CD RECOMMENDED ACTION: Staff recommends the Authority ADOPT RESOLUTION NO. 4 rejecting all construction cost proposals received for the construction of the Carlsbad City Golf Course Project. ITEM EXPLANATION: At its meeting of April 18, 2000, the City Council of the City of Carlsbad, acting in concert with the Board of the Carlsbad Municipal Water District, approved the Joint Exercise of Powers Agreement creating the Carlsbad Public Financing Authority. On May 16, 2000, the Authority adopted rules and regulations, a conflict of interest code, and contractor selection procedures for the proposed Carlsbad City Golf Course Project. The Authority has become the controlling entity to finance, construct, manage, operate, and maintain the Golf Course Project on behalf of the City of Carlsbad as the owner of the property upon which the project will be developed. At its meeting of June 13, 2000, the Authority approved the plans and specifications and authorized the solicitation of construction cost proposals for the Golf Course Project. The Authority Board will recall this very large and complex project was divided into three (3) construction components: (1) golf course including all required on-site and off-site road and utility improvements and environmental mitigation, (2) all six (6) buildings including the clubhouse, and (3) bridge structure over College Boulevard. On September 13, 2000, the Authority received cost proposals from the following companies pre-qualified by the Authority for this project: Golf Course Construction Landscapes Unlimited, Inc. Wadsworth Golf Construction Ranger Golf, Inc. Environmental Golf, Inc. Hazard Construction Company $ 844,322 *** Total of 3 lowest cost proposals submitted: $25,493,725 The construction cost proposals are being recommended to be rejected by the Authority for two (2) reasons. First, because of jurisdictional conflicts and processing entanglements originating with various Federal and State Resource Agencies, including the California Coastal Commission, final certification of the Carlsbad Habitat Management Plan has been delayed indefinitely. Additionally, the California Coastal Commission has asserted “appeal authority” over the previously issued Coastal Development Permit for the City Golf Course Project eliminating any opportunity the City may have to proceed with golf course construction in the near term. The second reason for rejecting the construction cost proposals at this time is that the terms and conditions of the Authority’s solicitation of proposals specifies the cost proposals are valid for a period of 180 calendar days from the date of opening, which in this case was September 13, 2000. Therefore, the Authority must either award construction contracts within the 180 calendar day period or the cost proposals become null and void. The proposals expire on or about March 13, 2001. Therefore, it is recommended the Authority formally reject the above referenced construction cost proposals for all three (3) components of the Golf Course Project received by the Authority on September 13, 2000. On June 7, 2000, the Planning Commission adopted Resolution No. 4772 certifying the Environmental Impact Report finding the project consistent with the California Environmental Quality Act and applicable City ordinances and environmental policies. FISCAL IMPACT: The Authority incurs no costs or liabilities related to the solicitation and subsequent rejection of the above referenced construction cost proposals. EXHIBITS: 1. Resolution No. 4 regarding the Authority’s rejection of construction cost proposals for the Carlsbad City Golf Course Project. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 4 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD PUBLIC FINANCING AUTHORITY REJECTING CONSTRUCTION COST PROPOSALS FOR THE CARLSBAD CITY GOLF COURSE PROJECT WHEREAS, the Board of Directors of the Carlsbad Public Financing Authority did previously adopt a resolution approving the plans and specifications and authorized the solicitation of constriction cost proposals for the construction of the Carlsbad City Golf Course Project, hereafter referred to as the “Project;” and WHEREAS, said proposals were received and opened by the Authority on September 13,200O; and WHEREAS, said Project has been delayed indefinitely by involved Federal and State Resource Agencies; and WHEREAS, the Board of Directors hereby finds it necessary, desirable, and in the public interest to reject all construction cost proposals received by the Authority on September 13, 2000 for said Project. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the above recitations are true and correct. 2. That the Board of Directors does hereby reject all construction cost proposals received by the Authority on September 13, 2000 for the Project. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Cartsbad Public Financing Authority on the 6th day of March , 2001 by the following vote, to wit: 1 2 II AYES: Board Members Lewis, Kulchin, Finnila, Nygaard and Hall.
