino Real which is designated as a Scenic Corridor, the Scenic Preservation Overlay Zone standards apply to the project and are analyzed in the previous section. Given the above, the project is consistent with the Mello II land use policies and the applicable implementing ordinances. E. City Council Policy Statement: Policy 64 -Wireless Communication Facilities The City Council adopted policies regarding prioritization for the location of Wireless Communications Facilities (WCF) on October 3, 2001. The guidelines state that wireless facilities should be located on buildings and structures, not on vacant land. In addition, WCFs should locate, in order of priority, on industrial, commercial, public, other non-residential, public utility, park, or community facility property. Design guidelines of the policy state that all aspects of a WCF, including the supports, antennas, screening methods, and equipment should exhibit "stealth" design techniques so they visually blend into the background or the surface onto which they are mounted. The policy encourages co-location wherever feasible and appropriate. Although this project is located on residentially zoned vacant land, it is replacing an existing facility that provides a coverage link on El Camino Real. No tall buildings exist within the vicinity of the site and the elevation of the adjacent commercially zoned property is too low to meet the coverage needs. The project does meet the Council's policy by replacing a non-stealth monopole with a new "stealth" mono-palm that will be designed to accommodate a second carrier. The applicant submitted an RF emissions report to ensure that the RF emissions will not exceed the FCC guidelines. The report indicates that RF emissions of the Cingular Wireless antennas are well below the FCC standard for continuous public exposure. F. Growth Management The site is located within Local Facilities Management Zone 1. The replacement of the existing monopole with a new mono-palm with 12 panel antennas will not result in increased public facilities demands; therefore, the proposal will not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The minor alteration of existing private facilities is a Class 1 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15301). The FCC requires CUP 02-21/SUP 02-10/ CL~ 02-40-HOFFMAN CINGULAR April2,2003 Page6 compliance with radio frequency power density standards (ANSI/IEEE C95.1-1992) for the general public; therefore, the project would not have a significant impact on the environment.
