Recommended Action Provide feedback to staff on proposed Carlsbad Municipal Code amendments relating to the Traffic Safety Commission’s role and duties. Background At the annual goal setting workshop held on March 20, 2018 City Council directed staff to change the name and amend the duties of the Traffic Safety Commission (TSC) to better align with the implementation of the General Plan Mobility Element. The proposed amendments adjust all references to the TSC, update the duties of the Traffic Safety Commission relating to multimodal transportation systems, and remove sections from Chapter 2.28 of the Carlsbad Municipal Code to eliminate redundancy with Chapter 2.15, which relates to all boards and commissions. The proposed amendments expand the duties of the TSC to be involved in all mobility issues, and not just automobile traffic. Discussion A goal setting workshop was hosted by the City Council on March 20, 2018. City Council approved Resolution No. 2018-052 on April 17, 2018 establishing the City Council goals that included the following: By April 2019, amend the duties of the Traffic Safety Commission to include advising the City Council on matters related to implementation of the General Plan Mobility Element. Based on suggestions from current TSC Commissioners relating to potential Carlsbad Municipal Code amendments, Staff is bringing this proposal forward for discussion and feedback from the TSC. Exhibit 1 is staff’s proposed Carlsbad Municipal Code amendments relating to the TSC’s expanded role and duties. Staff took this opportunity to review all CMC sections that related to, or referenced, the TSC, with the resulting recommendations: • revise CMC Section 2.28.010 to change the name of the TSC to the Traffic and Mobility Commission; • revise CMC Section 2.28.050 to change the duties of the renamed Traffic and Mobility Commission relating to multimodal transportation systems; • revise CMC sections 2.15.050, and 2.12.125 to reference the Traffic and Mobility Commission instead of the TSC; • eliminate CMC sections 2.28.020 and 2.28.040 since sections found within Chapter 2.15 have been added or revised to address the same subject matter. In addition to staff’s recommended amendments (Exhibit 1), Exhibit 2 is Carlsbad Municipal Code amendments language that staff received from Commissioner Linke on June 20, 2019. The TSC may consider both proposals in providing feedback to staff on proposed amendments to the Carlsbad Municipal Code relating to the TSC’s role and duties. Additionally, City Council’s adoption of Carlsbad Municipal Code amendments relating to the TSC will assist in the process of preparing a work plan for the TSC, which will guide the TSC’s work over the next year. Necessary Council Action An ordinance will be required to be adopted by the City Council to make changes to the Carlsbad Municipal Code relating to the TSC’s role and duties. Next Steps Staff will prepare a staff report to City Council to introduce one or more versions of amendments to the Carlsbad Municipal Code relating to the TSC’s role and duties. After Council adopts amendments to the Carlsbad Municipal Code relating to the TSC, Staff will prepare a draft work plan for the Commission that reflects the adopted Carlsbad Municipal Code amendments. Proposed CMC Amendments – Commissioner Linke EXHIBIT 1 Chapter 2.28 TRAFFIC AND MOBILITY SAFETY COMMISSION Sections: 2.28.010 Created. 2.28.020 Membership—Appointment—Terms. 2.28.040 Officers—Meetings—Reports—Conduct of meetings. 2.28.050 Duties. 2.28.010 Created. A traffic and mobility safety commission for the city is created. 2.28.020 Membership—Appointment—Terms. The traffic safety commission shall consist of five seven members appointed by the mayor and confirmed by the city council. Each member shall serve until their successor is duly appointed. The members shall serve staggered terms at least two years apart. In order to stagger the terms, upon the next appointment of commission members after the effective date of the ordinance from which this section derives, two members will be appointed for terms expiring two years thereafter and three members will be appointed for terms expiring four years thereafter. All subsequent appointments will be for four-year terms. Members of the commission may be removed by the mayor with the consent of the city council at any time. The transportation director shall be an ex officio member and serve as secretary to the commission. The ex officio member shall not be entitled to vote. 2.28.040 Officers—Meetings—Reports—Conduct of meetings. The commission shall elect a chair, a vice chair, and such other officers as it deems desirable. The officers shall serve for a term of one year and until the election of successors. The commission shall hold meetings no less than once during each calendar month (provided agenda items exist), and shall send a report of each month’s meeting to the city council. The commission may adopt its own rules and regulations. 2.28.050 Duties. It shall be the duty of the traffic and safety mobility commission to study all matters referred to it concerning mobility and traffic safety and pedestrian safety, including implementation of the General Plan Mobility Element, and to make written recommendations to the city council regarding measures that should be taken to promote mobility and traffic and pedestrian safety within the city as follows: A. Review staff studies and reports, and make recommendations to the city council on mobility and traffic safety matters involving, including those related to traffic and pedestrian, bicycle, and vehicular modes of travel safety; B. Provide a public forum to review citizen complaints and requestscommunity input regarding traffic and pedestrian safety mobility and traffic safety matters, including those related to pedestrian, bicycle, vehicular and other modes of travel; C. Review and Pprovide recommendations for revision to the city codes and plans on mobility and traffic safety matters, involving including those related to traffic and pedestrian safety, bicycle and vehicular modes of travel, and parking and school traffic safety. ---_--___ -- EXHIBIT 1 2.15.050 Appointments. A. Appointments to the planning commission, parks and recreation commission, and traffic and mobility safety commission, shall be made by the following process: 1. The mayor and each councilmember shall nominate one individual to serve on each of the commissions for a term coinciding with the term of the councilmember making the appointment. The mayor shall nominate two additional individuals to serve on each of the commissions. All nominations shall be subject to ratification by a majority vote of the city council. If a nominee is not approved by a majority vote of the city council, the councilmember making the nomination may nominate another individual at the same or a subsequent meeting. In the event that a member of the city council does not make any nomination within 45 days of the date the councilmember is sworn into office or within 60 days of the occurrence of a vacancy, the appointment will be made by the mayor with the approval of the city council. 2. Although each member of the city council elected by a district shall use his or her best efforts to appoint individuals residing in that district to these commissions, members of the city council may appoint individuals not residing in their districts in their discretion in order to assure that the most interested and qualified individuals serve on the commissions. B. Appointments to all other city boards and commissions shall be made by the mayor with the approval of the city council. 2.12.125 Attendance at commission meetings. The city manager may attend any and all meetings of the planning commission, parks and recreation commission, harbor commission, library commission, traffic and mobility safety commission and any other commissions, boards or committees created by the city council, upon the city manager’s own volition or upon direction of the city council. At such meetings which the city manager attends, he or she shall be heard by such commissions, boards or committees as to all matters upon which the city manager wishes to address the members thereof, and he or she shall inform the members as to the status of any matter being considered by the city council, and the city manager shall cooperate to the fullest extent with the members of all commissions, boards or committees appointed by the city council. Traffic Safety Commission, Commissioner Report By: Steve Linke (submitted June 20, 2019) Subject: Municipal Code Update Meeting Date: July 1, 2019 Background It is my understanding from City Manager Chadwick that the municipal code update to change the name and duties of the Traffic Safety Commission has now been prioritized again and will be on our July 1st agenda. Accordingly, I am submitting the following suggested update for discussion purposes. Proposed Municipal Code Update Chapter 2.28 TRAFFIC AND MOBILITY COMMISSION 2.28.010 Created. A Mobility Commission for the city is created. 2.28.050 Duties. The Mobility Commission shall have the duty to provide a forum for community input, and to review and provide recommendations to the City Council and Planning Commission, on all mobility-related matters, including implementation and application of the General Plan Mobility Element and revision to city codes and plans. Rationale • The new name and duties are consistent with the City Council’s original goal: “Amend the Carlsbad Municipal Code to revise the duties of the Traffic Safety Commission to include advising the City Council on matters related to implementation of the General Plan Mobility Element.” • Because the Planning Commission has decision-making power independent of the City Council on matters that often include Mobility Element-related issues, such as traffic impact analyses/studies for developments, transportation demand management, etc., I included advising the “Planning Commission,” as well as the City Council, although we should seek guidance from the City Council on that. • I included the reference to providing recommendations on “revision to city codes and plans,” because that is a duty in the current municipal code that is not specifically described in the Mobility Element. The remaining duties listed in the current municipal code are all encompassed by the reference to the Mobility Element, which includes traffic safety, pedestrian safety, school safety, and parking.
