'- \A\\\ X V5" PLACE OF MEETING: City Manager's Conference Room V\\ \\-\\ DATE OF MEETING: September 10, 1970 '. \\\\\\\ ROLL CALL: OATH OF OFFICE: The Oath of Office was administered by the Deputy City Clerk to Dr. John Earl, Col. Carl Neiswen- der, Miss Barbara Westree, Dr. Philip Pryde and Dr. Robert Young . ELECTION OF OFFICERS: Acting Chairman Neiswender announced nominations were opened for Chairman' of the Commission. Col. Neiswender nominated himself for Chairman, seconded by Dr. Pryde. By proper motion, nominations for Chairman were closed. The Chairman announced nominations were opened for the office of Vice-Chairman. A nomination was made and seconded naming John McGowan. By proper motion, nominations for Vice-Chairman were closed The Chairman announced nominations were opened for the office of Secretary. ' . A nomination was made and seconded naming Barbara Westree. By proper motion, nominations for Secretary were closed. DISCUSSION: The Chairman opened discussion to the Commission on various problems which may be faced in the future and explained the function of the Commission. He stated the reason for the Commission is to control the pollution problem in this area with the growth of the City, as well as other problems applicable to the Commission. The Chairman stated when a proposal is made to the Council on development, the Council will consult with the Commissio before granting permission if Council has any questions on possible pollution problems, etc. Miss Westree stated two items which she would like the commission to consider is waste management and noise con- trol, and investigating what role the Commission can play in suggesting certain kinds of legislation they believe would be beneficial in this field. Mr. Neiswender stated that Miss Westree. is a resident of Carlsbad but she brings with her a wealth of information from the San Francisco Area where she works. The informa- tion she offers will be of assistance to the Commission. Mr. Olinghouse stated regarding local ability, to control legislation, the cities are concerned with other implica- tions such as regional cantrol and that would probably over-ride the purpose of the bill. He stated this Commis? io could approach the City Council on the offer of certain bills. The Ordinance gives the Commission the right to act freely and calls for only one meeting a year. The Chairman further stated since the Commission was formed at the request of the Council, they will assist with legal, planning, and engineering, etc. problems. Dr. Young stated he has been interested in keeping noise from invading private homes and if the people in Carlsbad would like to see the same thing, he can propose some accoustical ideas; such as a building code on sound in- stallation. The Planning Director stated that this could be done, per- haps like the fire code requires that a fire wall be con- structed to allow the wall a certain burning time before • they can, spread to other parts of the building. The noise problem is one the City is trying to fight right now. Dr. Young stated that noise is upsetting the balance of ecology because the birds are not nesting, the rabits are not rabiting, and are not eating the grass which in turn makes for a more hazardous fire area. Also the coyote is not getting' the foods because the animals are not there so that soon the coyote will be in search of dogs, or other domestic animals when they really get hungry. Dr.. Young stated he would like to offer some advice on the noise problem but felt it might not be free of legalities. He stated motorcycles are a major noise problem and stated the reason why is because they are allowed to make as much noise as a truck. Mr. Olinghouse stated he could supply information on the noise element and other items of importance to the Commissi Mr. Nieswender stated if the Commission coul-d come up with a good noise control ordinance that is not pre-empted by the State Vehicle Code, they would really be accomplishing something. Also they would have legal assistance from the City. The Commission went into discussion of the possibility of of all city vehicles being converted to propane. Mr. Neiswender stated this was a consideration of the City at one time and at that time, San Diego Gas and Electric offered assistance in starting such a pilot program. The thought that S.D.G. & E. might contribute as a public service. Dr. Pryde stated he felt conversion of City - vehicles to propane gas was a very good idea. Discussion of collection of metal, paper and glass was . inspired by Miss Westree. on . CITY OF CARLSBAD ENVIRONMENTAL POLLUTION CONTROL September 10, 1970 -3- The Chairman stated he felt a tour of the S.D.G.&'E. Encina Power Plant would be beneficial to the Commission and stated it could be arranged some Saturday at the Commission convenience, . perhaps about 9 or 9:30 a.m. would be a good time. Dr. Young presented, an instrument in relation to the noise element which measured the amount of noise. In operating it in the City Manager's Conference Room, with all members quiet, the instrument recorded 48 decibels which Dr. Young stated was more than allowed in the industrial zone. Chairman Neiswender requested the following members to do some research on subjects brought up at the meeting which members were interested in. Barbara Westree Collection of glass, metal and paper . Dr. Robert Young Noise Element Dr. Philip Pryde General Parks and Recreation and Open Space Chairman Neiswender also stated that Mr. Olinghouse would made arrangements for the members of the Commission and their friends (those interested in the problems of pollu- tion) to tour the Encina Power Plant the first Saturday in November. He requested those Commission members who would like to tour the plant contact Mr. Olinghouse prior to the tour to let him know how many people will be avail- able to go on the tour. Dr. Young stated he would not be available at that time. Miss Westree inquired if the Commission was interested in the Gas Tax Bill and inquired if a meeting should be set up prior to the November Election and felt perhaps the Commission could made a public statement, as technicians, which may have some potential on the citizens. By unanimous decision, the Commission set their next meeting date for Tuesday, October 27, 1970. By proper motion, the meeting was adjourned. Respectfully submitted, NORA .K.
