I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 5508 and 5509 APPROVING CT 03-08 and PUD 03-05, based on the findings and subject to the conditions contained therein. 11. INTRODUCTION The proposed project consists of a Tentative Map and Non-Residential Planned Development Permit for the subdivision of the subject site into six lots. A Planned Industrial Permit, PIP 02- 03 was previously approved by the Planning Director for the project design on August 13, 2002. The design consisted of five office buildings totaling 48,730 square feet and associated parking and landscaping. The proposed subdivision will create five separate lots, one for each of the five buildings, and the sixth lot will contain parking and landscaping areas held in common by an association of owners. Adjacent properties have been developed with industrial and office buildings. The project as proposed is in compliance with all City standards and staff is recommending approval of the project. 111. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of a Tentative Map and Non-Residential Planned Unit Development to subdivide a 4.02-acre parcel located at the northeast comer of Camino Vida Roble and Corte Del Nogal into six lots. A Planned Industrial Permit was approved by the Planning Director to allow the development of five office buildings and associated parking and landscaping. As proposed, the site will be subdivided such that each building will be on a separate individual parcel with the parking and landscaping areas held in common by an association of owners. The buildings under construction vary in size from 7,040 square feet to 11,840 square feet. A total of 196 at-grade parking spaces are provided. The buildings are arranged around a landscaped area. Access to the site is via a single driveway on the easterly side of the site off Corte Del Nogal. Employee eating areas are provided at the westerly end of the property and also between the buildings. Construction is currently ongoing at the site. Subdivision has frontage on Corte Del Nogal and Camino Vida Roble which are already fully improved. Planned Industrial (PI) General Plan Land Use Designation; Subdivision Ordinance (Title 20 of the Carlsbad Municipal Code); Non-Residential Planned Development (Chapter 2 1.47 of the Carlsbad Municipal Code); McClellan-Palomar Airport Comprehensive Land Use Plan (CLUP); and Growth Management Regulations (Local Facilities Management Zone 5). The recommendation of approval for this project was developed by analyzing the project’s consistency with the applicable policies and regulations listed above. The project’s compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan The General Plan designation of the site is Planned Industrial (PI). The PI land uses include manufacturing, warehousing, storage, research and development, and utility uses. The project complies with all the elements of the General Plan as shown in Table A below. Subdivision Ordinance The Engineering Department has reviewed the proposed tentative map and has concluded that the subdivision, as conditioned complies with all the applicable requirements of the Subdivision Map Act and the City’s Subdivision Ordinance. The other infrastructure improvements (sewer, water, drainage, etc.) are currently in place to serve the project and no off-site improvements are required. The project is served by Corte Del Nogal and has direct access to public streets. The streets adjacent to the project site, Corte Del Nogal and Camino Vida Roble, are adequate to serve the 978 Average Daily Trips (ADT) generated by this project. C. Planned Industrial (P-M) Zone The proposed subdivision of the subject property into six lots containing five office buildings and associated parking and landscaping is consistent with the P-M Zone. The design of the project was analyzed through the approval of PIP 02-03 and was found to be consistent with the design standards contained in the P-M Zone. D. Non-Residential Planned Development The non-residential planned development regulations are to: 1. 2. 3. Ensure projects develop in accordance with the General Plan and applicable specific plans; Provide for non-residential projects which are compatible with surrounding development; and Provide a method to approve separate ownership of planned development lots. The proposal to create individual ownership lots which do not have direct access from a publicly dedicated street necessitates that a Non-Residential Planned Unit Development permit be processed to supplement the proposed Tentative Map (CT 03-08). The 5 lots proposed would share common driveway access and landscaping which would be located on the sixth lot. The project complies with the General Plan and Zoning standards as addressed in the discussion above. The subdivision, by nature of the office use, will not be detrimental to the health, safety or welfare of the surrounding occupants of the area and the office use is similar to the adjacent uses. No modifications to the development standards are required to protect public health, safety, and general welfare. There are no size nor configuration standards for non-residential planned development lots beyond those imposed as a part of the permit, but shall be reasonable as to the intended use and relation to the project. Individual lots are being created to accommodate individual buildings and are related to the size of the buildings. E. McClellan-Palomar Airport Comprehensive Land Use Plan (CLUP) The proposed subdivision is compatible with the CLUP. The project site is located outside of the runway protection zone and the flight activity area. The project site is outside of the 60 CNEL noise level contour, thus being a compatible use. Growth Management Regulations The project is located within Local Facilities Management Zone 5. The impacts on public facilities created by five office buildings, and the project’s compliance with the adopted performance standards were analyzed and evaluated at the time of approval of PIP 02-03. V. ENVIRONMENTAL REVIEW Pursuant to Section 15332(a-e) of the California Environmental Quality Act exemptions (Class 32) projects characterized as in-fill development in urbanized areas are exempt from environmental review. The project site is less than five acres and is substantially surrounded by urban uses. In light of the above, a Notice of Exemption will be filed by the Planning Director upon project approval.
