AGENDA OF: November 19, 2008 Application complete date: May 23, 2007 Project Planner: Chris Garcia Project Engineer: Tec la Levy SUBJECT: CDP 07-10 - SALEM RESIDENCE LOT 9 - Request for approval of a Coastal Development Permit to allow for the construction of a 3,258 square foot single family residence located at 957 Alyssum Road within the Mello I segment of the City's Local Coastal Program and Local Facilities Management Zone 4. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6510 APPROVING Coastal Development Permit CDP 07-10 based upon the findings and subject to the conditions contained therein. II.INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. There are no unresolved issues. The staff recommendation of approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The undeveloped infill lot is located at 957 Alyssum Road as shown on the attached location map. The lot area is .15 acres (6,408 square feet) and is not located in the appeal jurisdiction of the California Coastal Commission. The vacant lot is a part of the original Sea Pines Unit 1 subdivision (CT 83-02) approved in 1983. The lot was never developed, but is .part of the Vista Pacifica Home Owners Association and is subject to their CC&Rs which include design review. Proposed Residential Construction: The applicant is proposing a new two story single family residence totaling 3,258 square feet with an attached 476 square foot garage. Proposed Grading: Estimated grading quantities include 50 cubic yards (cy) of cut with 50 cy of export. A grading permit will not be required for this project. Impact on Coastal Resources: The development is a single family residence on a vacant lot; no agricultural activities, sensitive resources, geological instability, or flood hazard exist onsite and c CDP 07-10 - SALEM RESIDENCE LOT 9 November 19, 2008 Page 2 the development does not obstruct views of the coastline as seen from public lands or public right-of-way or otherwise damage the visual beauty of the coastal zone. IV. ANALYSIS The project is subject to the following regulations and requirements: A. General Plan RM (Residential Medium Density) designation; B. RD-M (Residential Density Medium) zone (Chapter 21.24 of the Carlsbad Municipal Code; C. Coastal Development Regulations for the Mello I LCP Segment and Coastal Resource Protection Overlay Zone (Chapters 21.201 and 21.203 of the Carlsbad Municipal Code); and D. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code) The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable city regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan The proposed project is consistent with the policies and programs of the General Plan. The property has a General Plan designation of RM. The RM designation allows the development of a single-family residence on any legal lot that existed prior to October 28, 2004, and which is designated and zoned for residential use. The proposed single-family residence is consistent with the land use type and density regulations for the property. B. RD-M Zone Regulations As shown on the RD-M zone and Coastal Development Compliance Tables 1 and 2 below, the proposed development is in compliance with all RD-M zoning and all applicable Local Coastal Plan regulations. Mello I LCP Segment The project site is located within the Mello I Segment of the Local Coastal Program and is not in the appeal jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203) of the Carlsbad Municipal Code. The project proposes to construct a new 3,258 square foot single family residence with attached two-car garage in an area designated for residential development. The subject site has an LCP Land Use Plan designation of RM (Residential Medium Density), which allows for 6.0 dwelling units per acre at the Growth Management Control Point. The proposed single-family residence is consistent with the land use type and density regulations for the property. The proposed two-story, single-family residence would be consistent with the surrounding development of one and two-story single-family homes. The two-story residence will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The proposed single-family residence is not located in an area of known geologic instability or flood hazard. Since the site is not located in close proximity to the coast, no public opportunities for coastal shoreline access are available from the subject site. The residentially designated site is not suited for water-oriented recreation activities. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run off, pollutants and soil erosion. No development is proposed in areas of steep slopes (coastal bluff) and no native vegetation is located on the subject property. The site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. CDP 07-10 - SALEM RESIDENCE LOT 9 November 19,2008 Page 4 D. Growth Management The proposed project is located within Local Facilities Management Zone 4 in the southwest quadrant of the City. The project will create little impact on local facilities because only one single-family residence is proposed. There are no special conditions or requirements within the Zone 4 Local Facilities Management Plan that apply to this single-family residential project. However the project is conditioned to pay the appropriate public facility fees, water and sewer connection fees, traffic impact fees, and school fees. All facility improvements necessary to accommodate the development will be in place prior to, or concurrent with development. Therefore, the project is consistent with the Zone 4 Local Facilities Management Plan. At the RM Growth Management Control Point of 6.0 dwelling units per acre, 1.0 dwelling unit is allowed on the subject site. The project proposes 1 dwelling unit and is .16 of a unit over the GMCP. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemption listed below: A. Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
