AGENDA OF: March 5, 2008 ItemNo. G) Application complete date: July 9, 2007 Project Planner: Chris Garcia Project Engineer: David Rick SUBJECT: CDP 07-12 -SEARS RESIDENCE -Request for approval of a Coastal Development Permit to allow for the construction of a 3,200 square foot single family residence within the City's Coastal Zone located at 4015 Sunnyhill Drive within the Mello II Local Coastal Program Segment and Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6400 APPROVING Coastal Development Permit CDP 07-12 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. There are no unresolved issues. The staff recommendation of approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The undeveloped, infilllot, is located at 4015 Sunnyhill Drive as shown on the attached location map. The lot area is .36 acres (15,895 square feet) and is not located in the appeal jurisdiction of the California Coastal Commission. The lot has previously been disturbed by landscaping, but is currently cleared. Proposed Residential Construction: The applicant is proposing a new two story single family residence totaling 3,200 square feet with an attached garage and storage area. Proposed Grading: Estimated grading quantities include 0 cubic yards ( cy) of cut, 225 cy of fill with 115 cy from on site footings and foundation and 110 cy of import. A grading permit will be required for this project. Impact on Coastal Resources: The development is a single family residence on a vacant lot; no agricultural activities, sensitive resources, geological instability, or flood hazard exist onsite and • • CD P 07-12 SEARS RESIDENCE Jan uary 31, 2008 PA GE2 the development does not obstruct views of the coastline as seen from public lands or public t-of-way or otherwise damage the visual beauty of the coastal zone. righ IV. ANALYSIS project is subject to the following regulations and requirements: General Plan RLM (Residential Low-Medium Density) designation; R-1-15000 (Single-Family Residential) Zone (Chapter 21.10 ofthe CMC); Coastal Development Regulations for the Mello II LCP Segment and Coastal Resource Protection Overlay Zone; and Growth Management (Chapter 21.90 of the CMC). The recommendation for approval of this project was developed by analyzing the project's sistency with the applicable city regulations and policies. The project's compliance with each he above regulations is discussed in detail in the sections below. con oft A. Mello II LCP Segment The project site is located within the Mello II Segment of the Local Coastal Program and is not in the appeal jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203) ofthe Carlsbad Municipal Code. The project proposes to construct a new 3,200 square foot single family residence with garage and storage in an area designated for single family development. The subject site has an LCP Land Use Plan designation of RLM (Residential Low-Medium Density), which allows for 3.2 dwelling units per acre at the Growth Management Control Point. The proposed single-family residence is consistent with the land use type and density regulations for the property. The proposed two-story, single-family residence would be consistent with the surrounding development of one and two-story single-family structures. The two-story residence will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The proposed single-family residence is not located in an area of known geologic instability or flood hazard. Since the site is not located in close proximity to the coast, no public opportunities for coastal shoreline access are available from the subject site. The residentially designated site is not suited for water-oriented recreation activities. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run off, pollutants and soil erosion. No development is proposed in areas of steep slopes (coastal bluff) and no native vegetation is located on the subject property. The site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. CDP 07-12 SEARS RESIDEIE January 31,2008 PAGE4 D. Growth Management • The proposed project is located within Local Facilities Management Zone 1 in the northwest quadrant of the City. The project will create little impact on local facilities because it is only a single-family residence. Impacts on public facilities are identified on the Local Facilities Impact Assessment Form attached to this report. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemption listed below: (1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
