AGENDA OF: March 3, 2004 ItemNo.@ Application complete date: January 20, 2004 Project Planner: Barbara Kennedy Project Engineer: David Rick SUBJECT: CUP 03-28/CDP 03-44 -GRAND PACIFIC PALISADES WF -Request for a Conditional Use Permit and Coastal Development Permit to allow the installation of an unmanned wireless communication facility on an existing building at the Grand Pacific Palisades Resort. The resort is located at 5805 Armada Drive in the C-T-Q/C-2-Q Zones and Local Facilities Management Zone 13. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 5572 and 5573 APPROVING Conditional Use Permit No. CUP 03-28 and Coastal Development Permit No CDP 03-44 for a period of five (5) years, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a Conditional Use Permit and Coastal Development Permit to allow an unmanned Wireless Communication Facility (WCF) consisting of four ( 4) panel antennas and an associated equipment area at the Grand Pacific Palisades Resort located at 5805 Armada Drive. The zoning of the site allows, by conditional use permit, quasi-public utility facilities such as the proposed WCF. All required findings for the Conditional Use Permit and Coastal Development Permit can be made, and staff recommends approval for the proposed facility. III. PROJECT DESCRIPTION AND BACKGROUND Sprint PCS is proposing an unmanned WCF at the building located at 5805 Armada Drive in the Grand Pacific Palisades Resort. The resort is located on a high point above Palomar Airport Road and is bordered by open-space zoned lands (the flower fields) to the west and south, LEGOLAND and Armada Drive to the east, and existing and developing office and research use to the north. The WCF will consist of four panel antennas hidden behind architectural elements of the building. Two antennas are proposed to be mounted within an existing cupola and two more within a recessed area at the front of the hotel. Nextel currently has an antenna located and screened within the cupola. All of Sprint's antennas will be screened by RF transparent material, painted and textured to match the existing building materials. The associated equipment consists of three cabinets located in a recessed area of the roof The equipment will be screened from public view by enclosing two windows (with a view only to this roof space) and covering the equipment with an overhead lattice painted to match the existing building fa9ade. The equipment installation area will encompass approximately 220 square feet. CUP 03-28/CDP 03-44 -~ND PACIFIC PALISADES WF - March 3, 2004 Pa e2 The applicant, Sprint PCS, has been authorized by the Federal Communications Commission (FCC) to construct and operate a digital PCS network throughout California. The proposed site was chosen by the applicant because of its location and elevation which will enable Sprint to meet the capacity and coverage needs in this area. The proposed project is subject to the following regulations: A. C-T, Commercial-Tourist Zone; and C-2, General Commercial Zone (Chapters 21.28 and 21.29 of the Zoning Ordinance); B. Qualified Development Overlay Zone (Chapter 21.06 of the Zoning Ordinance); C. Carlsbad Ranch Specific Plan (SP 207); D. Conditional Use Permit regulations (Chapter 21.42 of the Zoning Ordinance); E. Wireless Communication Facilities Policy (City Council Policy 64); F. Comprehensive Land Use Plan for McClellan-Palomar Airport; G. Coastal Development Regulations (Chapter 21.201 and 21.203 of the Zoning Ordinance); and H. Growth Management. IV. ANALYSIS Staff developed its approval recommendation after analyzing the project's consistency with the applicable City regulations listed above. A discussion on the compliance with each of the regulations follows. A. Commercial -Tourist and General Commercial Zones The proposed facility is consistent with all development standards of the Commercial-Tourist and General Commercial zones. Its location inside the rooftop cupola and screened within the building walls complies with setback, lot coverage, and building height requirements and does not require additional parking. Zoning Ordinance conditional use permit regulations (Section 21.42.010 (2)(J)) allow accessory public and quasi-public utility facilities in all zones by approval of a Conditional Use Permit (CUP). Required CUP findings ( discussed in Section D below) can be made for the proposed WCF as it is a desirable public convenience and is compatible with its surroundings. Qualified Development Overlay Zone The Zoning Ordinance designates the project site with a "Q" Overlay Zone because of its sensitive location. However, additions of no more than 1,000 square feet to commercial buildings in commercial zones are exempt from the Overlay Zone provisions. The facility, proposing no expansion to a commercially zoned resort building, is also exempt. C. Carlsbad Ranch Specific Plan The Grand Pacific Resort is within the Carlsbad Ranch Specific Plan boundaries. The proposed WCF is consistent with all applicable regulations, including the goals of the Specific Plan and development standards expressly for the Grand Pacific Resort planning area in that the installation of the panel antennas will be screened from public view. D. Conditional Use Permit Regulations Conditional uses such as WCFs possess unique and special characteristics that make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e. residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. Staff has reviewed the proposed project and found that all the necessary findings can be made to approve the CUP. The required findings and satisfaction of these findings are provided below. The proposed location on an existing building in a commercial zone is a preferred location and the stealth design (i.e., entirely hidden within the walls and cupola, with the roof-mounted equipment entirely screened) will completely limit the facility's visibility to the public. F. Comprehensive Land Use Plan For McClellan-Palomar Airport (CLUP) The project is located within the boundaries of the CLUP. Airport noise will not have an impact on the facility nor will the facility interfere with airport activities. Therefore, the proposal will be compatible with airport operations. G. Coastal Development Regulations The site is located within the Mello II segment of the City's Coastal Zone and is subject to the corresponding land use policies and implementing ordinances (Sections 21.201 and 21.203). These policies and ordinances emphasize topics such as preservation of agriculture and scenic resources, protection of environmentally sensitive resources, provision of shoreline access, and the prevention of geologic instability and erosion. The site is currently developed and the proposed facility will be located entirely within an existing structure. No agricultural or environmentally sensitive lands exist on site. Since the project site is located approximately one mile from the Pacific Ocean, no shoreline development regulations apply. No scenic resources exist on or near the developed site. Given the above, the project is consistent with the Mello II land use policies and the applicable implementing ordinances. CUP 03-28/CDP 03-44 -GL PACIFIC PALISADES WF - March 3, 2004 Pae 5 H. V. ENVIRONMENTAL REVIEW The proposal is exempt from the California Environmental Quality Act (CEQA). CEQA Section 15303 exempts construction and installation of small new equipment facilities or structures. Additionally, as Sprint PCS must comply with FCC regulations, radio frequency emissions from the proposed facility are not considered a health hazard.
