Recreation ~~ ~ RECOMMENDED ACTION: It is recommended the City Council, acting as the Board of the Carlsbad Public Financing Authority, ADOPT RESOLUTION NO. 6 approving the plans and specifications and authorizing the advertisement of bids for the construction of Phase 1 of the Carlsbad City Golf Course Project, City Project Number 30721. CITY MGR -&- ITEM EXPLANATION: In 1999, the Carlsbad Public Financing Authority was formed to undertake the development, financing, construction, operation, and management of the proposed Carlsbad City Golf Course Project. The City Council sits as the Board of Directors for this Authority. On December 9, 2003, the City Council authorized proceeding with the development of the Carlsbad City Golf Course Project. Since this date, the Authority's design team has completed the extensive redesign of the project required by the August, 2003 approval of the project by the California Coastal Commission. Development of the project will be undertaken in two phases: Proiect Description Schedule Phase 1 : partial site clearing and fencing intended to initiate construction in conformance with the many project permits and entitlements October 2004 through March 2005 Phase 2: site grading and construction of golf course, all buildings including clubhouse, and all related facilities September 2005 through July 2007 This project has a gnatcatcher nesting season grading restriction contained within all of its permits which limits grading activities to the September to March timeframe in any year. Therefore, the critical importance of commencing the Phase 1 construction this Fall is to initiate construction activities in conformance with the City's many permits and entitlements. Several of the City's permits for this project will expire in mid-2005 unless construction activities in reliance upon those permits and entitlements is initiated. Therefore, the Authority will undertake a partial site clearing and fencing operation this year and then undertake the mass grading and follow-up construction operations beginning in September of 2005 through mid- 2007. The Phase 1 work consists of an extensive site survey and placement of steel stakes and protective orange environmental fencing over a large portion of the site. The orange fencing will follow the "limits of grading" for each of the golf holes, buildings, driving range, lakes, and other facilities that drain southerly toward Palomar Airport Road and College Boulevard. Within the outline of the orange fencing will be a mowing or topping of the vegetation with the materials removed and disposed of off-site. Installed will be several water quality control measures that will minimize erosion and contain any potential runoff. The area to be cleared in Phase 1 represents about two-thirds of the entire golf course site. The remaining one-third of the site that drains northerly toward Macario Canyon Creek will be not be included in this Phase 1 work. Because of the steep slopes, the general erosiveness of the soil, and the sensitivity of resources adjacent and within Macario Canyon Creek, the clearing of the site that drains toward the creek is not recommended to be done at this time. It will be accomplished in the subsequenl Phase 2 project. Also to be installed the entire length of site frontage along Palomar Airport Road, College Boulevard, and Hidden Valley Road will be a protective 6-foot chain link fence. This will assist with securing the overall site and protect the orange environmental fencing that separates the future grading of the golf course from the preserved habitat on the property. I PAGE 2 OF AGENDA BILL NO. 004 All of the work described in Phase 1 is work that would be undertaken initially in the Golf Course Project development regardless of phasing. Nothing is lost by undertaking these operations in the phased approach recommended. The challenge to the Authority as the project developer is to minimize its costs in Phase 1 yet still accomplish substantial work so that its many permits and entitlements do not expire. Phase 1 as outlined will accomplish that goal. A listing of the City’s permits for this project is as follows: Public Aqencv Permit City of Carlsbad San Diego Gas and Electric SDRWQCB Discharge Waiver; California Coastal Commission Cal. Dept. of Fish and Game US Army Corps of Engineers Us Fish and Wildlife Service CUP, HDP, SUP, CDP (subsequently appealed by CCC), and various grading, building, and storm water discharge approvals; Encroachment Permit; Coastal Development Permit; 1601 Agreement; 404 Permit; ESA “take authority” under Carlsbad HMP. Staff recommends approval of the plans and specifications and authorization to bid the Phase 1 work for the Carlsbad City Golf Course Project. Bids are scheduled to be received and opened by the City on September 15, 2004. Award of a contract by the City Council, acting as the Authority Board, for Phase 1 would be tentatively scheduled for October 5, 2004 with work to commence by the end of that month and be completed well before the March, 2005 nesting season deadline. In the interim, Staff wishes to identify the following actions are required to be completed and / or certified before the City can award the Phase 1 work this coming October: Issuance of the California Coastal Commission’s (“CCC) Coastal Development Permit The CCC unanimously approved the “Notice of Intent“ (‘“01”) to issue their permit to the Authority with several General and Special Conditions in August, 2003. The design team has completed the project redesign and repackaging of the extensive set of documents, reports, exhibits, studies, deeds, and other data and materials outlined in the CCC permit Special Conditions and delivered the package to CCC staff, San Diego office, the second week of July. City staff has requested a 30 day review by CCC staff under their “NOI” of the document package with issuance of the Coastal Development Permit to the City immediately thereafter. Citv of Carlsbad Dedication of Open Space and Conservation Easement CCC permit, Special Condition 10, requires the City via the Authority, as property owner, dedicate an open space and conservation easement over all “non-golf course project development areas” on the site that preclude future development and conserve habitat resources. The Authority’s design team is currently finalizing the necessary documentation to grant the required easemenl over these areas of the site. This will come before the City Council in the near future for review and action. Awroval of the Carlsbad Habitat Management Plan and Execution of the Implementing Aqreement bv the Citv and the United States Fish and Wildlife Service The Carlsbad City Golf Course Project is a “hard-line” project under the City’s HMP. Planning Department staff have indicated final certification of the City’s HMP is scheduled for September, 2004. Joint agency execution of the accompanying Implementing Agreement will empower the City of Carlsbad with “take authority” to issue permits under the HMP. The first permit to be issued under this new City process will be to the Authority for the Carlsbad City Golf Course Project in the late September to early October timeframe. PAGE 3 OF AGENDA BILL NO. 004 Carlsbad Acquisition and Subsequent Dedication of 51 Acres of off-Site Mitiqation ProDerh/ As negotiated with the United States Fish and Wildlife Service and required under the City’s HMP for the Carlsbad City Golf Course Project, the City must acquire 51 specific acres of property located within the “County Core” as mitigation for a partial taking of onsite resources required of the golf course development. City staff, working with the City Attorney’s Office, are finalizing the negotiations with the property owners for this acquisition. A draft acquisition agreement has been prepared and is nearing completion. This agreement will also come before the City Council in the near future for review and action. ENVIRONMENTAL REVIEW: On June 7, 2000, the Planning Commission adopted Resolution No. 4772 certifying the Environmental Impact Report for the Carlsbad City Golf Course Project finding the project in compliance with the environmental regulations and policies of the City of Carlsbad. The project’s Conditional Use Permit, Hillside Development Permit, Special Use Permit, and Coastal Development Permit (subsequently acted upon by the California Coastal Commission) were also approved. FISCAL IMPACT: The City Council has appropriated a total of $350,000 for this Phase 1 work in the FY 2004 - 2005 Capital Improvement Program budget. The Engineer‘s estimate for the work is anticipated to be within a range of $250,000 to perhaps $550,000 or higher. There is no available construction cost data on a “mowing and fencing” operation such as this to rely upon. The work is relatively small in scale and scope and of limited duration (only 90 calendar days total )so the bids should be expected to be within a wider range of cost. Staff wishes to point out that embarking upon Phase 1 of this project represents the City’s commitment to developing the Golf Course Project as proposed on this site. In the December 9, 2003 presentation, project development estimates reported to the City Council in 2002 - 2003 dollar values were $29.4 million for the complete golf course facility with the permanent clubhouse building and $24.4 million for the complete golf course facility with a temporary clubhouse building. Under the current schedule, the project is being constructed over multiple fiscal years and well into mid-2007. The City can expect total development cost increases consistent with the construction market index over this time period. The City Council’s direction to staff at the December 9, 2003 meeting was to proceed with the development of the complete golf course project, including the permanent clubhouse building, bul explore other potential funding opportunities for the permanent clubhouse. Later this calendar year, staff will report to the City Council the following: 1. 2. 3. Progress of the Phase 1 construction; Status of the solicitation of proposals to outside firms to operate and manage the completed Golf Course Project on behalf of the Authority; An analysis of other potential funding opportunities for the clubhouse. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the plans and specifications for Phase 1 of the Project on file in the ofice of the Recreation Department of the City of Carlsbad are hereby approved and the City Clerk is authorized and directed to advertise for bids for the Project in accordance with State law.
