AGENDA OF: August 16, 2017 Project Planner: Cliff Jones Project Engineer: Jeremy Riddle SUBJECT: CUP 11-07X1 (DEV11047) – SDG&E NORTH COAST OPS CENTER – Request for the first time extension of CUP 11-07 (CUP 11-07X1) to allow the continued operation of a 2,850 square foot temporary mobile building on the 16.37-acre SDG&E site located at 5016 Carlsbad Boulevard in the Agua Hedionda Segment of the Local Coastal Program and in Local Facilities Management Zone 3. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7259 RECOMMENDING APPROVAL of the first five-year time extension of CUP 11-07 (CUP 11-07X1) based upon the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND The applicant San Diego Gas and Electric (SDG&E), is requesting a five year extension of CUP 11-07 to allow the continued operation of a 2,850 square foot temporary mobile building at 5016 Carlsbad Boulevard that was approved by the City Council on May 8, 2012. Condition No. 11 of Resolution No. 6871 specifies that CUP 11-07 is granted for a period of five years but may be extended upon written application of the permittee (SDG&E). In an effort to ensure that progress towards a new location is being pursued, condition number 12 was included in Planning Commission Resolution No. 6871 that requires the City Council to be the final decision-making body on any five-year extension of the CUP. On January 14, 2014, the City Council approved a settlement agreement between the city, Carlsbad Municipal Water District (CMWD), Cabrillo Power I LLC and Carlsbad Energy Center LLC (collectively, NRG), and SDG&E. The purpose of the agreement was to resolve long-standing disputes between the City of Carlsbad and NRG regarding the Carlsbad Energy Center Project, and to provide for the redevelopment of the Encina Power Station site. Since the agreement was approved, the city and SDG&E have worked diligently to identify an acceptable site within the city to relocate the North Coast Operation Center. A site has not yet been identified, and options are still being explored by both parties. III. ANALYSIS A. The 2,850 square foot temporary mobile building continues to be consistent with all applicable plans, policies and regulations described below: A. Public Utilities (U) General Plan Land Use designation; B. Public Utility Zone (P-U, CMC Chapter 21.36); 3 CUP 11-07X1 (DEV11047) – SDG&E NORTH COAST OPS CENTER August 16, 2017 Page 2 C. Encina Specific Plan (SP 144); D. Conditional Use Permit Regulations (CMC Chapter 21.42); E. Parking Ordinance (C.M.C. Chapter 21.44); F. Carlsbad Local Coastal Program: Agua Hedionda Segment and Coastal Resource Protection Overlay Zone (C.M.C. Chapter 21.203); and G. Local Facilities Management Plan Zone 3. B. The adopted project findings for CUP 11-07, which are contained in Planning Commission Resolution No. 6871 still apply to this project (CUP 11-07X1). C. The adopted project conditions for CUP 11-07, which are contained in Planning Commission Resolution No. 6871, still apply to this project (CUP 11-07X1) with the exception of Condition No. 11 which is amended by Condition No. 4 in Planning Commission Resolution No. 7259, and with the exception of Condition No. 9 which is amended by Condition No. 5 in Planning Commission Resolution No. 7259. Condition No. 4 extends CUP 11-07 for five years from May 8, 2017, through May 7, 2022. Condition No. 5 requires the recordation of a Notice of Restriction for the extension of the CUP. D. No formal written complaints regarding CUP 11-07 have been submitted to the City. E. Annual reviews have been conducted for CUP 11-07 and the project is in compliance with all conditions of approval. IV. ENVIRONMENTAL REVIEW The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
