AGENDA OF: July 6, 2016 Application complete date: April 28, 2016 Project Planner: Teri Delcamp Project Engineer: Steve Bobbett SUBJECT: RP 16-01/CDP 16-03-VERIZON ARMY & NAVY ATHLETIC FACILITY WCF-Request for approval of a Minor Review Permit and Coastal Development Permit to allow the installation, operation, and maintenance of an unmanned Wireless Communication Facility consisting of six (6} panel antennas mounted within a 48 inch radome cylinder on a new light standard that will replace an existing light standard and associated equipment at the northeast corner of the athletic field within the Army & Navy Academy Athletic Facility located at 2600 Carlsbad Boulevard in the Village Segment of the Certified Local Coastal Program and in Local Facilities Management Zone 1. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and 1s therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301(e) (Additions to Existing Structures) of the state CEQA Guidelines. This project is not located within the appealable area of the California Coastal Commission. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7177 APPROVING RP 16-01/ CDP 16-03 based upon the findings and subject to the cbnditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND The project site is the Army & Navy Academy athietic facility located on the east side of Carlsbad Boulevard north of Beech Avenue. The facility was approved in 2012 (RP 12-13/CDP 12-04) and includes a 27,000 square foot gymnasium and a lighted ball field with stadium seating and press box. The proposed project will allow for the installation, operation and maintenance of an unmanned WCF consisting of six, 6'-6" tali antennas, six Remote Radio Units (RRUs) and two DC surge protection units mounted below the antennas, all concealed within a radome near the top of a field light standard. The WCF will be installed on a new 81'-1" taillight standard that wil!replace an existing 81'-1" tall field light standard, in virtually the same location as the existing standard at the northeast corner of the athletic field. The antennas will be installed in a vertical array at approximately 62 feet and 68 feet up the light standard as measured to the center of the antenna arrays. The associated equipment will be located within a chain link enclosure at the rear (east) of the existing gymnasium building. Table A below includes the General Plan designations, zoning and current land uses ofthe project site and surrounding properties. Village (V) General Plan Land Use designation; B. Village Review (V-R) Zone {CMC Chapter 21.35), Land Use District 9-Tourism Support {Village Master Plan and Design Manual); C. Coastal Development Regulations for the Village Segment of the Local Coastal Program {CMC Chapter 21.81 and Viillage Master Plan and Design Manual}; D. City Council Policy Statement: Policy No. 64-Wireless Communication Facilities; and E. Growth Management Ordinance (CMC Chapter 21.90}, Local Facilities Management Plan Zone 1. The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable regulations and policies. The project's compliance with each of the above regulations is discussed in the sections below. A. Village {V} General P'lan Land Use designation The subject property, comprising one (1} legal parcel, has a General Plan Land Use designation of Village (V). The Carlsbad General Plan includes the following goals for the Village: 1) Maintain and enhance the Village as a center for residents and visitors with commercial, residential, dining, civic, cultural, and entertainment activities; and 2) Develop a distinct identity for the Village by encouraging a variety of uses and activities, such as a mix of residential, commercial, office, restaurants and specialty retail shops, which traditionally locate in a pedestrian-oriented downtown area and attract visitors and residents from across the community by creating a lively, interesting social environment. The proposed project is consistent with the goals for the Village, as outlined within the General Plan, The proposed use is consistent with the General Plan and Village Segment of the Certified Local Coastal Program in that the Village i[V) Land Use designation does not preclude the provision of WCF uses. The proposed WCF project has been found to be consistent with City Council Policy No. 64, Wireless Communication Facilities, in that it is in a preferred non-residential location and has a stealth design as discussed in Section D below. The project's location and stealth design comply with General Plan objectives that seek to maintain and enhance Carlsbad's appearance. Village Review (V-R) Zone (CMC Chapter 21.35), Land Use District 9-Tourism Support (Village Master Plan and Des;ign Manual) The subject property is located in Land Use District 9-Tourism Support of the Village Master Plan. The Tourism Support district is intended for hotels, time share condominiums, restaurants and shops to serve visitors to Carlsbad's ocean front and travelers along Carlsbad Boulevard. The WCF use is not precluded by the project site's Village R:eview (V-R) zoning and is considered a provisional use. Provisional uses are those which are permitted subject to discretionary approval. They are approved based upon findings that the use is consistent with the Village vision and goals under specific conditions imposed by the permit. The proposed WCF is located within a preferred non-residential location as listed in Location Guideline A.1.b. of City Council Policy Statement No. 64. The WCF exhibits stealth design and the ground-located equipment will be screened by existing improvements and vine plantings. Furthermore, the placement of the antennas and associated WCF equipment will not result in any additional building coverage, does not alter the existing site's purpose or its design, and does not interfere with other surrounding uses. The Village Master Plan and Design Manual sets forth the standards for the front, rear and side yard setbacks for the property. In Land Use District 9, the allowable setback requirements are as noted below, with the specific setback within each range to be determined by the decision-maker for each case: Front: 5-20 feet Side: 5-10 feet Rear: 5-15 feet The Army & Navy Academy's Athletic Facility was approved by the Planning Commission with a front yard setback of five feet, a north side setback of five feet, a rear setback of five feet and a south side setback of 10 feet. The existing light standards were also approved as part of the Athletic Facility. The proposed WCF complies with the required setbacks, is the same height as the existing light standard and in virtually the same location as the e>Cisting standard, and will not alter or interfere with the Athletic Facility's functional operation. The Village Master Plan and Design Manual project procedures require Review Permits, not Conditional Use Permits. Certain provisional uses in the Village Master Plan have specific additional findings, although there are none for WCFs. Therefore, staff has used the Conditional Use Permit {CUP) findings in Carlsbad Municipal Code (CMC) Chapter 21.42 in addition to the findings for Review Permits to ensure that the project is compatible with surrounding uses. The following summarizes how the project meets the CUP findings, which are further detailed in the resolution: RP 16-01/CDP 16-03-VERIZON ARMY & NAVY ATHLETIC FACILITY WCF July 6, 2016 Page 4 Tt~BLE B-CONDITIONAL USE PERMIT FINDINGS FINDINGS That the requested use is nece~ssary or desirable for the development of the community, and is in harmony with the various elements and objectives of the general plan, including, if applicable; the certified local coastal program, specific plan or master plan. 1-------··-·-·------------·---··· That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the City Planner, Planning Commission or City Council, in order to integrate the use with other uses in the neighborhood. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. PROJECT CONSISTENCY There is a benefit and demand for digital communications and data transmissions for businesses, residences, individuals, public agencies and emergency service systems in this part of the city. The use is consistent with the General Plan because the Village Land Use designation does not preclude the provision of WCF uses. The use is in harmony with objectives that seek to maintain and enhance Carlsbad's appearance in that the WCF is integrated into a light standard, attached as close to the light standard as possible within a concealing radome cylinder, and visibility of the standard and associated equipment is reduced because they are located close to the rear of the __ e_x_i_st_in_,g"-'g"'"'y'-m_. -----·----1 The antennas are proposed to be mounted to a replacement light standard that is the same height as the existing light standard, and are mounted close to the light standard within a radome, thus minimizing visual impacts, and will comply with the Federal Communications Commission Radio Frequency Exposure Guidelines. The light standard on which the proposed antennas are to be located and the associated equipment are not within any required front, rear or side yard setbacks and there is no proposed increase in the height of the field light standard. The unmanned WCF will require, on average, only monthly maintenance visits and the existing street system is adequate to properly handle any traffic generated by the use. C. Coastal Development Regulations for the Village Segment of the local Coastal Program (CMC Chapter 21.81 and Village Master Plan and Design Manual) The proposed WCF is located within the Village Segment of the Coastal Zone. Consistency with the Village Local Coastal Program is required for this project. The Village Master Plan and Design Manual functions as the Local Coastal Program for the Village area. The proposed WCF use is not precluded by, and its design is consistent with applicable development standards ot the Village Master Plan and Design Manual as previously discussed in section "B" of this staff report. Furthermore, staff finds the proposed project to be consistent with the Village segment of the Local Coastal Program in that views of the coastline, as seen from public lands or the public right-of- way, will not be obstructed by the proposed project, nor would the project otherwise damage the visual RP 16-01/CDP 16-03-VERIZON ARMY & NAVY ATHLETIC FACILITY WCF July 6, 2016 Page 5 of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The project site is not located in an area of known geologic instability or flood hazard. Although the site is located in close proximity to the coast, no public opportunities for coastal shoreline access are available from the public site. Furthermore, the site is also not suited for water- oriented recreation activities. D. City Council Policy S1tatement: Policy No. 64-Wireless Communication Facilities The project is consistent with City Council Policy No. 64 -Wireless Communication Facilities in that the location is considered "preferred" given that the antennas are proposed to be installed on a structure that already exists for the purpose of lighting the athletic field, and within a non-residential zone on a property that could be considered a community facility. The replacement light standard will be the same height as the existing light standard. The proposed site is more than 81 feet away from the Residential Support District to the east, and the facility complies with the building setback requirements for the Tourism Support District as established through the prior approval of the athletic facility. The proposed WCF has been designed using "stealth" design techniques to the extent feasible. The new antennas will be mounted as close to the light standard as technologically feasible, and the applicant was able to reduce the diameter of the radome from the initially proposed five feet to four feet. The radome will be painted to match the color of the light standard, thereby minimizing impacts. The equipment enclosure will be screened by the gymnasium behind it, vines to be planted on the enclosure fence, and painting the equipment to match the building behind it. Color photo-simulations have been provided to show what the project would look like from surrounding viewpoints. The applicant has provided site selection information indicating that other locations are not feasible. Overall, the proposed WCF is consistent with the Location, Design, Performance and Review Guidelines listed in Council Policy No. 64. E. Growth Management Ordinance (CMC Chapter 21.90}, Local Facilities Management Plan Zone 1 The proposed WCF is located in Local Facilities Management Plan Zone 1. Installation of the facility on the existing site and monthly facility maintenance visits will not result in increased public facilities demands; therefore, the proposal will not exceed performance standards for public facilities. IV. ENVIRONMENTAL RIEVIEW The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301(e), "Additions to Existing Structures," of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
