Permit to allow the installatio~ operation and maintenance of an unmanned
wireless telecommunications facility located at 7750 Rancho Santa Fe Road in the
P-C /C-2 Zone and Local Facilities Management Zone 11.
I. RECOl\U\IENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5571
APPROVING CUP 03-24 for a period of five (5) years based on the findings and subject to the
conditions contained therein.
II. INTRODUCTION
This application is a request for a Conditional Use Permit (CUP) to allow Ne}..1:el
Communications to install, operate and maintain an unmanned wireless telecommunications
facility consisting of eight roof mounted equipment cabinets and twelve antennas that are
concealed within the existing walls of a commercial building at the Rancho La Costa Village
shopping center in the P-C zone. The La Costa Master Plan designates the commercial center for
C-2 (General Commercial Zone) uses. Quasi-public utility facilities are permitted in any zone by
conditional use permit. The project is consistent with \Vireless Communications Facilities
Council Policy 64 and all required conditional use permit findings can be made for the proposed
telecommunications facility.
III. PROJECT DESCRIPTION AND BACKGROUND
The proposed CUP is requested to allow the installation of a Nextel Communications PCS
facility at the Rancho La Costa Village shopping center located on the southeast comer of
Rancho Santa Fe Road and La Costa Avenue. The proposed facility consists of eight equipment
cabinets mounted on the roof and concealed within an existing cupola and a total of 12 panel
antennas that will be recessed into exterior walls and concealed by a signal transparent material
that is textured and painted to match the existing building surface. The antennas will be installed
in sectors of four on the northwestern elevation of Sav-On and the northeastern and southern
elevations of commercial retail shops located adjacent to La Costa A venue.
Nextel Communications is a nationwide wireless carrier licensed by the Federal Communications
Commission (FCC) to proYide personal communications services to the community. The

proposed facility is necessary to reduce capacity and coverage deficiencies in the vicinity of the
site.
The proposed project is subject to the following regulations:
A. Conditional Use Permit Regulations (Chapter 21.42 of the CMC); and
B. City Council Policy 64).
IV. ANALYSIS
A. Conditional Use Permit Regulations
Conditional uses such as digital communications facilities possess unique and special
characteristics that make it impractical to include them as permitted uses "by right" in any of the
various zoning classifications (i.e., residential. commercial, office, industrial). The authority for
the location and operation of these uses is subject to Planning Commission revie"· and the
issuance of conditional use permits. Staff has reviewed the proposed project and found that all
the necessary findings can be made to approve the conditional use pemrit. The required findings
and satisfaction of these findings are provided below.

B. Council Policy 64
The project is also consistent with Council Policy 64 -Development Guidelines for Wireless
Communication Facilities. The proposed location on a commercial building is a preferred
location, and the stealth design, (i.e., equipment cabinets concealed within an existing cupola and
antennas recessed into existing exterior walls and concealed behind signal transparent material
textured and painted to match the existing building surface), ¥.rill eliminate the facility's visibility
to the public. The preliminary RF exposure report prepared by the applicant indicates that the
cumulative RF exposure from all facilities at the site will not exceed FCC Exposure Guidelines
and the project implementation report required within 6 months after the issuance of occupancy
must verify compliance.
V. ENVIRONMENTAL REVIEW
The construction and installation of small new equipment facilities or structures is a Class 3
Categorical Exemption under the California Environmental Quality Act (Guidelines Section
15303 ). The FCC requires compliance with radio frequency power density standards
(ANSI/IEEE C95.1-1992) for the general public; therefore, the project would not have a
significant impact on the environment. A Notice of Exemption will be filed by the Planning
Director upon project approval.
