The site is located at 4901 El Can1ino Real in the C-2 and R-A-10 zones in Local Facilities Management Zone 1. I. RECOl\11\lENDATIO:N That the Planning Commission ADOPT Planning Commission Resolutions No. 5515, 5516, and 5517 A.PPROVING CUP 03-06, SUP 03-0--1-and CDP 03-16 for a period of five {5) years, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a Conditional Use Pemrit (CUP), Special Use Pemrit (SUP), and Coastal Development Permit (CDP) to allow an unmanned wireless communication facility consisting of a freestanding 250 square foot equipment room and six (6) panel antennas mounted on a 31 ½ foot tall mono-palm. Quasi-public utility facilities are permitted in residential and commercial zones by a conditional use permit and all required findings for the CUP, SUP, and CDP can be made for the proposed facility. III. PROJECT DESCRIPTION AND BACKGROUND AT&T \\Tireless is requesting approval of a CUP to allow the construction and operation of a digital wireless communication facility in order to provide adequate coverage for their users. The new facility would be located behind the :Marja Acres (Country Store) commercial center. The applicant will lease a small portion of two larger parcels (5.2 acres commercial and 14.6 acres residential). The 11:arja Acres commercial center is located on the commercial site and the residential parcel consists of undeveloped residential/agricultural lands on the hillside just south of the commercial property. The project site is surrounded by agricultural fields to the south, a palm nursery to the west, and a mobile home park to the east. Of the four facilities, two are installed and operational; one is operational, but will be redesigned as a stealth facility; and one has not yet been installed. The antennas, which are 16 inches wide, 3.5 inches deep, and 4.25 feet tall, will be arranged in a triangular-shaped array. Three antennas would be installed initially and the other three would be installed at a future time. The AT&T mono-palm would be located approximately 36 feet west of the Nextel mono-palm. Five :Mexican Fan Palms surround the Nextel facility. Two additional mature Canary Island Date Palms would be arranged around the AT&T facility along with large shrubs which would be planted along the top of the slope and near the base of the palms. ·with this additional landscaping, the mono-palm will blend into the natural landscape. The 250 square foot equipment building would be constructed on the south side of the Country Store at the base of the slope, west of the Nextel and Sprint enclosures. The design of the equipment building complements the e:\.'ierior building materials and color of the County Store and foundation plants would be planted around the perimeter of the structure, similar to the other existing enclosures. IV. ANALYSIS The proposed project is subject to the following regulations: A. Residential Agriculture (R-A-10) and General Commercial Zone (C-2) (Chapters 21.08 and 21.28 of the Carlsbad :t\,funicipal Code); B. Scenic Preservation Overlay Zone (Chapter 21.40 of the Carlsbad 1v1unicipal Code); C. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); D. Coastal Development Regulations (Chapter 21.201 and 21.203 of the Zoning Ordinance); and E. City Council Policy Statement: Policy 64 -Wireless Communication Facilities. CUP 03-06/SUP 03-04/Cifc>3-I6-TAMARACK AT&T WIRELls January 7, 2004 Pa e3 The recommendation for approval of this CUP, SUP, and CDP was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. Residential Agriculture (R-A-10) and General Commercial Zone (C-2) Chapter 21.42.010(2)(1) (Conditional uses) allows accessory public and quasi-public buildings and facilities in all zones, including the C-2 commercial and R-A-10 residential zones with approval of a CUP. The equipment cabinet will be located on the C-2 zoned portion of the site. The cabinet and enclosure comply with all applicable restrictions of the C-2 zone. The proposed mono-palm will be located on the R-A-10 zoned portion of the site. Again, the project complies with all applicable regulations of the R-A-10 zone in that the pole is not located within any required setback area. The 30' height limit of the R-A-10 zone is not applicable to the mono-palm structure since it qualifies as an allowed protrusion above the height limit per Chapter 21.46.020. B. Scenic Preservation Overlay Zone The proposed mono-palm will be located approximately 300 feet from El Camino Real, which has been designated a Scenic Roadway by the City's General Plan. Consequently, the project is subject to the requirements of the El Camino Real Scenic Corridor Development Standards and requires an SUP. The view of the mono-palm will be fairly distant since it is located slightly over 300 feet away from the roadway. The surrounding natural view shed is not considered significant due to the fact that it has been partially degraded by existing development (Country Store) between the project and El Camino Real, a mobile home park development to the east, utility poles and lines along El Camino Real, and SDG&E transmission towers to the west To reduce the visibility of the facility, it has been designed as a .. stealth" mono-palm and will be surrounded by natural palms of varying heights. The palms will blend in with the palms that are located around the Nextel site and along the driveway on the west side of the site. Since there are no tall structures in the vicinity on which to locate a facility, staff encouraged AT&T Wireless to develop a stealth installation for this site. The mono-palm has also been designed so that it can accommodate a second carrier, thereby reducing the potential for visual clutter of multiple carriers on this site. The equipment building will be designed to match the existing commercial structures by using a similar colored siding and roof material. Therefore, staff has concluded that the proposal conforms to the requirements of the Scenic Preservation Corridor Overlay and is recommending approval of the SUP. C. Conditional Use Permit Regulations Conditional uses such as wireless communication facilities possess unique and special characteristics. The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. Staff has reviewed the proposed project and found that all the necessary findings can be made to approve the CUP. The required findings and supporting facts are contained in the table below. CUP 03-06/SUP 03-041c1'°3-I6 -TAMARACK AT&T \VIRELfs January 7, 2004 Pa e4 CONDITIONAL USE PERMIT FINDINGS AND RESPONSES FINDING That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, including, if applicable, the certified local coastal program, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. That the site for the intended use is adequate in size and shape to accommodate the use. That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. D. Coastal Development Regulations PROJECT CONSISTENCY The requested use is necessary and desirable for the development of the community because of the benefit and demand for mobile voice and data transmissions for businesses, individuals, public agencies and emergency service systems. The proposed use is consistent with the General Plan in that the residential and commercial land use designations do not preclude the provision of quasi-public utility uses, nor is it detrimental to existing or permitted uses in the R-A-10 or C-2 zones. The site is adequate in size and shape to accommodate the use and the proposed mono- palm and equipment building can be located on the site without the need for variances from development standards. In addition, there is adequate room to install landscaping to provide additional screening. The design and location of the equipment building will match the existing commercial buildings and will not conflict with existing circulation patterns. The mono-palm ,vill be surrounded by palm trees so that it blends in with the natural landscape. It has been designed so that it can accommodate a second carrier in the future to reduce the visual impact of multiple carriers on the site. An open space easement will be provided around the mono-palm structure to protect future uses in the event of an unforeseen structural failure. The use generates very little traffic, requiring only routine maintenance visits twice monthly and occasional visits in response to operational problems. The existing driveway will be used to access the equipment building. The site is located within the Mello II segment of the City's Coastal Zone and is subject to the corresponding land use policies and implementing ordinances. These policies and ordinances emphasize topics such as preservation of agriculture and scenic resources, protection of environmentally sensitive resources, provision of shoreline access, and the prevention of geologic instability and erosion. The commercial portion of the site is currently developed and the proposed CUP 03-06/SUP 03-04/C~B-16-TAMARACK AT&T WIREL'S January 7, 2004 Pa e5 equipment building will be located adjacent to an existing drive aisle and will be surrounded by landscaping. The mono-palm will be located on a small portion of the Residential-Agricultural zoned land; however, these lands are not designated as coastal agricultural lands, and are not subject to protection under the Local Coastal Program (LCP) as shown in Map X. The proposed facility will not affect the existing agricultural and residential uses on the site. No steep slopes will be affected by the project and no native vegetation or environmentally sensitive lands are located on the subject property. The site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. The project does not require a grading permit since site work will only consist of footings for the mono-palm and equipment building and associated trenching for the antenna cables conduits. Therefore, the project will not result in an increase in urban runoff flow, urban pollutants, or erosion and sedimentation. Since the project site is located over hvo miles from the Pacific Ocean, no shoreline development regulations apply. Since the project site is located within 300 feet of El Camino Real which is designated as a Scenic Corridor, the Scenic Preservation OYerlay Zone standards apply to the project and are analyzed in the previous section. Given the above, the project is consistent with the Mello II land use policies and the applicable implementing ordinances. E. City Council Policy Statement: Policy 64 -\Vireless Communication Facilities The City Council adopted policies regarding prioritization for the location of Wireless Communication Facilities (WCF) on October 3, 2001 (Policy 64). The guidelines state that WCFs should be located on buildings and structures, not on vacant land. In addition, preferred locations for WCFs, in order of priority, are industrial, commercial, public, other non-residential, public utility, park, or community facility property. The mono-palm is proposed to be located in the R-A-10 residential zone. Residential zones are considered ""discouraged locations" under the Policy 64 guidelines. However, WCF's may be located in "discouraged locations" if the applicant demonstrates that no feasible alternative exists within a preferred location. The applicant has submitted a map indicating the coverage needs for this facility. The areas requiring coverage are residential, with the exception of the Country Store parcel which is at the lower elevations along El Camino Real. There are no other properties in the vicinity which would be at a high enough elevation which have a non-residential land use designation and the existing commercial buildings are too low to accommodate a structure which would meet the coverage objectives. Design guidelines of the policy state that all aspects of a WCF, including the supports, antennas, screening methods, and equipment should exhibit "stealth" design techniques so they visually blend into the background or the surface onto which they are mounted. The policy encourages co-location wherever feasible and appropriate. The project complies with this policy in that the facility is a "stealth" design. The mono-palm was specifically designed to support a second carrier and it will be surrounded by mature palms which will help the installation to blend into the natural surroundings. No tall buildings exist within the vicinity of the site and the elevation of the adjacent commercially zoned property is too low to meet the coverage needs. The equipment building will be located on the commercially zoned portion of the site. CUP 03-06/SUP 03-04/C1'°3-16-TAMARACK AT&T WIREL'S January 7, 2004 Pa e6 The applicant submitted an RF emissions report to ensure that the RF emissions will not exceed the FCC guidelines. The report indicates that the RF emissions of the AT&T Wireless antennas will be well below the FCC standard for continuous public exposure. Additionally, the combined exposures of AT&T Wireless and the mono-palm containing the Nextel and Sprint facilities will not exceed the FCC standards. V. ENVIRONMENTAL REVIE\V The construction and installation of small new equipment facilities or structures qualifies as a Categorical Exemption according to Section 15303 of the State CEQA Guidelines. In addition, the Federal Communication Commission requires compliance of all PCS telecommunications facilities to comply with radio frequency power density standards (ANSI/IEEE C95.1-1992) for the general public. The Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. Therefore, the project is exempt from further environmental documentation and a Notice of Exemption will be issued upon final project determination. ATTACHMENTS: 1.
