AGENDA OF: June 2, 2004 Project Planner: Saima Qureshy Project Engineer: David Rick SUBJECT: CDP 03-15 - CARLSBAD BOULEVARD HOME - Request for approval of a Coastal Development Permit to allow for the construction of a new 4,766 square foot single-family residence within the City's Coastal Zone. The subject property is located along the east side of Carlsbad Boulevard between Tamarack Avenue and Redwood Avenue within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5627 APPROVING Coastal Development Permit CDP 03-15 based upon the findings and subject to the conditions contained therein. H. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single- family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. The proposed residence is consistent with the Mello II segment of the City's LCP. The project site is not located within the appeal jurisdiction of the Coastal Commission. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. ifi. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infihl lot located along the east side of Carlsbad Boulevard between Tamarack Avenue and Redwood Avenue, as shown on the attached location map. The undeveloped lot is predominately flat and has an area of .106 acres (4,613 square feet). The property is located within the Beach Area Overlay Zone of the Local Coastal Program. Surrounding Development: The subject site is surrounded by single-family residences to the north and east, a restaurant (Vigilucci's) to the south and Carlsbad Boulevard to the vest. Proposed Residential Construction: The applicant is proposing to construct a new 4,766 square foot residential structure. The two-story structure will be constructed of wood framing with stucco and hardiplank siding with a shingle roof. Proposed Grading: Based upon a review of the proposed grading quantities shown on the site plan, a grading permit for this project is required. * CDP 03-15 - CARLSBaOIJLEVARD HOME June 2, 2004 Impact on Coastal Resources: The development is a single-family house on a previously subdivided lot; no agricultural activities, sensitive resources, geological instability, flood hazard or coastal access opportunities exist onsite and the development does not obstruct views of the coastline as seen from public lands or public right-of-way or otherwise damage the visual beauty of the coastal zone. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 5627. Conformance with the Certified Local Coastal Program and all applicable policies The project is located in the Mello II Local Coastal Program Segment. The project includes the construction of a new 4,766 square foot, two story, single-family residence in an area designated for residential development. As discussed below, the project complies with the applicable LCP provisions. The LCP Land Use Plan designates the subject site for Residential High (RH: 15 - 23 du/ac) density development, which allows 19 du/ac, at the Growth Management Control Point. Based on a density of 19 du/ac, the lot could accommodate two dwelling units. The proposed density of the project, at 10 dwelling units per acre, is below the growth management control point (19 du/ac) used for the purpose of calculating the City's compliance with Government Code Section 65584. However, consistent with Program 3.8 of the City's certified Housing Element, all of the dwelling units, which were anticipated toward achieving the City's share of the regional housing need that are not utilized by developers in approved projects, are deposited in the City's Excess Dwelling Unit Bank. These excess dwelling units are available for allocation to other projects. Accordingly, there is no net loss of CD? 03-15 -. CARLSBAIOI.REVARD HOME June 2. 2004 residential unit capacity and there are adequate properties identified in the Housing Element allowing residential development with a unit capacity, including second dwelling units, adequate to satisfy the City's share of the regional housing need. The proposed residence will be located along the east side of Carlsbad Boulevard between Tamarack Avenue and Redwood Avenue. The two-story custom built residence is consistent with the surrounding development of one- and two-story single-family structures. The two-story residence will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the sit; nor are there any sensitive resources located on the undeveloped property. The proposed residence is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The residentially designated site is not suited for water-oriented recreation activities. 2. Coastal Overlay Zones The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. Based upon a review of the proposed grading quantities, a grading permit for this project is required. Construction of the project will adhere to the Citis Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. The subject site is also located within the Beach Area Overlay Zone and is in compliance with its development standards by providing one visitor parking space on- site. Council Policy 44— Neighborhood Architectural Design Guidelines New single-family residential projects of less than 5 homes are required to comply with numbers 4, 5, 7, 13, and 14, of the City's Neighborhood Architectural Design Guidelines. These guidelines require separate building planes on front and rear elevations, recessed or projected doors and windows, and specific architectural design elements. The proposed single-family residence satisfies all of the required Neighborhood Architectural Design Guidelines as shown in the table below. Only the items noted in the table are required for new single-family construction of less than 5 homes. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemption listed below: Section 15303(a) of CEQA exemptions (Class 3) exempts the construction of single- family residences in urbanized areas from environmental review.
