AGENDA OF: June 1, 2016 Application complete date: May 6, 2016 Project Planner: Christer Westman Project Engineer: David Rick SUBJECT: COP 16-08-HOENIG RESIDENCE-Request for approval of a Coastal Development Permit to allow for the construction of a 2,299 square foot single family residence within the Mello II Segment of the City's Coastal Zone located at 1075 Chinquapin Avenue within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303(a) construction of a single family residence of the state CEQA Guidelines. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7169 APPFtOVING Coastal Development Permit CDP 16-08 based upon the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The 0.36 acre (15,682 square feet), project site is located at 1075 Chinquapin Avenue as shown on the attached location map. The property is developed with a two-unit apartment building and at-grade parking. The topography of the site is flat and the vegetation on the site includes ornamental species. Table "A" below includes the General Plan designations, zoning and current land uses of the project site and surrounding properties. The new house is two-stories with 3 bedrooms, two bathrooms, and an attached two-car garage. The architectural style is reminiscent of farmhouse with horizontal cedar siding, cedar wood fascias, and window and door trim. Other portions of the house are faced with stucco. CDP 16-08-HOENIG RESIDENCE June 1, 2016 Page 2 Proposed Grading: Estimated grading quantities include 56 cubic yards (cy) of cut. A grading permit will not be required for this project. Ill. ANALYSIS The project is subject to the following regulations and requirements: A. R-15, Residential General Plan Designation; B. RD-M-Q: Residential Density-Multiple Zone and a Qualified Development Overlay; C. Coastal Development Regulations for the Mello II Segment of the LCP; D. lnclusionary Housing Ordinance {CMC Chapter 21.85); and E. Growth Management {CMC Chapter 21.90). The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable city regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan Land Use Designation Table "B" below includes the project site's gross and net acreage, the number of dwelling units allowed by the General Plan's Growth Management Control Point {GMCP) density and the proposed projects number of dwelling units and density. The R-15 Land Use designation allows for the development of single family residential units within a density range of 8-15 dwelling units per acre (du/ac) and at a Growth Management Control Point {GMCP) of 11.5. The project site has a net area of 0.36 acres and at the 11.5 GMCP, 4.14 dwelling units are allowed. B. Residential Density-Multiple Zone and Qualified Overlay Zone (RD-M-Q) The project is required to comply with all applicable regulations and development standards of the Carlsbad Municipal Code {CMC) including the Residential Density-Multiple (RD-M) zone. The proposed project meets or exceeds all applicable requirements of the RD-M zone (Shown in Table C below). Conformance with the Coastal Development Regulations for the Mello II Segment of the Local Coastal Program (CMC Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203) The project site is located within the Mello II Segment of the Local Coastal Program and is not within the appeals jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone. The project's compliance with each of these programs and ordinances is discussed below: 1. Mello II Segment of the Certified Local Coastal Program and all applicable policies The project is located in the Mello II Local Coastal Program Segment. The subject site has an LCP Land Use Plan designation of R-15 Residential, which allows for a density of 8 to 15 du/acre and 11.5 du/acre at the Growth Management Control Point (GMCP). Th~~ project density is within the R-15 density range of 8-15 du/ac as discussed in Section "A" above. Therefore the project is consistent with the Mello II Segment of the LCP. The project consists of the construction of a new 2,299 square foot single-family residence with an attached two-car garage in an area designated for multi-family residential development. The development of the proposed single-family home will be the third unit for this multi-family property since the property includes an existing duplex structure. The proposed two-story residence is compatible with the surrounding development of two-story single-family and multi-family residential structures. Additionally, given the projects distance from the coastline, the two-story residence will not obstruct views of the coastline as seen from public lands or public right-of-way nor otherwise damage the visual beauty of the coastal zone. Furthermore, no agricultural uses exist on the previously graded site, nor are there any sensitive resources located on the site. The proposed single-family residence is not located in an area of known geologic instability or flood hazard; and given that the site does not have any frontage along the coastline, no public opportunities for coastal shoreline access or water- oriented recreational activities are available. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the city's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Carlsbad BMP Design Manual and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. No undevelopable steep slopes or native vegetation is located on the subject property and the previously graded site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods, or liquefaction. D. lnclusionary Housing Ordinance (CMC Chapter 21.85) For any residential development of less than seven (7) units, the inclusionary housing requirements may be satisfied through the payment of an inclusionary housing in-lieu fee. The project is conditioned to pay the fee concurrent with the issuance of a building permit. CDP 16-08-HOENIG RESIDENCE June 1, 2016 Page 4 E. Growth Management The proposed project is located within Local Facilities Management Zone 1 in the northwest quadrant of the city. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in Table "C" below. Delete Condition Number 18: Prior to approval of the final map or issuance of any permits, the developer shall enter into an agreement with the city to pay the city's Transportation System Management Program and Transportation Demand Management Program fees established as a result of the forthcoming Traffic Impact Fee Update. The form and content of said agreement shall be to the satisfaction of the city engineer and city attorney.
