AGENDA OF: March 16, 2016 Project Planner: Pam Drew Project Engineers: Steve Bobbett/Mark Biskup SUBJECT: CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III – Request for the adoption of the Findings of the Final Mitigated Negative Declaration (MND), the Mitigation Monitoring and Reporting Program (MMRP) and Addendum, prepared and approved by the Buena Sanitation District, as adequate for the Buena Outfall Force Main Phase III project, and approval of a Coastal Development Permit and a Conditional Use Permit to allow the construction of a sewer pipeline and appurtenances within the Mello II Segment of the City’s Coastal Zone on property generally located within the public rights-of-way located at the northeast corner of the intersection of Palomar Airport Road and El Camino Real, traversing within the westbound lanes of Palomar Airport Road, and continuing south on Paseo del Norte for approximately 1,200 feet within Local Facilities Management Zones 3, 5 and 13. The project is appealable to the California Coastal Commission per Section 30603(a)(5) of the Public Resources Code of the California Coastal Act, which states any development which constitutes a major public works project costing $100,000 or more is appealable to the Commission. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7148 ADOPTING the Final Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program and Addendum prepared and approved by the Buena Sanitation District as adequate for the Buena Outfall Force Main Phase III project, and ADOPT Planning Commission Resolution No. 7149 APPROVING Coastal Development Permit (CDP 14-06) and Conditional Use Permit (CUP 15-08) based on the findings and subject to the conditions contained therein. II. BACKGROUND The Buena Sanitation District (District) is responsible for the collection and delivery of wastewater from homes and businesses within approximate 10 square miles within the Shadow Ridge area of the City of Vista, north and south of highway 78, to the Encina Water Pollution Control Plant (EWPCF), located on Avenida Encinas. These flows are conveyed via the Buena outfall originally constructed in 1964, which currently collects from two drainage basins. The Buena Creek Pump Station Basin and Raceway Pump Station Basin wastewater flows are pumped via the Buena Creek and Raceway pump stations through the Buena outfall force main, which is located within sensitive habitat located to the south of Palomar Airport Road. These flows are then conveyed via the Buena outfall to treatment at the EWPCF. The existing Buena outfall does not provide sufficient capacity for implementation of the District’s approved 2008 Sewer Master Plan Update. A new outfall needs to be constructed to accommodate the previously approved flows and the City of Carlsbad’s local flow. The District has proposed a new sewer main to relocate the District’s sewer flows. This proposed project will re-route the existing Buena outfall and tie into both the existing 30-inch Buena outfall and the 39-inch Vallecitos Water District (VWD) land outfall, located within Paseo Del Norte right-of-way adjacent to the Motel 6. The District owns capacity 2 CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 2 within the 39-inch VWD land outfall. A flow control structure will be utilized to direct sewer flow to the existing 30-inch Buena outfall and/or the 39-inch VWD land outfall. The City of Carlsbad’s local flows shall remain in the existing Buena outfall. The District is also proposing three above grade odor control facilities along the project alignment. The proposed project will provide additional capacity to allow future projected flows from previously approved and existing land use densities coming from the existing Buena Creek and Raceway lift stations to be conveyed to the EWPCF. The proposed project is intended to improve and enhance capacity and non-capacity- related facilities (e.g., odor control facilities) that are necessary to ensure safe and reliable operation of the existing sewer system. The following objectives have been identified for this project:  Relocate the District’s primary trunk sewer out of environmentally sensitive areas to minimize potential impacts in case of a spill;  Provide access for regular maintenance activities;  Reduce the potential for sewer overflows;  Make facility improvements on age, material, and condition related infrastructure; and  Restore, maintain, and/or enhance existing sewer service. III. PROJECT DESCRIPTION The District is proposing to construct a new Buena outfall. The alignment begins at an existing 24- inch force main located at the northeast corner of El Camino Real and Palomar Airport Road. The Buena outfall starts as a pressurized force main then continues west across El Camino Real, parallel to the existing 18-inch vitrified clay pipe (VCP) Buena outfall sewer, approximately 500 feet southwest to the north side of Palomar Airport Road. The force main then proceeds within the center westbound lanes of Palomar Airport Road towards the intersection of Yarrow Drive and Palomar Airport Road. The alignment continues west for approximately 2,600 feet to a high point before the intersection of Yarrow and Palomar Airport Road. The total length of 26-inch force main for this section is approximately 2,600 feet. A manhole will be placed where the force main will end and transition into a 30-inch gravity sewer and continue approximately another 5,600 feet along the center westbound lane of Palomar Airport Road. At 400 feet east of Palomar Oaks Way, the pipeline will transition to a 24-inch force main sewer and continue approximately 9,700 feet further west to the intersection of Palomar Airport Road and Paseo Del Norte. The pipeline will then turn south, transition to a 24-inch gravity sewer main 500 feet south of the intersection, and proceed within the southbound lanes of Paseo del Norte approximately 800 feet and tie into the existing 30- and 39-inch trunk sewer lines, which flow to the EWPCF located west of Interstate 5. The District owns the 30-inch sewer pipeline, which has a capacity of 9.44 million gallons per day (MGDs). The District also owns 3.75 MGDs of capacity in the 39-inch pipeline owned by Vallecitos Water District. In order to provide maximum flexibility, the design will include a flow-splitting manhole just upstream of the tie-in point. The diversion manhole will be equipped with the means to allow flow to be diverted to one or both of the existing trunk sewer lines. Although most of the work for the Buena outfall will be confined to City of Carlsbad rights-of-way, three parcels have been identified, portions of which will have to be obtained either through easement or fee, for the installation of the pipeline section below Palomar Airport Road via a trenchless method and for the three above grade odor control facilities. Each of the parcels is described below. CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 3 Parcel 1 – Palomar Airport Road at the intersection with El Camino Real. This parcel is located at the northwest corner of the intersection. This right-of-way is required to provide a site for the directional drilling that will be required to cross from the junction of the existing force main and the new force main to the north side of Palomar Airport Road. Parcel 2 – Palomar Airport Road east of Yarrow Drive. This parcel lies on the north side of Palomar Airport Road and approximately 650 feet east of the intersection of Palomar Airport Road and Yarrow Road. This site would be used for the construction of a passive odor control facilities (designated as Odor Control Facility #3 on the project plans). Parcel 3 – Palomar Airport Road west of Camino Vida Roble. This parcel lies on the north side of Palomar Airport Road and approximately 1,600 feet west of the intersection of Palomar Airport Road and Camino Vida Roble. This site would be used for the construction of an active odor control facility (designated as Odor Control Facility #2 on the project plans). Parcel 4 – Paseo Del Norte at the Motel 6, located at the southwest corner of the Motel 6 parking lot adjacent to the trash receptacles. This parcel lies on the west side of Paseo Del Norte. The location of the odor control facility will not permanently remove any parking spaces from the Motel 6 parking lot. This site would be used for the construction of an active odor control facility (designated as Odor Control Facility #1 on the project plans). Construction Description Project construction is anticipated to be initiated in late 2016 and will take approximately one year including project start up, material procurement and close out. The actual pipeline construction will be a roving operation with a production rate of approximately 300-feet per night. The trenchless activities which would include installing pipe near the intersection of Palomar Airport Road and El Camino Real will take approximately three months. The trenchless construction and cut and cover construction would likely occur concurrently. The project would be built primarily at night generally between the hours of 9 pm to 5 am (Sunday through Thursday) to avoid creating peak hour traffic impacts along this heavily traveled roadway. Construction along Paseo Del Norte, near the Motel 6, would occur in the daytime to avoid creating nighttime noise related impacts to hotel guests. In addition to the pipeline, other proposed ancillary facilities include three above grade odor control facilities and construction laydown and staging areas. A combination of cut and cover and trenchless technologies (including micro-tunneling) would be utilized for this project. The proposed project would be constructed generally from west to east in progressive 300-foot long segments. The pipeline would consist either of High Density Polyethylene (HDPE) or Polyvinyl Chloride (PVC). Staging areas for pipes, machinery, materials and tools will be within adjacent traffic lanes which will also be closed to traffic. Backhoe and similar rubber-tire machinery will be primarily utilized for trenching, with the spoils temporarily laid directly adjacent to the trench. Traffic Control Construction of the project will involve temporary control of traffic through the work activity zone as normal traffic flow and patterns will be disrupted on the westbound lanes of Palomar Airport Road and on Paseo Del Norte. This work activity zone will be marked by signs, pavement markings, delineators and CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 4 other devices to provide visibility to the drivers, bicyclists and pedestrians in order to provide a safe and efficient route through the work zone area. Detour routes will be provided as necessary. The applicant will prepare, and submit to the Traffic Engineer, a traffic control plan, based on the final design to minimize disruptions to traffic on the affected streets and intersections during construction. Nighttime Construction Noise: Nighttime construction hours will be from 9:00 p.m. to 5:00 a.m. Noise problems are normally caused by the operation of heavy equipment and specifically by vehicle and machine backup-alarms. The contractor will install sound walls along the construction site to reduce construction noise. The volume for the back-up horns on vehicles will be reduced. Lights: Flood lights will be installed along the construction site for safety and visibility. All lighting will be facing downward and directed away from adjacent buildings. Odor Control Facilities Implementation of the proposed project has the potential for odor generation. Preliminary sizing of the odor control facilities are based on both turbulence at the connection between the force main and the gravity system, the flow control structure, flow monitoring structures, and low flow deposition in the gravity sewer with resulting odors released through the manholes. Several odor control methods were evaluated to reduce and minimize potential odors from the project. For individual manhole applications, the District would utilize a combination of manhole seal/bio-filter inserts. The District is also proposing three above ground odor control facilities in locations within the system where there are areas of system turbulence and are designed to reduce the potential for odor. There are two types of odor control systems being installed on the Buena Outfall Force Main Phase III sewer project. The first type is an active odor control system, which will be installed at Odor Control Facility #1 and #2. The active odor control system uses a combination of biological and carbon scrubbers. The biological portion of the system uses bacteria to remove 99% of hydrogen sulfide from the sewer airstream, while the activated carbon removes residual hydrogen sulfide and organic odors. The active odor control system also has a fan that forces air from the sewer system into the unit. Since the system has a fan and controls, power is required at the location. The two active odor control facilities will be installed with noise reduction features that limit the generated noise level from the fan to approximately 60 decibels (dB) at 10 feet away and 46 dB at 50 feet away which is below City of Carlsbad noise guidance for motel, hotels, and commercial areas. The two active units proposed adjacent to Palomar Airport Road will be located in an area with existing noise levels generated by road traffic that will mask the noise. The active unit near Motel 6 will be located 50-feet from any motel rooms and adjacent to the northbound I- 5 off-ramp at Palomar Airport Road. The passive odor control system is a much simpler system compared to the active system. This system, which will be installed at Odor Control Facility #3, does not require power, has no controls or fans, and uses carbon based media to absorb hydrogen sulfide. The passive odor control system only treats air that passively flows through the unit. The passive odor control facilities will not produce any noise. The dimensions of the two active odor control facilities (#1 and #2) are 14 feet wide x 18 feet 8 inches long x 8 feet 8 inches high. The dimensions of the passive odor control facilities (#3) is 6 feet wide x 12 feet long x 4 feet 8 inches high. The two active odor control facilities will be constructed of concrete blocks and the structures would be enclosed and painted to blend in with the surrounding areas. The CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 5 material for the outside structure of the passive unit will be a composite enclosure, similar to many utility enclosures along Palomar Airport Road. Odor Control Facilities Materials Odor control facility #1 would be located adjacent to an existing sandstone color block wall that separates the motel parking lot from northbound I-5 off ramp at Palomar Airport Road. The color of the block walls will be matched to blend in with the existing sandstone color block wall (see Attachment #5 for material and color samples). Odor control facility #2 would be located within an open space easement that is vegetated with shrubs and trees. The block walls will be matched to blend in with the adjacent vegetation. Odor control facility #3 would be located within a vegetated area and would be painted to blend in with the adjacent vegetation. Outreach Cooperation with the public is an important aspect of the construction approach on this project. In addition to the communications the District has already had with surrounding businesses and airport, the District is hiring a public outreach consultant to begin outreach 4-6 months ahead of planned construction. The public outreach firm will prepare a communication plan, which will include coordination with the airport, hotels, medical facilities, and businesses along the alignment prior to construction. The consultant will notify them of the proposed construction schedule, prepare and distribute public outreach information and materials, and serve as the District’s main point of contact for questions regarding this project. V. ANALYSIS The project is subject to the following regulations and requirements: A. Visitor Commercial (VC), Open Space (OS) and Public (P) General Plan Land Use Designations; B. Commercial Tourist – Qualified Development Overlay (CT-Q) Zone (Carlsbad Municipal Code [CMC] Chapter 21.29), Open Space (OS) Zone (CMC Chapter 21.33) and Industrial (M) Zone (CMC Chapter 31.32); C. Coastal Development Permit Procedures (CMC Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203); D. Conditional Use Permit (CMC Chapter 21.42); E. McClellan-Palomar Airport Land Use Compatibility Plan (ALUCP); and F. Growth Management (CMC Chapter 21.90). The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable city regulations and policies. The project’s compliance with each of the above regulations is discussed in detail in the sections below. CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 6 A. General Plan Land Use Designation The project is located in the Visitor Commercial (VC), Open Space (OS) and Public (P) Land Use designations and within street rights-of-way. The corresponding Commercial Tourist – Qualified Development Overlay (CT-Q), Open Space (OS) and Industrial (M) zones allow public infrastructure as a permitted use subject to the approval of a Conditional Use Permit (CUP). Furthermore, the property with an OS easement, located on the north side of Palomar Airport Road where Odor Control Facility # 2 is proposed, is within an OS easement that only allows structures with the issuance of a CUP. The Land Use and Community Design Element requires that public facilities be provided in the city adequate for the projected population. The project complies with these provisions by re-routing the sewer line, mostly within the public rights-of- way, and out of the sensitive habitat, and to provide additional capacity to allow for future projected flows. Compliance with some of these standards of the General Plan is outlined in Table A below: TABLE A: GENERAL PLAN COMPLIANCE ELEMENT STANDARD PROJECT COMPLIANCE? Land Use and Community Design Ensure that adequate public facilities and services are provided in a timely manner to preserve the quality of life of residents (Growth Management Goal 2-G.21). The existing Buena outfall does not provide sufficient capacity for implementation of the District’s approved 2008 Sewer Master Plan Update. A new outfall needs to be constructed to accommodate the projected flows of the District and City of Carlsbad. Yes Open Space, Conservation, and Recreation Promote the protection of Carlsbad’s creeks, lagoons, ocean and other natural water bodies from pollution (Water Quality Goal 4-G-14). Currently the District shares the sewer main, located within sensitive habitat, with CMWD and Vallecitos Water District. By rerouting the District’s sewer flows out of environmentally sensitive areas potential impacts to habitat will be minimized in case of a sewage spill. Yes B. Title 21 (Zoning) The project has zoning designations of Commercial Tourist-Qualified Development Overlay (CT-Q), Open Space (O-S), Industrial (M) and public rights-of-way, which permit public utility facilities with the issuance of a CUP. C. Conformance with the Coastal Development Permit Procedures (CMC Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC Chapter 21. 203). The portion of the project site west of Palomar Oaks Way is located within the Mello II Segment of the Local Coastal Program, and therefore requires a Coastal Development Permit. This portion of the project site is also subject to the Coastal Resource Protection Overlay Zone, which implements the California Coastal Act and is applicable to all properties located in the coastal zone. The project’s compliance with each of these programs and ordinances is discussed below: CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 7 1. Mello II Segment of the Certified Local Coastal Program and all applicable policies. The project will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone as the pipeline will be underground and the tallest structure will be 8 feet 8 inches high. The proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that in that the proposed project is consistent with, or otherwise implements, the following Mello II LCP policies: a. Carlsbad LCP Mello II Policy 3-4 Grading and Landscaping Requirements. The project complies because most of the work will be within the public rights-of-way and will be repaved to eliminate the possibility of erosion. Furthermore, standard design features and construction measures will be incorporated in the project and will include compliance with the Construction General Permit which requires the development and implementation of a Storm Water Pollution Protection Plan (SWPPP) as well as implementation of BMPs. b. Carlsbad LCP Mello II Policy 4-3 Accelerated Soil Erosion. The project complies because no portion of the project is being developed on steep slopes as identified in the LCP. The project also complies because the project will incorporate BMPs and submit a SWPPP to insure proper storm water quality measures during construction such as installation of gravel bags, silt fences, straw wattles, equipment drip pans, ‘porta-potty’ containment pans, trash cans etc. c. Carlsbad LCP Mello II Policy 4-4 Removal of Natural Vegetation. The project complies because it will not remove any natural vegetation. d. Carlsbad LCP Mello II Policy 4-5 Soil Erosion Control Practices and Policy 4-6 Sediment Control Practices. The project complies because onsite erosion will be avoided and sediment controlled through the use of silt fences, sandbags and straw mulch rolls being placed around excavated trench spoils during the construction period. Furthermore, all storm drains and natural drainages situated downstream from the construction will be protected by linear sediment barriers or similar erosion control devices. CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 8 The proposal is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act in that the proposed sewer pipeline will been installed underground and, therefore, will not impact public access opportunities nor recreational resources. The three above grade odor control facilities are small in size, with the two largest being 8 feet 8 inches high, and approximately 263 square feet in size and will not obstruct views of the coastline as seen from public lands or the public right-of-way; therefore, the visual beauty of the coastal zone will not diminish, nor will there be any impacts to coastal resources or public access. No agricultural uses currently exist on the site; however, agricultural uses are located adjacent to it. The project will not impact agricultural uses as most of the work will be completed at night. The project is not located in an area of known geologic instability. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Runoff Management Program (JRMP) to avoid increased urban runoff, pollutants, and soil erosion. No steep slopes or native vegetation is located on the subject properties and the sites are not located in areas prone to landslides, or susceptible to accelerated erosion, floods, or liquefaction. D. Conditional Use Permit Regulations The sewer pipeline and appurtenances proposed on the lots zoned Open Space (O-S), Commercial Tourist- Qualified Development Overlay (CT-Q) and Industrial (M) are allowed subject to the approval of a CUP. Chapter 21.42 of the Carlsbad Municipal Code requires that four findings be made in order to approve a conditional use permit. All of these findings can be made for this project as discussed below: 1. That the requested use is necessary or desirable for the development of the community, and is in harmony with the various elements and objectives of the general plan, including, if applicable, the certified local coastal program, specific plan or master plan, in that the proposed sewer main and appurtenances are needed to ensure adequate provision of sewer service into the future and will protect the quality of the sensitive habitat in the area by relocating the sewer line into the public right-of-way and out of the habitat preserve. 2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located, in that the existing sewer line is located within a habitat preserve and has been in operation in the area for the past 50 years and has not been detrimental to the existing uses or uses specifically permitted in the zone. The sewer main is below grade and will not impact any of the surrounding uses. The three above grade odor control facilities are sited and treated to blend in with the surrounding area and will not interfere with existing uses. 3. That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the City Planner, planning commission or city council, in order to integrate the use with other uses in the neighborhood, in that the proposed sewer main and appurtenances are proposed in the public rights-of-way, Commercial–Tourist–Qualified Development Overlay (C-T-Q) zone and Open Space (O-S) zone, which contains only one specific development standard, a 25-foot (O-S) and a 35-foot (C-T-Q) maximum building height. The tallest of the above-grade structures will be no more than 8 feet CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 9 8 inches, and the remaining structures will be below grade. Furthermore, project components located within the Industrial (M) zone will be below grade and therefore will not impact other uses in the in the area. 4. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use, in that the project will require service by one maintenance vehicle once every three months. E. McClellan-Palomar Airport Land Use Compatibility Plan (ALUCP) The project is consistent with the McClellan-Palomar Airport Land Use Compatibility Plan (ALUCP) as amended December 1, 2011 in that the project is consistent with the applicable goals and policies of the city’s General Plan. The project will be located in the public rights-of-way, Commercial–Tourist– Qualified Development Overlay (C-T-Q) zone, Industrial (M) zone and Open Space (O-S) zone, which allows the construction of public facilities and structures subject to the approval of a CUP. The project also is consistent with the Federal Aviation Regulations (FAR) Part 77 Guidelines, which determines if structures will affect navigable airspace. The tallest permanent structure would be the odor control facilities at 8-feet 8-inches; however, the temporary construction equipment would need a Part 77 determination. A Part 77 form was completed for the construction equipment. The FAA made a Determination of “No Hazard to Air Navigation” (Aeronautical Study No. 2014-AWP-5756-OE dated October 6, 2014); however, the determination expired on April 6, 2015. A new determination will need to be made prior to the start of construction. F. Growth Management The sewer piping alignment and odor control facilities are located within Zones 3, 5 and 13 of Local Facilities Management Plans (LFMPs). The zone plans identified above implements the Citywide Facilities and Improvements Plan and were adopted to ensure that growth occurred in concert with public facilities and service systems. The sewer pipeline and appurtenances will provide additional sewer capacity to allow future projected flows from previously approved and existing land use densities consistent with the city’s Growth Management Plan. The proposed project is intended to improve and enhance capacity and non-capacity- related facilities (e.g., odor control facilities) that are necessary to ensure safe and reliable operation of the existing sewer system. Furthermore, project operations will not result in any increased traffic and will thus not result in any substantial deterioration of the public roadway system, nor generate a need for other governmental services, such as emergency services. The sewer main and appurtenances are designed of a size adequate to convey the future anticipated build-out demand of the service area for the District. IV. ENVIRONMENTAL REVIEW In its capacity as lead agency under the California Environmental Quality Act (CEQA), the Buena Sanitation District conducted an environmental impact assessment to determine if the project could have a potentially significant effect on the environment. The 30-day public review period was from April 9, 2014 to May 9, 2014. The District concluded that although the proposed project could have a significant effect on the environment, there will not be any significant effects in this case because mitigation measures CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 10 have been identified and incorporated into the project and will be implemented by the District. Therefore, the project would not have a significant effect on the environment. The Final Mitigated Negative Declaration (MND 5-914), dated September 2014, was adopted by the District at its September 24, 2014 Board meeting (Resolution No. 2014-20). Since the 30-day public review of the draft MND, the Buena Sanitation Districted has conducted additional engineering studies on the project, resulting in minor changes to the project. The project changes include:  The IS/MND states on page 1-5 that the existing Buena Outfall is located 650 feet southwest to the north side of Palomar Airport Road. The final design notes the correct reference should be 500 feet southwest to the north side of Palomar Airport Road.  The IS/MND states on page 1-6 that the force main in the vicinity of Yarrow Road and Palomar Airport Road will be a 24-inch diameter pipeline; however the final design indicates this pipeline segment will be 26 inches in diameter.  The IS/MND states on page 1-6 that the force main in the vicinity of Yarrow Road and Palomar Airport Road will be 3,250 feet; however the final design indicates this segment will be 2,600 feet in length.  The IS/MND states on page 1-6 that this segment of pipeline will transition to a 24-inch diameter gravity sewer line. Based upon the final design, the pipeline will tie into a 30-inch diameter gravity sewer line.  The IS/MND states on page 1-6 that the gravity sewer line will continue another 5,500 feet in the westbound lanes of Palomar Airport Road; however, final design indicates this segment of pipeline is 5,600 feet in length.  The IS/MND states on page 1-6 that gravity sewer line will transition back to an 18-inch force main. Final design confirms this will be a 24-inch force main.  The IS/MND states on page 1-6 that the force main will continue approximately 10,000 feet further west to the intersection of Palomar Airport Road and Paseo Del Norte. Final design indicates that the actual length of pipeline will be 9,700 feet.  The IS/MND states on page 1-6 that the terminus of the Buena outfall will tie into the existing 30- inch and 48-inch truck sewer lines. Final design confirms that the existing trunk lines are 30-inches and 39-inches in diameter.  The IS/MND states on page 1-6 that the District owns capacity within the 30-inch sewer pipeline which consists of up to 10.75 million gallon per day (MGD). Final design indicates that the District owns capacity of up to 9.44 MGD.  The IS/MND states on page 1-6 that the District owns 3.75 MGD of capacity in the 48-inch pipeline. Final design confirms that the pipeline diameter is actually 39 inches. CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III March 16, 2016 Page 11 The minor changes to the EIA Part II do not require recirculation of the Mitigated Negative Declaration since the changes are consistent with the description of “new information” in CEQA Section 15073.5(c)(4), which states recirculation is not required if “new information is added to the negative declaration which merely clarifies, amplifies, or makes insignificant modifications to the negative declaration.” The Planning Commission has reviewed, analyzed and considered the MND and Addendum and has determined that the MND prepared and adopted by the Buena Sanitation District has been prepared in accordance with requirements of CEQA that there is no substantial evidence the project will have a significant effect on the environment and has determined that the MND is adequate for use by the City of Carlsbad as a responsible agency.
