1. Call to Order and Minutes of Meeting of March 23. 1977
Chairman Stiles called the meeting to order at 9:00 a.m.
A motion passed (Foo-Skotnicki) to approve the minutes of the JAC
meeting of March 23, 1977 as submitted.
2. Special Executive Session
In view of Paul Pressman's resignation as JAC counsel, Chairman Stiles
called for an Executive Session to discuss the hiring of the firm of
Walker & Gann as legal counsel to the Encina Joint Powers. Following
reconvening to an open meeting, the Chairman entertained a motion
for retaining new JAC counsel.
Motion passed (Zapotocky-Casler) to instruct the JAC counsel to pre-
pare an agreement to provide for JAC legal services to be rendered by
the firm of Walker & Gann at the rate of $50 per hour plus reimburse-
ment of actual out-of-pocket costs and a cancellation of the existing
agreement with the Vista Sanitation District to provide for legal ser-
vices.
3. Review of Septage Dumping Program
Pursuant to a request at the last JAC meeting, Les Evans, with the
assistance of the San Diego County Department of Sanitation and Flood
Control, reviewed the current septage dumping program.
Following a discussion of that review, a motion was passed (Zapotocky-
Foo) to revise the present septage dumping charges and to adopt the
balance of the report's recommendations as follows:

Recommendations:
1. That no significant changes in dumping procedures be made at the pres-
ent time.
2. That the emergency manhole remain open until such time as plant operat-
ing hours are expanded.
3. That improved signing should be placed at the dump site, clearly indi-
cating what constitutes unacceptable waste and outlining dumping and
clean-up procedures.
4. That regular (weekly) random samples of septage waste be taken and
analyzed for suspend solids, BOD, grease and oil and, if considered
necessary, heavy metals.
4. Status of Encina Phase III Project
Mr. Evans discussed the results of his meeting with the EPA on April 12,
1977 regarding the Encina Phase III project. He explained that EPA
wants a timetable for implementation of the RAQS tactics prior to giv-
ing Step 2, or project design, approval. Further, EPA will then look
closely during the design period on how well the timetable is being
met. Provided that the Encina area governments are meeting the time-
table, coming close or showing an effort toward meeting the timetable,
the EPA would then look favorably on granting Step 3, or construction,
approval .
During the discussion which followed, a question was raised regarding
the pending appeal on the coastal permit. Mr. Pressman pointed out
that the Coastal Commission is currently considering, and about to
adopt, an emergency regulation on how they are going to conduct sew-
age treatment plant permit applications. He explained that those
regulations purport to apply only to new applications; however, the
significant part of these new regulations is that a Coastal Commission
permit will be necessary before getting concept approval from the
Water Resources Control Board. Mr. Pressman stated, however, that
he did not believe that is the case with EWPCF's pending permit inas-
much as we are under the old act. It was the general concensus that
now would be an appropriate time to check with the Coastal Commission
as to whether we should go forward with our permit application or
wait for actual concept (Step 2) approval in lieu of first reaching
agreement with EPA and WRCB before going to the Coastal Commission.
Mr. Pressman agreed to pursue this.

5. Status of 1977-78 Budget Preparation
The JAC members reviewed 1977-78 budget estimates prepared by Les
Evans.
In the discussion which followed, Mr. Kubota recommended that CETA
funds be reapplied for. A question was also raised as to whether in-
surance coverage is adequate. No formal action was taken.
Mr. Evans asked the members to further review the budget figures for
finalization at the next meeting.
6. Status Report on Implementation of the Woodside/Kubota Report
At the last JAC meeting, following acceptance of the Woodside/Kubota
report, Mr. Foo suggested that Mr. Evans give progress reports on
implementation of the suggestions in that report.
Accordingly, Mr. Evans reported that a more intensive effort in heavy
metals monitoring by the San Diego Laboratory/Industrial Waste section
had been instituted in addition to monthly meetings with the Encina
operators, chemist and the industrial waste staff.
Further, the Encina chemist is reviewing sampling devices, and an al-
lowance for the purchase of three sampling devices for monitoring
influent and effluent will be included in the 1977-78 budget.
In addition, automatic valves, which will enable the digesters to be
fed continuously, have been ordered.
Also, random sampling of septage haulers has been instituted.
7. Operation and Maintenance Report
Mr. Evans stated that nothing unusual had transpired in the month of
March. He did point out, however, that one of the sedimentation tanks
had been drained in order to get a low flow through the meter to change
the propeller, commenting that no noticeable change had occurred as a
result of the replacement. He added that the McCrometer Corp. is de-
• signing straightening vanes to be inserted in the pipe to determine
whether hydraulic conditions are responsible for the high readings.
8. Flow Report
Les Evans gave a brief overview of the March Flow Report explaining
the bases of the participating agencies' flows.
9. Sulfide Condition Report
The members' attention was drawn to this report. There was no discus-
sion.

10. Expenditure Reports
There was no discussion of this report.
11. San Diego County Proposal for Hydraulic and Chemical Testing
At the March 23, 1977 JAC meeting, a motion was passed to employ
Brown & Caldwell to do hydraulic and coagulation testing as to the
feasibility of increasing the plant's capacity.
Inasmuch as the County is doing a similar study at San Elijo, Mr.
Evans requested a proposal from the County. The County's response,
in the form of a letter from the Director of the Department of Sani-
tation & Flood Control, was reviewed by the JAC members.
It was pointed out that the method of testing used by the County is
similar to that of Brown & Caldwell; the price is less; and the
time period is relatively the same.
Mr. Evans stated that the study could be done without any contractual
arrangements as the County can bill EWPCF in the regular operations
billing.
A motion passed (Zapotocky-Skotnicki) to rescind the motion passed
at last month's meeting employing Brown & Caldwell to do hydraulic
and coagulation testing and to accept .the County's proposal to con-
duct the study.
12. Recommendation from JAC Management Subcommittee
Chairman Stiles reported that the subcommittee had developed no recom-
mendations on the Manager's Reorganization Report. The subcommittee
requested that the JAC authorize holding the report in abeyance pend-
ing the development of a draft reorganization plan to be submitted
to the Manager and Counsel no later than July 1, 1977.
Mr. Skotnicki added that the subcommittee did not study the Manager's
report but discussed the alternatives of going to an interim form of
management or going directly into a separate regulatory agency. Be-
cause the subcommittee did not have that wide a scope of authority,
the members recommended requesting, from the full JAC, the authority
to further investigate the step of going directly into an independent
regulatory agency and the continuance of the subcommittee.
A motion passed (Zopotocky-McKay) authorizing continuance of the sub-
committee with instructions to come up with recommendations by July 1,
1977 with Ms. Casler and Mr. Skotnicki opposed. No subcommittee meet-
ing date was established.

13. Adjournment
The meeting adjourned to the EWPCF Conference Room at noon on May 5,
1977.
The next regularly scheduled meeting will be at 9:00 a.m. on May 25, 1977.
