MINUTES OF SEPTEMBER 29, 1977 MEETING
Chairman Stiles asked for approval of the September 29, 1977 minutes
as submitted. On motion by Mr. Zapotocky, seconded by Mr. Van Sickle,
the motion carried.
3. COASTAL COMMISSION PERMIT CONDITIONS
Chairman Stiles asked Mr. Evans to report on the Coastal Commission
conditions.
Mr. Evans explained that the condition, recommended by the Coastal
Commission staff for the issuance of the Encina permit, requires no
premature development of the agricultural or steep slope areas of
the coastal zone. He further explained that the specific conditions
were not entirely clear and, in some cases, even contrary to law.
He also indicated that the maps referred to in the statement of con-
dition have not yet been prepared. Due to the confusion over the
conditions, Evans requested that the Encina permit conditions be
withdrawn from the Coastal Commission agenda of October 19 until
such time that we could get with Commission staff and better under-
stand the conditions.
Mr. Gann added that the procedures by which the Coastal Commission
intended that the conditions be accomplished exhibits a lack of un-
derstanding of the law and, therefore, we could expect some changes
in those conditions. He specifically mentioned that the conditions
regarding boundary reorganization were almost an impossibility if
the inhabitants of the area to be detached do not approve. He also
explained that the zone of benefit condition was not applicable to a
general law city or special district but only to a community service
district.
Mr. Skotnicki questioned what the Coastal Commission was trying to
accomplish through the permit process.
Mr. Gann replied that he believed the Coastal Commission staff was
trying to prevent situations where prime agricultural land was taxed
for sewer purposes and when it came time for a permit to be ruled
upon, the property owners asserted a vested interest in that they
had been paying for sewer and that they were entitled to it. Pro-
portedly, that situation placed the Coastal Commission in a very
awkward position.
Chairman Stiles asked if we had replied to the Coastal Commission staff
report and recommended condition. Mr. Evans indicated that a meeting
with the Coastal Commission staff had been tentatively set for the
morning of November 8 to review the conditions, talk about maps and to
discuss areas that should or should not be protected.

The City of Carlsbad, Encinitas Sanitary District and Leucadia County
Water District have been notified of the meeting.
Mr. Skotnicki asked why the county should not be notified since it is
the land use agency in those areas not covered by the City of Carlsbad.
Mr. Evans agreed that the county should also be represented.
Mr. Dominquez asked if the Coastal Commission's legal counsel had been
contacted in regard to the conditions. Mr. Gann explained that direct
contact with the counsel had not yet been made. Mr. Dominquez asked
if we could formulate a response to the Coastal Commission staff re-
port and conditions. Mr. Gann suggested a letter to Mr. McGrath, in
advance of the November 8 meeting, regarding suggestions and again re-
stating our position.
In response to Mr. Kubota's question of Coastal Commission's authority
to impose the recommended conditions, Mr. Gann indicated that he had
researched the matter and found two cases in which the courts had over-
ruled the home rule powers of local agencies in favor of the broad
powers of the Coastal Commission.
Mr. Zapotocky indicated that the matter should be brought to a conclu-
sion and said he felt that the attorney and manager had the matter well
in hand and that we had heard an expression from almost every member
agency. He suggested we leave it there. There was general agreement
that the manager and general counsel represent the position of the
Joint Advisory Committee to the Coastal Commission.
4. RWQCB STAFF REPORT
Mr. Evans explained that the NPDES permit for the Encina Facility con-
tained a provision that no odors may be detectable outside the plant
property. He further explained that, in a recent in-depth inspection
of the Encina Water Pollution Control Facility by the Regional Board
staff, the only negative result was a recurring odor violation -
mainly noticeable on the freeway and often attributed to the foaming
digester. The RWQCB meeting of October 24, 1977 included a staff
report on the odor violation and action on the report was a continu-
ation of the staff study for 60 days. At that time, the Board staff
will report on the progress we've made in overcoming the odor problem
and, if necessary, set a public hearing with the possibility of issu-
ing an enforcement order.
Mr. Zapotocky asked if the odor violation would affect a request for
rerating of the treatment plant. Mr. Evans replied that he doubted
very much that a rerating would be possible as long as there was any
permit violation.

In order to overcome the odors caused by digester foaming, the
perature of Digester No. 1 will be-reduced to about 80 and mixing
reduced.
Mr. Evans also explained that John Murk and Jerry Freiling of CM
Engineering have offered to construct three miniature digesters for
experimental purposes, with the only costs to the Joint Powers to
be $450.00 to purchase materials.
Mr. McKay moved and Mr. Zapotocky seconded that $450.00 be authorized
for purchase of the miniature digesters. The motion was carried.
Mr. Evans indicated that results from the proposed digester testing
program would take at least 120 days.
The possibility of covering the foaming digester to contain odors was
discussed. By motion of Mr. Schneider, second by Mr. Dominquez, the
Joint Advisory Committee directed the General Manager to arrange for
covering of Digester No. 1. The motion was unanimously approved.
REPORTS - ROUTINE
OPERATIONS AND MAINTENANCE REPORT
Chairman Stiles stated that he didn't see anything noteworthy on the
Operations and Maintenance Report and, unless someone had any ques-
tions, it would be passed by.
6. FLOW REPORT
Chairman Stiles asked Mr. Evans for his comments on the Flow Report.
Mr. Evans stated that he did not think that the propeller meter was
working correctly. The last test at 7% low, possibly caused by some-
thing caught in the straightening vanes. The operators will have to
come in early in the morning at low flow, stop the flow and crawl up
the pipe and clean it out.
Mr. Zapotocky said that in Vista, their local water purveyor tells
them that the flows are still 12 to 12^% down over last year.
Mr. Evans agreed that the Vista flows are definitely down but the
meter seems to be working correctly. It's reading about 2.7 mgd or
2.8 mgd and about 6 months or a year ago, it was reading over 3 mgd.
Except for the Carlsbad flows f everybody is either holding steady or
declining slightly.

7. SULFIDE CONDITION REPORT
Chairman Stiles asked Mr. Evans for his comments on the Sulfide Con-
dition Report. Mr. Evans indicated that the readings were pretty
consistent with the problem areas remaining the same. We have sealed
the manhole at the Encinitas/Leucadia structure in response to the
complaints we were having with odors there and since we sealed the
junction manhole and since Encinitas Sanitary District sealed the man-
hole at the end of the force main, we have had no more complaints
about odors at that particular location.
8. EXPENDITURE REPORTS
Chairman Stiles asked Mr. Evans for his comments on the Expenditure
Reports. Mr. Evans indicated that the figures seem to be pretty
reasonable and, as we can expect, we are starting to drop slightly
under the prorated budget totals mostly because the county hasn't
finished hiring the additional personnel authorized out here and
the expenditures are usually recorded several weeks or several months
after they've actually been made or obligated so capital outlay items
are not yet reflected on the expenditure report. There doesn't seem
to be any problem, except for the Vista flow meter where we spent half
of the budget.
ACTION
9. DAON CORPORATION LETTER
Chairman Stiles called on Joe Stucker of Daon Corporation for his re-
port. Mr. Stucker advised that the Daon Corporation will fund the
construction of a one mgd sewer treatment plant to be built with
Phase I of the development of Shadow Ridge. The plant will be built
to full capacity rather than being phased over the development life.
The plant will serve the Buena Sanitation District to the extent of
0.62 mgd (equivalent to current capacity at the Encina Plant) and
Shadow Ridge with the balance of 0.38 mgd, allowing development to
occur within Buena Sanitation District for approximately four (4)
years (based on purchase of 20 hook-ups per month and 1000 equivalent
units of capacity remaining). The 0.38 mgd will be adequate for
Shadow Ridge until 1983 or approximately five (5) years.
The current raw sewerage interception line will be converted to a
treated sewerage line and a by-pass will be constructed at the En-
cina Plant to take the treated effluent directly to the ocean out-
fall.

Mr. Stucker requested that an action be taken to direct the various
staffs to work with Daon Corporation and Buena Sanitation District
to develop a proposal which would not only solve their sewer problems
but would also create some capacity in the Encina plant that could
assist other districts in the Joint Powers Agency.
Mr. Zapotocky made the motion to direct staff to work with the pro-
ponents to determine the feasibility. Seconded by Mr. Dominquez, the
motion carried.
Mr. Hanson proposed that a standing committee be established which
would be involved in reviewing and providing information as it comes
in from the various agencies that are proposing satellite treatment
plants. Chairman Stiles named Messrs. Hanson, Evans, McKay, Frandsen
and Oldseri to be on this Committee.
10. PROPOSAL FOR DESIGN OF A GAS MIXING SYSTEM FOR DIGESTER NO. 2
Chairman Stiles asked Mr. Evans to give a report on the proposal for
the design of a gas mixing system for Digester No. 2. Mr. Evans ad-
vised that he had been given permission several months ago to adver-
tise for bids prepared to specification for a gas mixing system for
Digester No. 2. The equipment had to be designed so that it could
be inserted through the top of the digester. Walker Process was the
only firm to furnish a bid for equipment. Their price was over
$35,000.00 for equipment only, no installation. There was a question
about the size of the compressor unit that was to go on the mixing
system.
A recommendation was made by CM Engineering Associates that they write
the specifications, have a local fabricator build it and use local in-
stallation. Mr. Evans recommended that the Joint Advisory Committee
authorize the City of Carlsbad to contract with CM Engineering Asso-
ciates in accordance with their design for a mixing system for Di-
gester No. 2.
Mr. Zapotocky moved that the City of Carlsbad be authorized to nego-
tiate a contract covering the CM Engineering Associates proposal.
Seconded by Mr. Van Sickle, the motion carried.
It was noted that this was part of the budget and had already been
approved.
A question arose as to the qualifications of CM Engineering and its
engineers. Mr. Evans stated that the qualifications were not included
in the agenda packet because of the extra bulk but that the qualifi-
cation sheets were available for review. He further added that he
well satisfied with the qualifications of both CM Engineering Associates
and their engineers.

11. ENCINA GENERAL MANAGER'S SALARY
Mr. Beckman stated that, although Mr. Evans was technically an employee
of the City of Carlsbad, by agreement he is operating under the author-
ity of the Joint Advisory Committee. Therefore, Mr. Beckman recommended
that the Joint Advisory Committee:
a. Authorize a 5% increase in the salary range of the Encina
General Manager to account for the cost of living increase
recently received by the City of Carlsbad.
b. Authorize a 5% increase within the salary range effective on
Mr. Evans1 anniversary date (November 15, 1977).
Mr. Zapotocky moved to Mr. Beckman"s recommendation. Seconded by Mr.
Mahr, the motion carried.
OTHER BUSINESS
a. Permanent Secretary for General Manager
Mr. Schneider recommended that steps be taken to hire a permanent
secretary who could become familiar with the Encina operations.
Mr. Skotnicki stated that he would take this matter up with the
Ci,ty of Carlsbad Manager to resolve same within a reasonable length
of time.
b. Water Saver Kits
Mr. Dominquez asked whether we were underway on the program. Mr.
Evans stated that Sharon Reed had called him several times and be-
cause the City of Carlsbad had already distributed them in some
manner, she felt that Encinitas Sanitation District, Vista Sani-
tation District and Leucadia County Water District should receive
this material.
c. "The Great Escape" or "The Sewer Story"
Mr. Stiles stated that through diligent research, study, concen-
tration, travels throughout the world, Mr. Kubota has come up with
a book which he recommends we keep as our Bible for the operation
of a sewer plant. Entitled "The Great Escape" or "The Sewer Story",
the book will be kept here at the office for the purusal of inter-
ested parties.
d. Joint Advisory Committee November Meeting Date
Mr. Zapotocky noted that the November meeting date was November 23

which was the day before Thanksgiving. Mr. Zapotocky moved that
the date be changed to Tuesday, November 22. Seconded by Mr. Foo,
the motion carried.
There being no further business, the meeting adjourned at 10:55 A.M.
The next regularly scheduled meeting will be at 9:00 A.M. on November 22,
1977 in the Conference Room of the Encina Water Pollution Control Facility.
