AGENDA OF: December 21, 2005 Application complete date: October 25, 2005 Project Planner: Pam Drew Project Engineer: Taniya Barrows SUBJECT: CUP 00-29xl -TECHBILT WAREHOUSE SD-377-04 -Request for a five- year extension of CUP 00-29 to allow the continued operation of a cellular communication facility on an existing building at 2875 Loker Avenue East in the PM Zone and Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6004 APPROVING a five-year extension of CUP 00-29 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION This proposed five-year extension of CUP 00-29 will allow the continued operation of a cellular communication facility on an existing building at 2875 Loker Avenue East from January 3, 2006 through January 2, 2011. III. PROJECT DESCRIPTION AND BACKGROUND On January 3, 2001 the Planning Commission approved CUP 00-29 to allow the installation of a cellular communication facility on an existing building at 2875 Loker Avenue East. Condition No. IO of the approving CUP Resolution No. 4890 specifies that CUP 00-29 is granted for a period of 5 years but may be extended upon written application of the permittee (T-Mobile USA, Inc.). The applicant, T-Mobile USA, Inc., is requesting a 5-year extension of CUP 00-29 to allow the continued operation of a cellular telecommunication facility at this site from January 3, 2006 through January 2, 2011. IV. ANALYSIS A. The cellular telecommunication facility continues to be consistent with all applicable plans, policies and regulations described below: I. Carlsbad General Plan; 2. Local Facilities Management Plan 5; 3. Palomar Airport CLUP; 4. Title 21 of the Carlsbad Municipal Code; 0 -CUP 00-29xl -TECHBILT'•,,-'AREHOUSE SD-377-04 December 21, 2005 Pae 2 5. Chapter 21.42 (Conditional Use Permits); 6. Carlsbad Airport Business Center Specific Plan (SP-200); 7. Policy 64 -Wireless Communication Facilities; and 8. Planned Industrial Zone (P-M) (Chapter 21.34 of the Carlsbad Municipal Code). B. The adopted project findings for CUP 00-29, which are contained in Planning Commission Resolution No. 4890 still apply to this project (CUP 00-29xl). C. The adopted project conditions for CUP 00-29, which are contained in Planning Commission Resolution No. 4890 still apply to this project (CUP 00-29xl) with the exception of Conditions No. 6, 7, 11, 14, 15, 16, 17 and 18 which have been satisfied, and Condition No. I 0, which is amended by Condition No. 4 in Planning Commission Resolution No. 6004 to extend CUP 00-29xl for 5 years from January 3, 2006 through January 2, 2011. D. No formal written complaints regarding CUP 00-29 have been submitted to the City. E. Annual reviews have been conducted for CUP 00-29 and the project is in compliance with all conditions of approval. F. City Council Policy 64 -Wireless Communication Facilities The project is consistent with City Council Policy 64 Wireless Communication Facilities. The proposed location on an existing office building in the Planned Industrial zone, which is a preferred location, and the stealth design (the antennas and supports are textured and painted to match the existing building) will limit the facility's visibility to the public. G. The extended CUP is exempted from environmental review per Section 15301, Existing Facilities, of CEQA. V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
