I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5593, APPROVING Conditional Use Permit CUP 03-25 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The proposal involves the collocation and operation of a Wireless Communications Facility (WCF) at the Olivenhain Municipal Water District (OMWD) site, located at the southwest corner of Rancho Santa Fe Road and Olivenhain Road. The proposed facility would consist of 12 panel antennas and 1 equipment cabinet, located on a recently approved (June 4, 2003) "monopine" (CUP 03-03). The proposed telecommunications facility is consistent with all applicable regulations and staff has no issues with the proposal. ID. PROJECT DESCRIPTION AND BACKGROUND Nextel Communications is requesting approval of a Conditional Use Permit to allow the collocation and operation of a WCF located within the OMWD headquarters site. The site is located at the south,vest comer of Olivenhain Road and Rancho Santa Fe Road in the southeast quadrant of the City. The site is designated Government and Office (G/O) in the City's General Plan and is zoned Office (0). The site is currently occupied by the OMWD general offices, associated maintenance yard and communications facilities, and by the approved Cingular Wireless ··monopine" and equipment cabinets. These facilities include buildings, large paved areas, a lattice tower for OMWD communications, and landscaped areas including tall trees. To the north and west of the site, across Olivenhain Road and Rancho Santa Fe Road, are single- family residential uses. To the south and east of the project site are open space areas. On June 4, 2003, the Planning Commission approved a PCS communications facility consisting of a 45-foot high ··monopine" fashioned with simulated bark, branches and needles to appear as a pine tree for Cingular Wireless. The approved ··monopine" consists of 12 antennas located approximately 40-feet in height for Cingular Wireless. Nextel is proposing an additional 12 0 CUP 03-25 -NEXTEL-wlT OLIVENHAIN April 7, 2004 Page2 - panel antennas located at approximately 32-feet in height on the approved ""monopine." The proposed equipment cabinet would be located adjacent to the approved '"monopine" and will be painted to match the exterior color of the surrounding buildings. Both the ··monopine" and the equipment cabinet are located in the center of the site, surrounded by existing buildings and/or landscaping, thus reducing any visual impacts to the surrounding areas The Nextel WCF proposal is subject to the following regulations: A. General Plan; B. Office Zone (Chapter 21.27 of the Zoning Ordinance); C. Conditional Use Ordinance (Chapter 21.42 of the Zoning Ordinance); and D. Wireless Communication Facilities Policy (City Council Policy No. 64). IV. ANALYSIS The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of these regulations/policies utilizing both text and tables. A. General Plan Given the limited nature of the proposed development, there are very few General Plan provisions that apply to the proposed WCF. The General Plan Land Use designation of the site is Government and Office. Quasi-public facilities are consistent with the Government and Office land use designations, as well as being consistent with the existing governmental office, maintenance yard, and communication uses currently occupying the OMWD site. The provision of wireless communication facilities for general and emergency use is beneficial to the community. The proposed use generates negligible traffic, does not generate any significant noise, involves no grading or earthwork, and has virtually no impact to existing facilities. Given the above, the proposed Nextel WCF is consistent with the City's General Plan. B. Office Zone The project site is zoned Office and, therefore, subject to the provisions of Chapter 21.27 of the Zoning Ordinance. With regard to permitted uses, Section 21.42.0l0(J) states that quasi-public facilities are conditionally allowed in all zones through the approval of a Conditional Use Permit. Section C below discusses the project's conformance with the provisions of the Conditional Use Ordinance. With regard to development standards of the Office Zone. Table 1 below describes the project's conformance ,vith those provisions applicable to the proposed WCF. Conditional Use Ordinance Compliance Yes Yes Yes According to Section 21.42.0lO(J) of the Zoning Ordinance, quasi-public facilities are allowed in all zones with the approval of a Conditional Use Permit. Four findings must be made in order to approve a Conditional Use Pemlit. These findings, elaborated in Planning Commission Resolution No. 5593, deal with the project's consistency with the General Plan, desirability for the community, and compatibility with its site and surroundings. The proposed \VCF site is desirable and necessary because wireless communication facilities are an integral part of the built environment defined by the General Plan by providing wireless communication access for general and emergency uses. As discussed above, the project is consistent with the General Plan and Zoning designations of the site. The project consists of a collocation on an approved "monopine" which is 45-feet in height. The proposed panel antennas will be located at a height of 32-feet, or four feet below the approved Cingular \Vireless antennas. All of the proposed features can fit within the existing site without need for expansion or reduced setbacks. The proposed ·•monopine" design serves to screen the panel antennas from public views and the proposed equipment cabinets are to be located adjacent to the existing ""monopine" and painted to match the surrounding buildings. The existing street system is adequate to accommodate the \VCF as the traffic generated by such a use invokes only periodic maintenance and repair and will have negligible impacts to the surrounding roadways. Given the above, the required findings for a Conditional Use Pem1it can be made for the proposed Nextel \VCF. CUP 03-25 -NEXTEL-WIT OLNENHAIN April 7, 2004 Page4 D. Wireless Communication Facility Policy - All commercial providers of wireless communication services are subject to City Council Policy No. 64, issued on December 16, 2003. Given the above, the proposed Nextel WCF is consistent with the Wireless Communication Facility Policy (Policy 64). V. ENVIRONMENTAL REVIEW The construction and installation of small new equipment facilities or structures qualifies as a Categorical Exemption according to Section 15303 of the State CEQA Guidelines. In addition. the Federal Communication Commission requires compliance of all PCS telecommunications facilities to comply with radio frequency power density standards (ANSI/IEEE C95.1-1992) for the general public. The Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project.
