Library Conference Room CALL TO ORDER Call to order was made by Chairman A. J. Skotnicki at 2:06 P.M., it being noted that the meeting was moved to the Library Conference Room due to a meeting in session in the City Council Chambers. ROLL CALL Roll call was taken by Chairman Skotnicki and it was noted that the following were present: Chairman Skotnicki - Appointed Carlsbad Citizen Shirley Truitt - Appointed Carlsbad Citizen Miriam Nichols - Appointed Vista Citizen Ronald Wooten - Representative of the Vista Chamber of Commerce Buddy Lewis - Carlsbad City Council Liaison Lloyd von Haden - Vista City Council Liaison Peal Tade - League of Women Voters Member Wayne Thompson - Audubon Society Member Also present was Nancy Wade - Vista City Council Member Absent: Don Brown - Carlsbad Chamber of Commerce Representative ^ Dave Rorich - Appointed Oceanside Citizen Fred Swearingen - Oceanside Chamber of Commerce Representative Ray Burgess - Oceanside City Council Liaison Appointed Vista Citizen Appointed Oceanside Citizen APPROVAL OF MINUTES: The Minutes of the Meeting on December 4, 1980, were approved as presented. COMMITTEE ORGANIZATION Committee Office Establishment Chairman Skotnicki indicated he had agreed to accept the position of Chair until such time as the Committee was sufficiently formed to establish a permanent chair and vice-chair. While only 11 of the 14 members comprising the Committee were entitled to vote -- the 3 Council members, each representing their City being liaisons only -• Chairman Skotnicki indicated there was a quorum and therefore a valid chair and vice-chair could be established. Nominations were then opened. -1- Wayne Thompson nominated A. J. Skotnicki. Chairman Skotnicki accepted, indicating that as a resident of Carlsbad, he believed those persons residing in Carlsbad have a greater responsibility to resolve the lagoon problem. The Committee then discussed the appointment of Shirley Truitt as vice-chair. It was discussed that ideally, both the chair and vice-chair should be representative of the cities with common lagoon boundaries. In that Mrs. Truitt also resides in Carlsbad and there are no representative of Oceanside present at this meeting, the matter of a vice-chair was deferred until the next meeting. Following the nomination of A. J. Skotnicki as permanent chairman, the Committee unanimously voted in favor of same. Committee Goals & Objectives Chairman Skotnicki indicated that in addition to the objective in forming this Committee, to wit: exert pressure at the appropriate government levels to obtain funds to dredge the lagoon; initiate and carry through various kinds of political action to encourage state and federal governments to provide funds, interest has been expressed in maintaining the Committee on a permanent basis as an ad- visory committee for the maintenance of the lagoon and the water- shed. Committee discussion reflected that the Committee should become an advisory body to the three Cities, meeting in both Oceanside and Carlsbad in the interests of equity, and requesting the respective City Councils to give the Committee writen objectives and^guidelines as to hosting of the meetings and type of support provided. Tri-City Joint Resolution It was the consensus of this Committee that same be made permanent and known as the Buena Vista Lagoon Management Advisory Committee via a joint Resolution adopted by the Cities of Carlsbad, Oceanside and Vista, specifying goals, objectives,members and such other items as deemed necessary. REPORT ON MEETING WITH STATE FISH & GAME, ATTORNEY GENERAL'S OFFICE AND TRI-CITY AREA REPRESENTATIVE. Chairman Skotnicki indicated that on December 16, 1980, representatives from the State Attorney Generalrs Office met with City staff from Oceanside, Vista and Carlsbad. The conclusion of that meeting indicates that while the lagoon belongs to the State who will there- fore be responsible for the maintenance of the lagoon, siltation is the responsibility of the developers, landowners and political subdivisions. If the local political subdivisions allow the lagoon to silt up and take no action to avoid same, the State Attorney General's Office will consider litigation to enforce them to do so. -2- Lorraine Galloway of Oceanside inquired if development above the lagoon could be looked to to provide some of the funds for dredging in that the grading above the lagoon was probably a contributing factor to the siltation. Chairman Skotnicki responded that the State Fish & Game representatives were currently investigating the grading ordinances of Vista, Oceanside and Carlsbad, as they relate to this problem, with an eye toward fixing responsibility for erosion and identifying where corrective action should be taken. Grant Applications Dave Bradstreet, Director of Parks & Recreation detailed the responses received from various agencies which have been contacted as possible sources of funds, only one of which -- the 1980 State Bond Park Act -.-- appeared to offer any encouragement. All responses would be analysized in terms of yes, no, or possible, with a further report to be made to the Committee. ACTION TAKEN ON STATE'S RECENT APPEAL Chairman Skotnicki gave a status report on this matter, indicating that he was still awaiting final information as to the decision. Chairman Skotnicki then explained the "chain letter" approach may be helpful in increasing the exposure of the lagoon problem.. Also, he expressed the opinion that the Committee should appeal directly to Mr. Wilcox of the Federal Emergency Management Agency to visit here before he renders his decision on the appeal. Mr. Skotnicki requested that Mr. Bradstreet draft a letter extending the invitation. Mrs. Tade additionally indicated that the League of Women Voter's has an appointment with Senator Craven which would present a good opportunity to solicit Senator Craven's assistance and support in the matter. LAGOON TOUR Chairman Skotnicki explained he has discussed with Mr. Bradstreet a tour of the lagoon which would also include inland portions of Vista to look at possible areas which are contributing to the siltation condition in the Lagoon proper, with the County Flood Control and Fish & Game representatives attending as expert guides. While the logistics may preclude participation by persons other than Committee members,the Committee agreed that members of the public would be free to accompany the tour providing their own transportation. It was agreed that when arrangements were made, an itinerary and map would be furnished to the local newspapers. STATE FISH & GAME REPORT ON MANAGEMENT PLAN Earl Lauppe reported on the status of the Fish & Game Management Plan, indicating the draft would be completed shortly. With regard to the Fish & Game Appeal, while there was no response as of this time, an update will be furnished. -3- SLIDE PRESENTATION - STEVE KIMPLE Mr. Kimple presented an accompanying narrative to the slides, explaining the different locations from which pictures were taken, and describing the subject efforts in preventing erosion at construction sites in terms of possible improvements and effectiveness of same. In addition to construction sites, pictures of other areas of erosion had been included to demonstrate the various sources of siltation which, as Mr. Kimple explained, contribute via the sewer and storm drain system although such areas may be well removed from the lagoon. At the conclusion of the slide presentation, Chairman Skotnicki expressed the opinion that the Committee should interest the respective City Councils in viewing same in that it would be very useful to them in identifying sources of siltation. ADJOURNMENT The Committee adjourned at 3:52 P.M. to Friday, February 27, 1981 at 2:00 P.M. in the City Council Chambers.
