SUBJECT: COP 16-23-OCEAN STREET BEACH ACCESS IMPROVEMENTS-Request for approval of a
Coastal Development Permit to allow for improvements at seven (7) public beach
accesses within the Mello II Segment of the city's Coastal Zone located on the west side
of Ocean Street, north of Oak Avenue to Rue Des Chateaux within Local Facilities
Management Zone 1. The project site is within the appealable area of the California
Coastal Commission. The City Planner has determined that the project belongs to a class
of projects that the State Secretary for Natural Resources has found do not have a
significant impact on the environment, and it is therefore categorically exempt from the
requirement for the preparation of environmental documents pursuant to state CEQA
Guidelines Sections 15301 -repair and maintenance to existing facilities; 15302 -
replacement or reconstruction of existing facilities; 15303-new construction; and 15304
-minor alterations to the land and vegetation.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7189 APPROVING Coastal
Development Permit CDP 16-23 based upon the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The Ocean Street Beach Access Improvements project is a Capital Improvement Program (CIP) initiative
from the City of Carlsbad Parks & Recreation Department. The project area consists of seven (7) public
beach accesses along the west side of Ocean Street, from just north of Oak Avenue to Rue De Chateaux.
The accesses have been titled according to their nearest intersection to Ocean Street: Oak Avenue,
Carlsbad Village Drive, Grand Avenue, Christiansen Way, Beech Avenue, Cypress Avenue, and Rue Des
Chateaux.
The City of Carlsbad is responsible for the ongoing maintenance and refurbishment of these public beach
accesses. Due to age, wear, and marine air influences, several of these accesses are currently in significant
need of refurbishment. Conceptual plans for the refurbishment and improvement of the accesses have
been developed with significant public involvement and neighboring property owners through two public
meetings, an on-line survey and one-on-one meetings. Additionally, the city's Coastal Corridor team and
Coastal Commission staff were consulted during plan development.
The conceptual plans propose to generally refurbish and improve these seven (7) public beach accesses
by: 1) making the stairs, railings, and landings more attractive/inviting; 2) providing amenities like bike
racks, benches and trash/recycling receptacles that match those in the adjacent Village; 3) adding low

lighting at the stairs and crosswalks on Ocean Street for safety purposes; 4) increasing access for the
disabled to the street-level platforms; 5) beautifying the wider accesses with native drought-tolerant
landscaping; and 6) enhancing security/aesthetics for neighbors.
More specifically, the plans call for the: 1) removal/replacement or restoration of the concrete stairs; 2)
upgrades to the existing hand/guard rails and gates to marine grade black steel; 3) reconfiguration of
selective landings and outlooks to allow for better seating and viewing opportunities; 4) introduction of
drinking fountains at three accesses; 5) upgrades to the entry signage in keeping with that of the Village
parking lots; 6) Installation of ADA compliant curbs and landings; and 7) removal/replacement of aged
wooden property line fences with attractive skim-coated walls.
Project Site/Setting: The approximate one acre (combined total), project site is located on Ocean Street,
north of Oak Avenue, to Rue Des Chateaux as shown on the attached location map. The topography of
the site is flat at the street level and sloping westward towards the beach. Existing vegetation on the site
include palm trees, decorative shrubs, birds of paradise and ground cover, such as ice plant. Table "A"
below includes the General Plan designations, zoning and current land uses of the project site and
surrounding properties.

Proposed Grading: The project will require some minor cut work for the two mid-stair outlooks and stair
widening at the Carlsbad Village Drive and Grand Avenue accesses. Some fill work will also occur on the
street level to enlarge platforms at those two accesses. Estimated grading quantities include 380 cubic
yards (cy) of excavation and export. A minor grading permit will be required for this project.
The proposed improvements at the seven (7) public beach accesses are described in detail below.

Controlled Accesses
Two of the seven public accesses have locking gates: Christensen Way and Cypress Avenue. These gates
are unlocked from 5:00a.m. to 10:00 p.m., and sunrise to sunset, respectively, and self-lock and unlock.
These controlled accesses were previously approved with separate COP's issued by the California Coastal
Commission (CCC) and will remain self-locking/unlocking gates. There is signage that will remain which
informs the public of the unlocked hours and how to get out of the access if the gates lock while in the
access. The other five (5) accesses were approved for unrestricted beach access, and no changes to access
are proposed.
Landscaping
The proposed plant palette, shown on Sheets 5 & 6 of Attachment 4, depict all native drought-tolerant
plants. The final landscape plan will use plants from that palette and will be developed during the
construction drawing phase. Irrigation lines, low volume emitters and automatic controllers will also be
installed for plant survival.
Construction Timeline
The accesses will be improved two to three at a time, in a staggered manner, between the months of
September 2017 and May 2018, in an effort to avoid significant impacts to the public during the peak
summer months.
Ill. ANALYSIS
The project is subject to the following regulations and requirements:
A. General Plan Goals and Policies;
B. R-3 Multi Family Residential Zone; and
C. Coastal Development policies and regulations for the Mello II Segment of the Local
Coastal Program (LCP), the Coastal Resource Protection Overlay Zone, and the Coastal
Shoreline Development Overlay Zone (Chapters 21.201, 21.203, and 21.204 ofthe Zoning
Ordinance).
The recommendation for approval of this project was developed by analyzing the project's consistency
with the applicable city regulations and policies. The project's compliance with each of the above
regulations is discussed in detail in the sections below.
A. General Plan Land Use and Community Design and Mobility Elements
The project consists of upgrading seven (7) public beach accesses. The project is consistent with the
General Plan Land Use and Community Design and Mobility Elements as outlined in Table B below:

B. R-3 Multi Family Resiidential Zone
The public beach accesses are located within the R-3 Multi Family Residential Zone within public access
easements or within the city's public right-of-way. The zoning requirements for the zone are not
applicable to the public accesses {i.e. height, setbacks, etc.)
C. Conformance with the Coastal Development Regulations for the Mello II Segment of the LCP,
the Coastal Resource Protection Overlay Zone, and the Coastal Shoreline Development Overlay
Zone (Chapters 21.201, 21.203, and 21.204 of the Zoning Ordinance).
The project site is located within the Mello II Segment ofthe LCP and is in the Coastal Commission appeal
jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone,
and the Coastal Shoreline Development Overlay Zone. The project's compliance with each of these
programs and ordinances is discussed below:
1. Mello II Segment of the Certified LCP and all applicable policies.
The project proposes to gene!rally refurbish and improve seven {7) public beach accesses by: 1) making
the stairs, railings, platforms and landings more attractive/inviting; 2) providing amenities like bike racks,
benches and trash/recycling receptacles that match those in the adjacent Village; 3} adding low lighting
at the stairs and crosswalks for safety purposes; 4) increasing access for the disabled to the street-level
platforms; 5) beautifying the wider accesses with native drought-tolerant landscaping; and 6) enhancing
security/aesthetics for the adjacent neighbors.
The proposed development is in conformance with the Certified Local Coastal Program and all applicable
policies in that the proposed project is consistent with, or otherwise implements, the following Mello II
LCP policies:
a. Carlsbad LCP Mello II Policy 3-4 Grading and Landscaping Requirements. The project
complies because most of the work will be within public access easements or within the
public right-of-way and will either be replanted with native drought-tolerant vegetation
or the existing vegetation will remain, which will eliminate the possibility of erosion.
b. Carlsbad LCP Mello II Policy 4-3 Accelerated Soil Erosion. The project complies because
development proposed in areas of steep slopes (equal to or greater than 25% gradient),
will primarily be the removal of vegetation and/or replanting and some flat work to widen
sections of accesses and landings. The project also complies because the project will
implement a Storm Water Pollution Prevention Plan {SWPPP) during the construction
phase and a Storm Water Quality Management Plan {SWQMP) for permanent post
construction storm water pollution control 'best management practices' {BMPs) that
provide long term storm water treatment to insure proper storm water quality measures
during and after construction.
c. Carlsbad LCP Mello II Policy 4-4 Removal of Natural Vegetation. The project complies
because it will not remove any natural vegetation with the project.
d. Carlsbad LCP Mello II Policy 4-5 Soil Erosion Control Practices and Policy 4-6 Sediment
Control Practices. The project complies because onsite erosion will be avoided and

sediment controlled through the use of silt fences, sandbags and/or straw mulch rolls
being placed around excavated areas during the construction period.
e. Carlsbad LCP Mello II Policy 7-2 Shoreline Access Signage. The project complies as public
beach access signs will be installed at each of the seven (7) beach access ways, located on
the west side of Ocean Street.
Furthermore, the proposal is in conformity with the public access and recreation policies of Chapter 3 of
the Coastal Act in that the proposed improvements will not obstruct views of the coastline as seen from
public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No
agricultural uses currently e>Cist on the previously graded site, nor are there any sensitive resources
located on the developable portion of the site. The proposed public accesses are not located in an area
of known geologic instability and are located outside a flood hazard area.
2. Coastal Resource Protection Overlay Zone
The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC
Chapter 21.203 ofthe Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan,
Grading Ordinance, Storm Water Ordinance, BMP Design Manual and Jurisdictional Runoff Management
Program (JRMP) to avoid increased urban run-off, pollutants and soil erosion. The subject property does
not include native vegetation. Development proposed in areas of steep slopes (equal to or greater than
25% gradient), will primarily be the removal of non-native, ornamental vegetation and/or replanting and
some flat work to widen sectiions of accesses and landings. In addition, the site is not located in an area
prone to landslides, or susceptible to accelerated erosion, floods or liquefaction.
3. Coastal Shoreline Development Overlay Zone
As the project site is located within the Mello II Segment of the Local Coastal Program, and is located
between the ocean and the first public road parallel to the ocean, it is subject to the provisions of the
Coastal Shoreline Development Overlay Zone. The proposed development complies with all applicable
requirements of the Coastal Shoreline Development Overlay Zone as illustrated in Table C below:

A Notice of Exemption will be filed by the City Planner upon project approval.
