AGENDA OF: November 16, 2016 Project Planner: Chris Garcia Project Engineer: Steve Bobbett SUBJECT: CDP 16-40/NCP 16-03 – DOW ADDITION – Request for approval of a Coastal Development Permit and Nonconforming Construction Permit to allow the remodel of an existing single family residence and replace the 253 square foot second story with a 1,583 square foot second story addition on a .15 acre lot within the R-1 Zone and the Mello II Segment of the city’s Coastal Zone located at 5080 Carlsbad Boulevard within Local Facilities Management Zone 3. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303(a), construction of a single family residence, of the state CEQA Guidelines. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7208 APPROVING Coastal Development Permit CDP 16-40 and Nonconforming Construction Permit NCP 16-03, based upon the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The 0.15 acre (6,559 square feet) project site is located at 5080 Carlsbad Boulevard as shown on the attached location map. The topography of the lot consists of a generally flat pad area approximately six feet above the street. The lot is developed with a two-story, 2,107 square foot single- family residence and attached 290 square foot one-car garage. No agricultural activities, sensitive resources, geological instability, flood hazards or coastal access opportunities exist onsite. No sensitive plant species were found on the property. Table “A” below includes the General Plan Land Use designations, zoning and current land uses of the project site and surrounding properties. The existing first floor will be remodeled with a new floor plan, new windows and exterior materials. However, the existing square footage and building 1 CDP 16-40/NCP 16-03 – DOW ADDITION November 16, 2016 Page 2 footprint remain the same. The 5 bedroom/4 bath single-family home also includes 1,526 square feet of second floor decks. Exterior building materials consists primarily of stucco with a Santa Barbara finish. Secondary elements consist of cedar siding, varied windows, cable railings around the decks and a flat roof complementing the modern design. Proposed Grading: No grading is proposed with this project as the existing building footprint remains the same. III. ANALYSIS The project is subject to the following regulations and requirements: A. R-4 Residential General Plan Land Use Designation; B. One-Family Residential (R-1) Zone (CMC Chapter 21.10); C. Nonconforming Lots, Structures and Uses (C.M.C Chapter 21.48); D. Coastal Development Regulations for the Mello II Segment of the Local Coastal Program (CMC 21.201) and the Coastal Resource Protection Overlay Zone (CMC 21.203); E. Inclusionary Housing Ordinance (CMC Chapter 21.85); and F. Growth Management (CMC Chapter 21.90). The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable city regulations and policies. The project’s compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan Land Use Designation The project site has a General Plan Land Use designation of R-4 Residential which allows for the development of single-family residences at a density of 0-4 dwelling units per acre with a Growth Management Control Point (GMCP) of 3.2 dwelling units per acre. The project’s density (6.7 du/ac) exceeds the R-4 Residential density range of 0-4 du/ac. However, one single-family dwelling is permitted to be constructed on a legal lot that existed as of October 28, 2004 pursuant to General Plan Residential Land Use Policy 2-P.7. The subject lot was legally created prior to October 28, 2004; therefore development of a one-family dwelling is consistent with the R-4 General Plan Land Use designation. Growth Management compliance is discussed further in Section G below. B. One-Family Residential Zone with minimum 7,500 square foot lot size (R-1-7,500) The project is required to comply with all applicable regulations and development standards of the Carlsbad Municipal Code (CMC) including the One-Family Residential (R-1) zone. The proposed project meets or exceeds all applicable requirements of the R-1 zone as shown in Table “B” below. However, the city is requiring a seven foot dedication for future Carlsbad Boulevard improvements. Therefore, the existing house will have a nonconforming front setback of 18 feet. The existing house currently has legal, nonconforming side yard setbacks of five feet on the north side and four feet seven inches on the south side. The new addition is required to comply with the current required setbacks and therefore is setback at least six feet from the side property lines. Additionally, the existing home has nonconforming parking. A single-family home in the R-1 zone requires two parking spaces within a garage. The existing home only has a substandard one-car garage. However, two parking spaces are being provided in the driveway in front of the existing garage. See Section “C” below for more information. C. Nonconforming Lots, Structures and Uses (CMC Chapter 21.48) The project is required to comply with the requirements of the Nonconforming Lots, Structures and Uses chapter of the zoning ordinance because the existing home does not meet the six foot setbacks for the side yard (existing five feet on the north side and four feet seven inches on the south side) and does not meet the parking requirements for a single-family residence. The proposed addition to the existing home is in conformance with all applicable zoning standards as shown in Tables B and C above. Chapter 21.48 of the Carlsbad Municipal Code requires that four findings be made in order to approve a Nonconforming Construction Permit. All of the findings can be made for this project as discussed below. 1. The expansion of the residential structure would not result in an adverse impact to the health, safety and welfare of surrounding uses, persons or property in that the property is already developed with a single-family home and is surrounded by single-family residences. In addition, the proposed project improvements comply with all current planning, building, and engineering standards. 2. The area of expansion shall comply with all current requirements and development standards of the zone (R-1) in which it is located in that the new second story addition complies with current front, side and rear yard setback requirements and all other development standards such as building height and lot coverage. The project is consistent with the parking requirements in that two parking spaces are located in front of a substandard one-car garage and Section 21.48.050 A.3. of the Carlsbad Municipal Code allows residential lots with substandard parking to provide required parking within the paved driveway in the front yard setback. The expansion/replacement structure shall comply with all current fire protection and building codes and regulations contained in Titles 17 and 18 in that a building permit, issued by the City of Carlsbad, is required for the project and the building plans will be reviewed for consistency with applicable fire protection and building codes prior to issuance. Furthermore, the project will undergo standard building inspection procedures during the construction of the addition. 4. The expansion/replacement would result in a structure that would be considered an improvement to, or complimentary to and/or consistent with the character of the neighborhood in which it is located in that the proposed addition and remodel will upgrade the exterior appearance of the existing single-family home. Furthermore, the project does not propose to change the existing building footprint and the second story addition is consistent with other existing and approved two-story homes in the area. D. Conformance with the Coastal Development Regulations for the Mello II Segment of the Local Coastal Program (CMC Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203). The project site is located within the Mello II Segment of the Local Coastal Program and is not within the appeals jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone. The project’s compliance with each of these programs and ordinances is discussed below: 1. Mello II Segment of the Certified Local Coastal Program and all applicable policies The project is located in the Mello II Local Coastal Program Segment. The subject site has an LCP Land Use Plan designation of R-4 Residential, which allows for a density of 0 to 4 du/acre and 3.2 du/acre at the Growth Management Control Point (GMCP). At the R-4 GMCP, .5 dwelling units would be permitted on this 0.15 acre (net developable) property. However, one single- family dwelling is permitted to be constructed on a legal lot that existed as of October 28, 2004 pursuant to General Plan Residential Land Use Policy 2-P.7. The subject lot was legally created prior to October 28, 2004; therefore development of a one-family dwelling is consistent with the R-4 General Plan Land Use designation and R-4 LCP Land Use Plan designation. The project consists of the replacement of the existing 253 square foot second story with a new 1,583 square foot addition. The existing first floor will be remodeled with a new floor plan, new windows and exterior materials. The proposed addition and remodel is compatible with the surrounding development of one- and two-story single-family residential structures. The two-story residence will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. Furthermore, no agricultural uses exist on the previously graded site, nor are there any sensitive resources located on the site. The proposed single-family residence is not located in an area of known geologic instability or flood hazard; and given that the site does not have any frontage along the coastline, no public opportunities for coastal shoreline access or water-oriented recreational activities are available. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the city’s Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and CDP 16-40/NCP 16-03 – DOW ADDITION November 16, 2016 Page 5 Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The subject property is an undeveloped parcel that does not include steep slopes (equal to or greater than 25% gradient) nor native vegetation. In addition, the site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. E. Inclusionary Housing Ordinance (CMC Chapter 21.85) Pursuant to CMC Chapter 21.85.030 D.1., a project may be exempt from the inclusionary housing requirement if an existing residence is altered, improved, restored, repaired, expanded, or extended, provided that the number of units is not increased. Since there will not be an increase in the number of units on the property, the project will be exempt from the inclusionary housing requirement. F. Growth Management The proposed project is located within Local Facilities Management Zone 3 in the northwest quadrant of the city. No impacts are associated with the project as the project consists of a remodel and addition to an existing dwelling unit and no new impacts will be generated. IV. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15303(a) of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the State CEQA Guidelines do not apply to this project.
