SUBJECT: CUP 02-32/CDP 02-54 -BOB BAKER VEHICLE STORAGE LOT -
Request for a Conditional Use Permit and Coastal Development Permit to allow a
245 space vehicle storage lot located on the southwest corner of Cannon Road and
Avenida Encinas in the P-M Zone and Local Facilities Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 5445 and 5446
APPROVING CUP 02-32 and CDP 02-54 based upon the findings and subject to the conditions
contained therein.
II. INTRODUCTION
The project consists of a 245-space vehicle storage lot to be utilized for new car inventory by the
Bob Baker dealership in Car Country. The site is a vacant lot in the P-M Zone at the southwest
corner of Cannon Road and Avenida Encinas. The project requires only minor site alteration and
vehicles will be entirely screened from the surrounding roadways by a combination of landscape
berms and stucco wall. As designed and conditioned, the project is consistent with all applicable
standards and the necessary findings to approve the project can be made.
III. PROJECT DESCRIPTION AND BACKGROUND
The project site is a 2.45-acre previously graded, vacant infill industrial lot located on the
southwest comer of Cannon Road and Avenida Encinas in the P-M Zone and within the
boundaries of the Mello II Local Coastal Program segment. The site is designated by the General
Plan for Planned Industrial (Pl) land use and surrounded to the north by Cannon Road and the
future Cannon Court commercial site, to the south by industrial development, to the west by the
railroad right of way and Cannon Lake, and to the east by the Inns of America. The property is
denuded of vegetation except for sparse ornamental vegetation that occupies the perimeter of the
site
The proposed development will consist of a 4 to 5' high landscape berm along the northern and
eastern property lines adjacent to Cannon Road and A venida Encinas and a 245-space asphalt
vehicle storage lot located behind the berm. The existing topography will be raised to create the
berm and lowered approximately 2' across the remainder of the lot resulting in approximately
2,000 cubic yards of balanced grading. A combination of the landscaped berm and stucco wall
proposed for installation along the rear and interior side property line will screen the stored
vehicles from surrounding roadways and properties. A driveway located at the southern end of

the lot will provide access to the site from A venida Encinas. A security gate located
approximately 60' inside the driveway entry and an 8' x 10' portable maintenance building are
also proposed to accommodate the use. The 8' high maintenance building will also be screened
from view by the landscaped berm.

IV. ANALYSIS
The recommendation of approval for this project was developed by analyzing the project's
consistency with the applicable regulations and policies. The project's compliance with each of
the above regulations is discussed in detail in the sections below.

The project is subject to and consistent with applicable Mello II LCP resource preservation
policies and implementing ordinances (Chapter 21.201 -Procedures, and Chapter 21.203 -
Coastal Resource Protection Overlay Zone) of the Carlsbad Municipal Code. In accordance with
Chapter 21.201, the proposed project includes an application for a Coastal Development Permit
for the proposed development. The applicable sections of Chapter 21.203 pertain to the
prevention of soil erosion, sediment control and adequate drainage facilities since the property
contains no steep slopes, sensitive vegetation, coastal agricultural lands, coastal views, or coastal
access opportunities. The project would be conditioned to require compliance with all City
erosion control and drainage standards. The proposed development would not increase storm
water runoff from the site, and runoff would be directed into existing storm drains. Compliance
with the City's National Pollutant Discharge Elimination System (NPDES) requirements through
implementation of necessary Best Management Practices (BMPs) will reduce storm water
pollutant runoff. Additionally, the project would be conditioned to prohibit grading during the
rainy season, October 1 to April 1, to avoid increased runoff and soil erosion during the grading
operation.
Cl. Planned Industrial (P-M) Zone
The project is subject to P-M Zone development standards requiring landscaped setbacks along
circulation arterial roadways and performance standards prohibiting offsite spillage of high
intensity illumination and requiring that all outdoor storage shall be completely enclosed by a
solid decorative concrete or masonry wall not less that 6' in height in combination with
landscape materials. Except for the small 8' x 10' maintenance building located in the interior of
the lot, the project includes no structures requiring adherence to building setback standards. To
satisfy the required 50' wide arterial setback standard, which allows a driveway to reduce the
setback to 35', the project proposes a minimum 35' wide landscape berm along the Cannon Road
and Avenida Encinas street frontages. A driveway will occupy the remaining 15' of the required
setback. The project includes a photometric lighting plan (Exhibit "E") that illustrates the extent
of offsite light spillage resulting from the proposed lighting. The project is consistent with the
illumination performance standard in that offsite light spillage to the west toward residential
development will be minimal. The project also includes a combination of 4 to 5' high berms
around the street side perimeters and a 6' high steel frame/foam wall with stucco coating around
the rear and interior side perimeters that will adequately screen the stored vehicles in compliance
with the enclosure performance standard.

C2. Conditional Uses
Chapter 21.42 of the Zoning Ordinance allows large assemblages of automobiles in any zone
except residential zones with approval of a Conditional Use Permit (CUP). The CUP requires
findings that the use is necessary or desirable, essentially in harmony with the General Plan, not
detrimental to existing uses specifically permitted in the P-M Zone, and that the site and street
system are adequate to accommodate the proposed use.
The vehicle storage use is a necessary interim use to reduce proliferation of stored cars resulting
from new inventory at the Bob Baker dealerships in Car Country. Storage is an anticipated use
within the Planned Industrial land use designation and therefore consistent with the General Plan.
The proposed use would be entirely screened from surrounding industrial and commercial uses
by landscaped berms and a stucco wall to avoid detrimental visual impacts. The rectangular
shaped site is adequate to accommodate the 245 space vehicle storage lot in accordance with P-M
zone development and performance standards, and the street system, which includes two
circulation arterial road segments that operate at acceptable levels, is adequate to accommodate
the additional traffic generated by the use. The applicant has indicated that Bob Baker employees
will drive cars to and from the storage lot; therefore, no car carrier trucks will be used to
transport vehicles.

V. ENVIRONMENTAL REVIEW
The small infill project qualifies as a Categorical Exemption under Section 15332 of CEQA
Guidelines. Section 15332 exempts infill projects located on properties in urban areas that are
less than five acres, served by adequate public facilities, and result in no environmental impacts.
A Notice of Exemption will be filed by the Planning Director upon project approval.
