AGENDA OF: August 3, 2005 Conditional Use Permit ltemNo. @ Application complete date: May 10, 2005 Project Planner: Pam Drew Project Engineer: Bill Plummer SUBJECT: CUP 05-12 -POINSETTIA COMMUNITY PARK -A request for a Conditional Use Permit to allow for the continued operation of the Poinsettia Community Park (previously called Alta Mira Community Park) located east of Paseo Del Norte, south of Palomar Airport Road and north of Camino de Las Ondas in the PC & OS Zones within Local Facilities Management Zone 20. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5930 APPROVING Conditional Use Permit CUP 05-12 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The proposed Conditional Use Permit CUP 05-12 will allow the continued operation, for an unlimited period of time, of the Poinsettia Community Park located east of Paseo Del Norte, south of Palomar Airport Road and north of Camino de Las Ondas. The community park has operated in conformance with the required conditions of approval of its approved CUP 92-05, which has since expired. III. PROJECT DESCRIPTION AND BACKGROUND On October 7, 1992 the Planning Commission approved a Negative Declaration (Resolution No. 3433), CUP 92-05 (Resolution No. 3434) and HDP 92-09 (Resolution No. 3435) to allow for the construction and operation of a 42 acre community park containing active and passive recreational uses and facilities located east of Paseo Del Norte, south of Palomar Airport Road and north of Camino de Las Ondas. The CUP has since expired and a new CUP application is required to allow the community park to continue to operate at its present location. The applicant, City of Carlsbad, is requesting that the Planning Commission approve CUP 05-12 to allow the continued operation of the community park at this site for an unlimited period of time. This CUP Resolution No. 3430 includes previous conditions of approval that are still applicable to this CUP even though some of the conditions have already been satisfied. To ensure that the community park remains consistent with the General Plan and compatible with the surrounding uses, several new conditions have been added to bring the project up to date with current City of Carlsbad practices and California State regulations, such as granting this CUP for an unlimited period of time and storm water quality regulations, which includes, but is not limited to, CUP 05-12 -POINSETTIA IMMUNITY PARK August 3, 2005 Page 2 implementing Best Management Practices (BMPs) to mm1m1ze storm water contact with pollutants. Conditional Use Permits for Capital Improvement Projects are typically granted for an unlimited period of time. The CUP will be reviewed by the Planning Director annually to determine if all conditions of this project have been met and that the use does not have a substantial detrimental effect on surrounding land uses and the public's health and welfare. IV. ANALYSIS The recommendation to approve CUP 05-12 was developed by analyzing the project's consistency with the applicable City regulations. The four findings required for approval of a Conditional Use Permit can be made, specifically: A. That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is located. The continued operation of the community park is compatible with surrounding development, provides adequate landscape buffers and setbacks, protects natural open space, accommodates the trail system, provides quality park facilities and recreational programs to ensure that residents of the City are afforded the opportunity to enjoy the optimum leisure experiences, both active and passive. The community park is not detrimental to the existing uses or to uses specifically permitted in the zone in which the proposed use is to be located since all necessary parking is provided onsite. In addition, the lights for the active sports fields would remain on in the evenings no later than 10:00 PM and light spillage and glare on adjacent properties would be minimized; B. That the site for the intended use is adequate in size and shape to accommodate the use as evidenced by the fact that the proposal meets all required ordinances, has many active sports facilities and still preserves natural open space areas onsite; C. That all the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained as is evidenced by the property line setbacks, landscape buffering and screening on slopes and along property lines; and D. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use because access to the project is provided by a non- loaded collector street and onsite circulation is facilitated by 24 foot wide driveways that lead to onsite parking areas and can accommodate two-way traffic. As conditioned, the Poinsettia Community Park does provide a much-needed service to the neighborhood and does not adversely affect the environment. ENVIRONMENTAL REVIEW The Planning Director has determined that this project (CUP 05-12) is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
