II. BACKGROUND This item was continued from the October 6, 2004 meeting for revisions to the interior walls of the first and second floor. The applicant was directed to make these modifications due to concerns that the single-family home would be converted into a two-unit development. The applicant has reduced the amount of wall area between the foyer and the family/living rooms on the first and second floors. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5746 APPROVING Coastal Development Permit CDP 03-36 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single- family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The project complies with the requirements of the Zoning Ordinance (R-3), the Beach Area Overlay Zone (BAOZ), and the Local Coastal Program (LCP). Staff is recommending approval of the request. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The .081-acre (3,520 sq ft) site is located within Local Facilities Management Zone 1. The site is bordered to the north by a two-family residence, to the south by a single-family residence, to the west a hotel and timeshare, and to the east by apartments. Topographically, the site is relatively flat with an existing single-family residence. The existing lot and single-family residence are considered nonconforming due to lot size and setbacks. The property does not have any sensitive vegetation or steep slope constraints and the entire site is considered developable. An Administrative Variance (AV 03-04) was granted by the Planning Director to reduce the front yard setback from 20 feet to 16 feet on September 24, 2004. AV 03- 04 was approved because the lot is a legal non-conforming lot due to lot size. The existing nonconforming residence has a front yard setback of 9-feet. Access to the project site is from Garfield Street. Proposed Residential Construction: The applicant is proposing to construct a new 2,465 square foot single-family structure. The two-story structure will be constructed of wood framing with ~, ""•+;' CDP 03-36 -NASSAR REfmENCE October 6, 2004 Pao-e 2 stucco and s-shape tile roof. The project is located in the Beach Area Overly Zone (BAOZ) and is required to provide one covered and one uncovered parking space. Proposed Grading: A grading permit will be required for the project. Grading will consist of the 90 cubic yards of fill, which will be imported. Impact on Coast_al Resources: The development is a single-family house on a previously developed lot; no agricultural activities, sensitive resources, geological instability, flood hazard or coastal access opportunities exist onsite and the development does not obstruct views of the coastline as seen from public lands or public right-of-way or otherwise damage the visual beauty of the coastal zone. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicabl~ regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 5746. Conformance with the Certified Local Coastal Program (LCP) and all applicable policies The project is located in the Mello II segment of the Local Coastal Program. The project includes the construction of a new two-story single-family residence in an area designated for single to multi-family residential development. As discussed below, the project complies with the applicable Local Coastal Program provisions. The LCP Land Use Plan designates the subject site for Residential High (RH) density development, -CDP 03-36 -NASSAR RESIDENCE October 6, 2004 Page 3 which allows 19 du/ac at the Growth Control Point. Based on a density of 19 du/ac, the lot could accommodate one dwelling unit. The proposed residence will be located along the west side of Garlield Street south of Pine A venue. The two-story, custom-built residence is consistent with the surrounding development of one-and two-story single and multi-family structure~. The two-story residence will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the previously developed property. The proposed residence is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subjeet site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The residentially designated site is not suited for water-oriented recreation activities. 2. Coastal Overlay Zones The subject site is located in the Coastal Resource Protection Overlay Zone. However, due to its location and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. Based upon a review of the proposed grading quantities, a grading permit for this project is required. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. Council Policy 44-Neighborhood Architectural Design Guidelines New single-family residential homes are required to comply with numbers 4, 5, 7 and 13 of the City's Neighborhood Architectural Design Guidelines. These guidelines require separate building planes on front and rear elevations, recessed or projected doors and windows, and specific architectural design elements. The proposed single-family residence satisfies all of the required Neighborhood Architectural Design Guidelines as shown in the table below.
