meeting was called to order at ?s30 ?.i-i. toy Chairman Betzmer, Comnia-
B loners present were: Lamb, Weeks, Alien, Oaburn, zahler c.nd Jeffers.
Others present were ilr. Gllssaan ana I-J?. Baird.
Upon a motion made by commissioner iuaab, seconded by Commissioner Osburo
and carried unanimously, the Jtoanission dispensed tilth the reading of the
meeting of Sept. «, 1950, and were- approved as written.
Chairman Betzmer made the following atatement of appreciation and purpose:
"Since being appointed to the iiarbor Commission by Ilayor Lough and subse-
quently elected to act as Chairman of the Uarbor Commission, a realization
of the complex problems confronting the members of the Ilarbor Commission
rapidly be cane apparent to me and I aa certain that all the members of tlie
Commission have that same feeling.
v/e realize that our acceptance of the appointments to the Ilarbor Goaais-
sion places a burden on us and challenges all the members to utilize their
mature Judgment, resources and abilities to the end that the Agua Iledlonda
Lagoon shall furnish to the people of Carlsbad and Its friends of the ad-
joining areas a nnrine recreation area as well as an area for our youth
to enjoy wholesome pleasure and water sports.
For the confidence that liayor jjough and the City Council have manifestly
expressed In appointing us to the Harbor Commission, we express our appre-
ciation and it is our sincere hope that as time goes by, we will cause the
ilayor and the city Council to feel pride and good judgment prevailed when
the appointments were mads.
To accomplish the desired effect, much work must be done in a cool and
calculated manner lest we blunder into a costly method for our tax payers
to inherit, we are indebted to the previous administration for ohe search-
ing work in its effort to accomplish Its goal. They have had considerable
success and some disappoint ing reverses, but all these factors will be a
kelp to us in arriving at a solution to the diversified problems facing
us. For this we express our appreciation to the previous administration.
As members of this .Commission, we have a challenge confronting us and we
fully intend to overcome all obstacles. But in the process of removing
these obstacles, many differences of opinions will become apparent. How-
ever, much good will shall be created. Hay I oper.k for the members of
this Commission when I say th--.t we shall relentlessly and fearlessly ez-
plore each facet of this complex problem before us nnd that preferential
treatment of any group or individual must be frowned upon and meticulously
avoided.
V/e aspire to dedicate our services to the end that a solution will be found
to establish, a Liarlne Recreation Area and a small boat harbor for the people
of Carlsbad rand their friauds of the surrounding areas. .
As a Esrbor Commission th-s seven members are burdened. with the task of
making orderly recommend!" tions to 'the City Council 'for their guidance.
Our status is that of ah -advisory group anS consequently we can neither
render a final decision nor formulate policy. That is the function of the
City Council, with this understanding relative to our duties I feel it es-
sential to dmonish each member of the Harbor Commission that along tilth
our restricted duties vie also oust restrain ourselves in thr.t official press
releases, shall not be made by us since this is p. function of the City Coun-cil. •
The press and. interested parties may attend the open Harbor Commission
meet ings and use the material so obtained. We need and welcome all civic
assistance possible.
I thank you."
Chairnan Betzaer pointed out that it was essential that all meetings of
the Harbor Coaalssion be conducted in accordance tilth accepted parliamen-
tary proceed ure to Insure orderly conduct of meetings. Upon the consent
of tile Commission, Chairman Betzeer appointed Commissioner Allen as Par-
liamentarian tihose function it shall be to advise on points of order.
Chairman Betzoer submitted a proceedure of meetings outline which t;as ap-
proved by the Commission as follows:

2. Heading of minutes of previous meeting - correction
or approval,
3. Unfinished business
4. Reports of committees

B. Discussion was held relative to the Carlsbad Ilarbor Commission
being notified of State Harbor Comaisslon meetings too late to
make the necessary arrangements for representative to attend.

discussion and approval by the Coaaission, the following oooalttees
were appointed by the Chairman:
1. Secretary Weeks and Cliairnaa Betzaer appointed to standing com-
mittee to prepare agenda prior to each meeting.
2. Coainissioners Laab and zahler appointed to the Public Eclat ions
Oomaittee to obtain the support of civic organisations and stimulate pub-
lic interest and attendanae at Ilarbor Coaaission meetings. Sec'y Weeks
also ;;as directed to placs notices of meetings in newspapers .
3. Coomissioners Zahler, Osbum and Jeffers appointed to investi-
gate, report aiid aake recommendations relative to the existing conditions
in and immediately adjaceat to the Lagoon. Investigations to include:
a. Sanitation and public rest room facilities.
b. Acceptable o conventional marine construction
and Installations.
o. Safety measures in practise ashore and afloat
for tho protection of the public.
d. Water borne traffic and its control.
e. Allocation of areas for various water and re-
creational activities.

5. Upon a motion made by Commissioner Allen and seconded by Com-
missioner Zahler and passed unanimously, a committee was formed conslst-
of Commissioners Jeffers, Allen and Betzmer to investigate all avenues of
information to determine the legal end specifio status of the Agua
Hedlonda Lagoon relative to the tidal and navigable aspects.
6. Commissioners Lamb and osburn appointed to review and make
report to the Harbor Commission on Ordinances, Harbor Eegulations and
matters of importance contained in the Harbor Commission files in the City
.Hall.
7. Upon a motion made by Commissioner Betzmer, seconded by Com-
missioner Allen and passed unanimously, the Secretary was directed to re-
quest the City Council to obtain copies of ordinances and harbor regula-
tions from the City of ilewport and San Diego harbors. The request should
Include: construction of harbor installations, sanitary code, safety,
and traffic regulations.
G. After discussion of suggestion made by Commissioner Lamb, Com-
missioner Allen made a motion which wasseppnded by Secretary Ueeko and
passed unanimously that Commissioner ^fiSSsfand Chairman Betzmer serve as
a committee to investigate and inform the Commission on various ways of
administration and control of the Harbor.
it was brought to the attention of the Commission by Commissioner Zahler
that there would be a state Interim Committee meeting on Friday, Sept. 26,
195G, in Fresno. It was recommended that Chairman Betzmer recommend to
the City Council at their meeting of Sept, 2'-/th that a representative of
the City, preferably from the Harbor Commission, be sent to the meeting
in Fresno, Sept. 26, 1950.
Discussion was hold relative to obtaining notification of Small Craft and
Harbor Commission meetings. Secretary u'eeks and Chairman Betsmer were
requested to investigate,
A report was made by llr. G-llssman on the last State meeting relative to
requests made by various cities. lie also stated that Carlsbad was called
upon but no representative was present and that he informed the State of
the formation of a new Harbor Commission.
Two requests of action were brought to the attention of t lie Commission by
property owner, David Balrd as follows:
1, Does the Commission plan to provide a safe area for sail
boats?
2. l/lll the Commission endeavor to abate the noise and nuisance
on the Lagoon on Sundays?
Hr. Bnlrd was informed by the- chairman that various committees
had been formed to study nuch problems and report to the Commission at;
which time the Commission could decide on type of recommendation to pre-
sent to the City council. Chairman Betzmer requested that lir. Balrd file

Commission Mahler informed, the Commission that a request uill be made at
the meeting of October 13th for mooring facilities on the Lagoon for sail
boats,
A motion uas made by Commissioner Iamb, seconded by Commissioner Allen and
unanimously passed that tue recommendation be made to the City Jouno.il
that the Harbor Commission be furnished a report on all accidents and
citations occurring in tha area under the jurisdiction of the Harbor Com-
mission.
Discussion was held pertaining to the rules governing the Carlsbad Lagoon
acd a suggestion uas oade by Secretary ".,:eeks that rules governing sail
boats and other crafts be brought to the Commission for study and evalu-
ation.
Upon a proper motion the meeting uas adjourned at 9:15 J?«H» Ueirb regular
