AGENDA OF: September 18, 2013 Project Planner: Christer Westman Project Engineer: Steve Bobbett SUBJECT: SDP 12-05 – FAITH COMMUNITY CHURCH – Request for a determination that the project is within the scope of a previously certified Environmental Impact Report (EIR 91-04 Rancho Carrillo) and for approval of a Site Development Plan for the development of a 34,308 square foot church building which includes a 500 seat sanctuary, child daycare center for 40 children, church classrooms, and administrative offices on a 3.44 acre site, Village “T” of the Rancho Carrillo Master Plan (MP 139), generally located at the northeast corner of El Fuerte and Rancho Pancho in Local Facilities Management Zone 18. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7013 APPROVING Site Development Plan SDP 12-05 based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND Village “T” is located within the boundaries of the Rancho Carrillo Master Plan (MP 139), which was approved by the City Council on October 21, 1997. The purpose of the master plan is to provide for the orderly development of Rancho Carrillo, while preserving the environmental resources of the area. Grading for the entire master plan area was approved under Hillside Development Permit HDP 91-17. For planning purposes, the Rancho Carrillo Master Plan is divided into Villages “A” – “T.” The master plan identifies the allowable type and intensity of land uses in each village and provides general development and design standards, requirements, and the method by which the Rancho Carrillo Master Plan will be implemented. The proposed church and child day care center uses are permitted within Village “T” by the Master Plan and underlying Community Facilities (CF) zoning and a Site Development Plan (SDP) is needed to develop the site. In the original Master Plan, Village “T” carried the Residential Medium Density (RM) General Plan Land Use designation (4-8 units per acre) with a three year reservation for Community Facility uses. Pursuant to the original Master Plan, if the site was not developed with a community facility use within three years of the grading of the right-of-way for El Fuerte Street or Rancho Pancho, then the site would revert back to its underlying designation of RM upon a showing that the applicant had made good faith efforts to market this site to a community facility type of use during the three-year period without any success. The applicant had previously requested two such determinations and on both accounts the Planning Commission and City Council determined that the applicant had not shown a good faith effort and denied the requests. The Planning Commission made a minute motion that the City Council adopt a Resolution of Intention to preserve Village “T” as a permanent Community Facility site. On December 3, 2003, the City Council adopted Resolution No. 2002-348 directing the Planning Director to prepare a Master Plan Amendment. The City initiated a Master Plan and General Plan Amendment to preserve Village “T” of the Rancho Carrillo Master Plan as a Community Facility site. On February 17, 2004, the 2 SDP 12-05 – FAITH COMMUNITY CHURCH September 18, 2013 Page 2 City Council approved a General Plan Land Use Amendment and Master Plan Amendment establishing the site as a Community Facilities site for a 10 year period. Consistent with Section 21.25.030 of the CF Zone, the currently adopted Rancho Carrillo Master Plan requires the reservation of Village “T” as a CF site for a minimum period of ten (10) years. The ten-year period commenced when the final inspections were approved for 100 percent of the units in the first residential planning area in the Master Plan. The first village to be completed was Village “J” on October 19, 2000. Even though the ten-year reservation period expired in October 2010, and community facilities have not developed in the community facilities designated area, the site continues to have the Community Facilities designation. Village “T” (Lot 103) was created by the Village “Q” subdivision (CT 93-04) approved by the Planning Commission on January 4, 1995 and the final map was recorded with the San Diego County Clerk’s office on March 31, 1998. The project site, Village “T,” has been previously graded into a large building pad as part of the Rancho Carrillo mass grading and is therefore devoid of vegetation. The site is 3.44 acres in size (2.33 acre pad area) and is bounded by manufactured and landscaped slopes to the north and an open space lot (portion of Open Space Area 12) to the east. Adjacent to the north is a storm water detention basin that is part of the Bressi Ranch development. To the south is Rancho Pancho (street), which provides access to the southern portion of the Rancho Carrillo Master Plan consisting of Villages “O,” “Q,” “R,” “T,” Open Space area nine (OS-9), and the recreational vehicle (RV) storage area for the Rancho Carrillo Master Plan. West of the site is El Fuerte Street and Open Space area six (OS-6). The entrance to the RV storage area is directly south of, and across the street from, the entrance to Village “T.” The applicant, Faith Community Church, has requested approval of an SDP to allow for the construction of a 34,308 square foot building, a 104 space parking lot, vehicular circulation aisles, and landscaping. The proposed building has two floors, is 24 feet tall to the flat roof, has 28.5 foot tall parapets which will also serve to screen 53” tall roof mounted equipment, and architectural towers at a height of 37.5 feet. The ground floor (21,740 sq. ft.) provides space for the buildout of a 500 seat sanctuary and related rooms, a fellowship room, child day care center at the northern end of the building, kitchen, restrooms and administrative offices. The second floor (12,568 sq. ft.) provides classrooms for study sessions, office space, and restrooms. Church services are typically held on Sundays. Class rooms will be used mid-week in the evening for bible studies or for occasional use by groups not associated with the church. The child day care center is approximately 2,560 square feet in area proposed with a maximum number of 40 children and eight teachers. Operation of the child day care center is proposed Monday through Friday from 7:00 a.m. to 6:00 p.m. The church proposes to develop the site in three phases. The first phase would be the construction of a building with a 12,570 square foot ground floor for the child care center at the northern end of the building adjacent to a 3,100 square foot outdoor play area, restrooms, kitchen, lobby, offices, and 292 seat sanctuary, and 6,449 square feet on the second floor for storage. All of the onsite improvements will be completed with Phase 1 including storm water bioretention basin, landscaping, buildout parking lot (100 spaces) and internal circulation, and the 3,100 square foot child day care center play yard. The second building phase would be to complete interior improvements to the second floor for offices, classrooms, restrooms, storage, and workrooms. The third phase is the addition of a new 9,170 square foot ground floor building for the main 500 seat sanctuary, the addition of 6,117 square feet of second SDP 12-05 – FAITH COMMUNITY CHURCH September 18, 2013 Page 3 floor space above the “old” 292 seat sanctuary space, removal of the 292 seats from the Phase 1 ground floor sanctuary space, new classrooms within that new second story area, and a remodel of the Phase 1 sanctuary ground floor as a fellowship space for pre and post church services gathering. The gathering space will be vacant when not in use but will be set up with the appropriate arrangement of tables and chairs for pre and/or post sanctuary events. No timing of construction of the second or third phase has been provided. The smooth tilt-up building is painted tan and emulates elements of the Spanish/Early California architectural theme for Rancho Carrillo through the incorporation of arched windows and window surrounds, red barrel tile arcades, and stone colored trim. The northern and southern building faces include tower features which are 37.5 feet tall. The features do not provide any floor area or contain or screen mechanical equipment. Red barrel colored tile covered walkways extend along the building on the eastern, northern, and westerly southerly building faces as an accent feature to the building and to provide shelter at doorways. The church occupies the western side of the triangular shaped site, along El Fuerte Street. The access point to the site is from Rancho Pancho along the south side of the lot. The remainder of the site is dedicated to parking and landscaping. Table 1 below includes the current land uses, General Plan designations and zoning of the project site and surrounding properties. ANALYSIS The proposed project is subject to the following plans, ordinances and standards: A. General Plan Community Facilities (CF) Land Use Designation; B. Rancho Carrillo Master Plan (MP 139); C. Carlsbad Municipal Code, Title 21, Chapter 06 – Qualified Development Overlay Zone; D. Carlsbad Municipal Code, Title 21, Chapter 25 – Community Facilities Zone; E. Carlsbad Municipal Code, Title 21, Chapter 83 – Child Care; F. Carlsbad Municipal Code, Title 21. Chapter 44 – Parking; and G. Local Facilities Management Plan and Growth Management. SDP 12-05 – FAITH COMMUNITY CHURCH September 18, 2013 Page 4 The recommendation of approval for this project was developed by analyzing the project’s consistency with the applicable policies and regulations listed above. Therefore, this section will cover the project’s compliance with each of the regulations listed above in the order in which they are presented. A. General Plan An objective of the Land use Element of the General Plan is “to ensure that new master planned communities...contribute to a balanced community by providing, within the development, adequate areas to meet some social/human service needs such as sites for worship, daycare, youth and senior activities, etc.” To implement this objective, Master Planned communities and residential Specific Plans over 100 acres are to provide usable acreage to be designated for community facilities. The Rancho Carrillo Master Plan included Village “T” as a community facilities site to satisfy a portion of this requirement. The development of Village “T” as a church, with an associated child day care center, is fulfilling the objectives of, and is consistent with, the General Plan and the Rancho Carrillo Master Plan. B. Rancho Carrillo Master Plan (MP 139) The Master Plan established Village “T” as Community Facilities (CF) site subject to the approval of a Site Development Plan (SDP) in lieu of a Conditional Use Permit (CUP). The development of Village “T” as a Community Facility site meets the goals and objectives of the Rancho Carrillo Master Plan. The site is compatible with surrounding development in that the site is located at least 700 feet from the nearest residential property and is surrounded by open space and the recreational vehicle storage lot for the Master Plan. The development of the site would not disrupt the open space network which preserves the environmental resources of the area. The orientation of the building takes advantage of views to the north. The site was considered as a Community Facility site as part of the initial development of the Master Plan, therefore adequate public facilities and services have already been provided and no new facilities are required. The proposed church and child day care center project complies with the development standards identified in the Rancho Carrillo Master Plan in Table 2 below. Otherwise, the church use is subject to the development standards of the CF Zone and the child day care center is subject to the Child Care Ordinance as discussed below. Yes Yes Furthermore, while church uses are normally approved through a CUP, MP 139, the Carrillo Ranch Master Plan, instead requires the processing of a Site Development Plan for any uses proposed in Village “T.” C. Qualified Development Overlay Zone As identified in the Carrillo Ranch Master Plan, development of the project site requires the approval of a Site Development Plan consistent with the procedures and findings set forth in the C.M.C. Chapter 21.06 Qualified Development Overlay. The project is consistent with the required findings. The General Plan lists churches and child day care centers as expected land uses within the designation of Community Facilities. The project site plan and building design fits within the context of the site as it provides all of the required parking, access, circulation, water quality facilities onsite and consistent with all required setback and other development standards. The project site is surrounded by open space SDP 12-05 – FAITH COMMUNITY CHURCH September 18, 2013 Page 5 and an RV storage lot and is also somewhat removed from existing residential developments so there is no expectation that the daily onsite operations or activities will have an adverse impact on existing uses in the area. El Fuerte Street and Poinsettia Lane are arterial roadways intended to carry larger volumes of traffic. These two roadways are anticipated to be the primary roads used to access to the site. The Average Daily Trips (ADT) assumed for the child day care center and weekday operations of the church is 509 ADT, and 1,235 ADT on Sundays for church services. These additional trips will not have adverse impacts to either roadway. Those trips that would be distributed eastbound on Rancho Pancho are a contribution that is within the design capacity of the road. No unique conditions or features are necessary to adjust the project to make it compatible since it is surrounded by open space on three sides and a recreational vehicle storage lot on the other. D. Community Facilities Zone The Master Plan established the underlying zoning of Village “T” as Community Facilities (CF). Furthermore, the Master Plan specifies that uses within Village “T” are subject to the development standards of the CF Zone. The CF Zone (Chapter 21.25 of the Carlsbad Municipal Code) allows churches as a conditionally permitted use and child day care centers are a permitted use. However, the Rancho Carrillo Master Plan substitutes a Site Development Plan (SDP) for a Conditional Use Permit (CUP) as the required discretionary permit of approval. The proposed project complies with the development standards identified in the Community Facilities Zone as shown in Table 3 below. Child Day Care Center Regulations The child day care center is a permitted use per the CF Zone and subject to the approval of a Site Development Plan pursuant to MP 139 and is subject to the regulations of C.M.C. Chapter 21.83 Child Care Ordinance. The child day care center operator will be required to obtain all licenses and permits required by State law for operation of the facility. Approximately 2,560 square feet of the building will be utilized for child day care use. The maximum number of children planned is 40 and the number of caretakers required would be eight. The center would be open Monday through Friday from approximately 7 a.m. to 6 p.m. The project meets the requirements of the Child Care Ordinance as outlined in Table 4 below. Parking The City’s Parking Ordinance (C.M.C. 21.44.030) states that when the parking requirement for a use is not specifically defined, the requirement shall be determined by the City Planner. The City Planner’s determination shall be based on the most comparable use specified in the chapter, by parking study, or other evidence satisfactory to the City Planner. Church parking is not specifically defined in the Parking Ordinance and historically the City Planner has made the determination that “public assembly” is the most comparable defined use in the chapter. The parking requirements for the project are for those uses proposed onsite and occurring simultaneously. Typically the number of spaces needed to serve the church sanctuary as a place of public assembly is used to satisfy the parking requirement since it generates the greatest parking demand and is a unique solo event on one day during the week. Other uses have been proposed onsite such as classrooms for bible study, various weekly or monthly ministry events, and possibly secular studies as well as a child daycare center. As seen in Table 5 below, the church, under the public assembly requirement of the Parking ordinance, requires 100 parking spaces. The site is designed with the provision of 104 parking spaces. Twelve parking spaces are required to serve the child day care center. One space is required for each ten children and one space is required for each day care center employee. The day care center will be in operation Monday through Friday 7:00 a.m. to 6:00 p.m. The peak demand for church parking will be during Sunday church services which typically occur mid-morning. The Planning Commission received a letter on August 7, 2013 from a resident on Rancho Pancho who is concerned that the proposed 104 space parking lot will not provide adequate parking capacity to accommodate the church sanctuary at full buildout of 500 seats and other concurrent church uses (which would occur with the third phase of development). The letter and staff’s responses are included as attachments no. 6 and 7. The proposed church has been analyzed and parked at the parking ratio of one space per five fixed sanctuary seats which historically has been applied to churches within the City. As previously discussed, churches are normally processed through a Conditional Use Permit (CUP) which requires annual staff reviews of the church operations and an ongoing ability to bring the church back to the Planning Commission to modify the conditions of approval or impose new conditions if the church use is incompatible with surrounding uses. However, since the project is being processed through a Site Development Plan (SDP) as required by the Rancho Carrillo Master Plan, rather than a CUP, and consequently staff does not have the ability to regularly monitor church operations or re-condition the SDP 12-05 – FAITH COMMUNITY CHURCH September 18, 2013 Page 8 church, staff has added a condition of approval to the project to address potential parking issues that could be associated with the implementation of phase three buildout of the church. The condition specifies that the owner/operator of the Faith Community Church provide to the City Planner a parking study, conducted by a professional parking consultant, for a six month period prior to the request for a building permit for phase two and then again for a six month period prior to the request for a building permit for phase three. The parking study shall evaluate peak weekend parking demand at the church, on a minimum of six different weekends over a six month period of church operations. If the on-site parking capacity of 104 spaces is inadequate to accommodate peak weekend demand, resulting in church parking along the adjacent streets, or if the remaining on-site parking supply is unable to accommodate the additional classrooms or sanctuary capacity of 208 seats (proposed with phase three of the project) which requires 42 parking spaces, then phase two or phase three of the project, whichever is applicable, shall not be allowed to pull building permits until additional parking capacity is provided on-site to address demand or the project sanctuary capacity is reduced to a size for which adequate parking can be provided onsite. G. Local Facilities Management Plan and Growth Management The proposed project is located within Local Facilities Management Zone 18 in the southeast quadrant of the City. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in Table 6 below. ENVIRONMENTAL REVIEW Staff has reviewed the request for the Site Development Plan and the City Planner has determined that the project, the development of the site with a church facility and child day care center creates no new or significant adverse environmental impacts above what was identified in the original CEQA document (EIR 91-04 for Rancho Carrillo). The City Council certified EIR 91-04 on July 27, 1993. At that time, CEQA Findings of Fact, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program were approved. All mitigation measures contained in the adopted Mitigation Monitoring and Reporting Program from EIR 91-04 applicable to the Planning Area have been completed, incorporated into the project design or are SDP 12-05 – FAITH COMMUNITY CHURCH September 18, 2013 Page 9 required as conditions of approval for the project. The EIR 91-04 Findings of Fact and Statement of Overriding Considerations apply to all subsequent projects covered by the Rancho Carrillo Master Plan Final Program EIR. The proposed activities would have no effects beyond those analyzed in the program EIR, as they are a part of the program analyzed earlier and no further CEQA review is required ATTACHMENTS: 1. Ms. Lightholder asked the Planning Commission to consider an administrative standard to adopt a fact based parking requirement. Commissioner Segall asked if Ms. Lightholder was going to attend the upcoming hearing. Ms. Lightholder stated yes. Jane Mobaldi, Assistant City Attorney, informed Ms. Lightholder that she may submit comments in writing to the City Council, who sets the parking standards for the community. Linda Geldner, 2814 Rancho Pancho, Carlsbad, also spoke in regards to the Faith Community Church parking and safety concerns. Ms. Geldner requested that the Planning Commission approve the project based on phases 1 and 2, and requested that the applicant apply for an amendment on phase 3 to ensure adequate parking is provided. Chairperson Siekmann asked if there were any questions for the speaker. Don Neu, City Planner, stated that the comments are recorded and will be included in the minutes of the meeting. GPA 12-01/ZC 12-01/LCPA 12-02 – KELLY CORPORATE CENTER – Request for the recommendation of adoption of a Mitigated Negative Declaration and a Mitigation Monitoring and Reporting Program and a recommendation of approval of a General Plan Amendment to change the General Plan Land Use designation from Planned Industrial (PI) and Open Space (OS) to Office (O) and Open Space (OS), a Zone Change to change the zoning from Planned Industrial, Qualified Development Overlay Zone (P-M-Q) and Open Space (OS), to Office (O) and Open Space (OS) and a Local Coastal Program Amendment on a 7.5 acre site with an existing 50,000 square foot office building and a vacant lot with approvals for another 50,000 square foot office building located at the southeast corner of Palomar Airport Road and Hidden Valley Road in Local Facilities Management Zone 5. Mr. Neu stated Agenda Items 2 and 3 would normally be heard in a public hearing context; however, the projects appear to be minor and routine in nature with no outstanding issues and Staff recommends approval. He recommended that the public hearing be opened and closed, and that the Commission proceed with a vote as a consent item. Staff would be available to respond to questions if the Commission or someone from the public wished to comment on Agenda Items 2 or 3. Chairperson Siekmann asked if any member of the audience wished to address Agenda Items 2 or 3. A gentleman stated he wished to speak on Agenda Item 2. Planning Commission Minutes August 7, 2013 Page 3 1. SDP 01-04(A) – LA COSTA TOWN SQUARE – Request for approval of a Site Development Plan Amendment (SDP 01-04(A)) to allow for the provision of common parking facilities in lieu of individual use parking requirements and approve an 8.3 percent parking reduction within the La Costa Town Square shopping center generally located on the northeasterly corner of La Costa Avenue and Rancho Santa Fe Road in Neighborhood 13A of the La Costa Master Plan and in Local Facilities Management Zone 11. Mr. Neu introduced Agenda Item 1 and stated Senior Planner Van Lynch would make the staff presentation. Mr. Lynch gave a brief presentation and stated he would be available to answer any questions. Chairperson Siekmann asked if there were any questions of Staff. Commissioner L’Heureux asked about the maximum number of parking spaces that will be reduced and if there still is a 120 space reduction if all the outdoor dining is utilized. Mr. Lynch stated that the areas that are not utilized would not generate a parking demand, but the overall project would still have 120 fewer spaces for the use of the plaza areas. Chairperson Siekmann stated that the outdoor dining area will be increasing in size which changes the parking ratio. Mr. Lynch stated no existing parking spaces will be removed from the plan. Mr. Lynch also stated the reduction is to utilize more of the plaza’s outdoor areas which do generate parking. Commissioner L’Heureux inquired about the parking reduction and the number of parking spaces that may be compromised. Mr. Lynch clarified that the project is designed with the square footage of the buildings and with adequate parking on the site. Mr. Lynch also stated the addition of the exterior plaza area which generates parking, creates a greater number of required parking spaces. The parking for the outdoor plazas will not be provided and that is at the request of the applicant. Chairperson Siekmann clarified that the outdoor areas are treated as though they add square footage to the property, rather than increasing or reducing parking spaces. Chairperson Siekmann asked if there were any further questions of Staff. Seeing none, she asked if the applicant wished to make a presentation. Mark Langan, architect, 13280 Evening Creek Drive, San Diego, gave a brief presentation and asked if there were any questions. Commissioner Schumacher inquired about the change of the restaurant outdoor seating area from when the project was approved in 2009. Mr. Langan stated that the project has gone through some changes due to the economy, including a different developer. Commissioner Anderson stated her concerns with the parking reduction, the size of the lot, and the amount of people who may access the property to its fullest extent. Mr. Langan responded stating the project’s type of use is a neighborhood commercial center, with both heavy and light uses on the site and parking. Mr. Neu stated that per the Municipal Code, the rate of an individual retail parking space is 1 per 300 square feet and the rate for shopping centers is 1 per 200 square feet. The higher rate was created to account for the variety of tenants that locate in a shopping center. Chairperson Siekmann asked if there were any questions of the applicant. Commissioner Segall asked if the applicant could specify the types of businesses that will occupy the center. Juan Arriaga, developer at Property Development Centers, 5918 Stoneridge Mall Road, Pleasanton, California 94588, stated that due to letters of intent, he is not able to release the names of the occupants of the property. Mr. Arriaga also stated the nature of the shops that will occupy the project will include a Vons, a fitness center, a pet store, soft apparel stores, some restaurants, a financial Planning Commission Minutes August 7, 2013 Page 4 institution, a pharmacy, a gas station, dry cleaners, a beauty parlor/spa, a coffee shop and an ice cream shop. Commissioner Segall inquired about the provision of the outdoor seating area in buildings 13 and 23. Mr. Arriaga responded stating they agreed to comply with Vons restrictions not to have any food tenants in building 23. Chairperson Siekmann asked if there were any further questions of the applicant. Chairperson Siekmann asked how the plan caters to the community in regards to it being pedestrian friendly. Mr. Langan responded stating that there are 3 different access points to the property: the sidewalks off of Rancho Santa Fe, the center of Main Street, and the eastern end of the project. Mr. Langan also stated an open area surrounding the property is connected to other areas for pedestrians to access the shops. Chairperson Siekmann asked if there were any members of the audience who wished to speak on the item. Seeing none, she opened and closed public testimony. DISCUSSION Commissioner Schumacher stated he can support the project and agrees with the findings. Commissioner Segall stated that while he has some concerns with parking, he can support the project. Commissioner L’Heureux stated he can support the project. Commissioner Scully stated she can also support the project. Commissioner Anderson stated she had concerns with adding 24,000 square feet to the property and not accommodating parking. Because of those concerns, she does not support the project. Commissioner Black stated he can support the project. Chairperson Siekmann also stated she can support the project. SDP 12-06/PUD 13-01/CUP 190(C) – COTTAGE ROW APARTMENTS – Request for the approval of a Conditional Use Permit amendment CUP 190(C) to rescind Conditional Use Permit CUP 190(B), and the approval of a Site Development Plan SDP 12-06 and Planned Development Permit PUD 13-01 to allow for the existing 24 apartment units to remain onsite and be made available for rent to the general public on property generally located at 1400 Flametree Lane in Local Facilities Management Zone 20. The project is exempt from the provisions of CEQA per the General Rule [CEQA Guidelines Section 15061(b)(3)]. Mr. Neu introduced Agenda Item 2 and stated Senior Planner Christer Westman would make the staff presentation. Mr. Westman gave a brief presentation and stated he would be available to answer any questions. Chairperson Siekmann asked if there were any questions of staff. Commissioner Anderson asked if the existing structure required inclusionary housing if it was not going through any structural changes. Mr. Westman stated no due to the facility being built prior to the inclusionary housing requirement and the ordinance, and no additional units or construction will be made to the project. Jack Henthorn, P.O. 237, Carlsbad, gave a brief presentation and stated he would be available to answer any questions. Chairperson Siekmann asked if there were any questions of the applicant. Bob Ebert, 1187 Mariposa Road, stated he had concerns with the project and asked if the owner has been in violation of the existing conditional use permit. Christine Nguyen, 1290 Mariposa Road, stated her concerns with noise, traffic and her property value. John Madrid, 1266 Mariposa Road, stated his concerns with traffic as well as RVs and boats parking around the community. Commissioner Scully inquired if the RVs and boats were from the Cottage Row community. Mr. Madrid stated he was not certain. Elise Fox, 1274 Mariposa Road, stated the RVs and boats were from the tenants that resided at the complex. Ms. Fox also stated her concerns with property values and traffic. Commissioner Anderson inquired if Ms. Fox was aware that the City of Carlsbad recently passed an ordinance prohibiting RVs from parking on city streets, and that a permit must be obtained in order to do so. Ms. Fox stated no. Zhixia Shi, 1278 Mariposa Road, stated her concerns with the width of the street, and frequent noise from the tenants of the apartment buildings. Denise Madrid, 1266 Mariposa Road, stated her concerns with the change in the use from a faith based retirement community to an apartment community. Chairperson Siekmann asked if there were any other members of the audience who wished to speak on the item. Seeing none, she closed public testimony and asked the applicant to respond to the issues raised by the speakers. Planning Commission Minutes August 7, 2013 Page 6 Mr. Henthorn replied to the neighbors’ concerns clarifying the restrictions of new ownership. The new owner attempted to attract a faith based operator to the site which was not successful. Mr. Henthorn also stated that the property has strict management, they meet all parking requirements and there are no additional development proposals. Commissioner Scully inquired about the number of residents and units on the property. Mr. Henthorn stated that there are 24 units at its full capacity. Commissioner L’Heureux inquired as to when the project was converted from faith based to non-faith based. Mr. Henthorn replied the change took effect 2-3 years ago due to renovation and vacancy. Commissioner Anderson asked what the benefits were for the previous owner to have the property restricted only for a faith based retirement facility. Mr. Neu stated that because the property was developed in 1980, in which regulations were different, the faith based retirement community may have been a requirement to allow the use through a conditional use permit in the R-1 zone. Mr. Neu also stated that the use was still permitted under that dated Conditional Use Permit after the code changed. Commissioner Segall asked if there was an onsite manager to manage the RV parking on private property. Mr. Henthorn stated yes. Commissioner Anderson inquired if public parking was allowed on Briarwood. Mr. Geldert replied stating Briarwood Street is 38 feet wide, and in accordance with the code, parking is allowed on both sides of a street which are in excess of 30 feet. Chairperson Siekmann closed public testimony and asked if there were any questions of staff. Commissioner L’Heureux asked if the Conditional Use Permit remains with the faith based requirement if the project is not approved. Mr. Neu stated yes that the applicant would then be limited as to how the facility is occupied. DISCUSSION Commissioner Schumacher stated he can support the project. Commissioner Segall concurs with Commissioner Schumacher and can also support the project. Commissioner L’Heureux stated he can support the project. Commissioner Scully stated that while she has concerns with the Conditional Use Permit, she can support the project. Commissioner Anderson stated that because the project is within the low-medium density usage, which is allowed on the site but it does not have the facilities required to make it a retirement community, she feels the Commission has no choice but to remove the Conditional Use Permit and let it become a market rate apartment project. Commissioner Black stated he can also support the project. Chairperson Siekmann stated she can also support the project. Staff is recommending modifications to Finding No. 4 and Condition No. 21 of Planning Commission Resolution No. 7013 as follows: FINDING 4. That the site for the intended use is adequate in size and shape to accommodate the use, in that the proposed building, parking, and landscaping can fit within the boundaries of the developable portion of the property with no need for a variance to standards and that the assembly capacity proposed onsite will be modified as needed to fit within the onsite parking capacity as delineated in parking surveys conducted before the issuance of building permits for both phases 2 and 3 phase three. CONDITION 21. Owner/operator of the Faith Community Church shall provide a parking study, prepared to the satisfaction of and submitted to the City Planner, for a six month period prior to the request for a building permit for phase two and then again for a six month period prior to the request for a building permit for phase three. The parking study shall evaluate peak weekend parking demand at the church, on a minimum of six different weekends over a six month period of church operations. If the on-site parking capacity of 104 spaces is inadequate to accommodate peak weekend demand for phase one phases one and two, resulting in church parking along the adjacent streets, or if the study illustrates that the Faith Community Church on-site parking demand exceeds the minimum requirement of one space per five seats in the sanctuary per the Carlsbad Municipal Code Chapter 21.41, then phase two or phase three of the project, whichever is applicable, shall not be allowed to pull building permits until additional parking capacity is provided on site to address demand or the project sanctuary capacity is reduced to a size for which adequate parking can be provided onsite as approved by a City Planner approved Consistency Determination.
