Minutes of the Spcoio.l Meeting of Oct. 2, 195C, were read by Seo'y
Weeks and the following corrections uero made:
Page 2, Sece IV, Par. 13 - the phrase "and be designated as
Sive-aile an hour speed zones " to be added to the motion
after the tiords "launching and anchorage"*
Page 3, Seoo IV, Par, C - the uord "Flotilla" be changed
to read "Auxiliary". The line viill then read: "Discussion
was also held pertaining to the possibility of establish-
ing a Coast Guard Auxiliary on the Lagoon."
The nlnutes were unanimously approved as corrected.

A, Gnn0 Laab reported on Public Relations Coranittee urging tlir.t
citizens bo encouraged to attend aeetlngs of the Ifarbor Goa-
nission and eicpress their vievrs. He also recoanencled tlitit
the Harbor Commission hear all citizens at all tines under
Parliamentary Rule as it is essential in order to encourage
attendance.
Sec'y Weeks vir.s instructed by the Chairman to inform the
press of meetings and agenda,
It was moved by Cnn. Lamb and seconded by Can. /Jahler that:
"The harbor Commission request the I layer to Publically
request the cooperation of citizens and participation
in ^procee&Ln&K and operations at Harbor Commission
meetings «"
After discussion, the motion died clue to the lac!: of a
majority vote, 3 voting aye and 3 voting nay.
Further discussion brought forth the following points of
interest:
Can, Weeks str.ted that this is the responsibility of the
Harbor Commission*
Chairman Betzmer recommended that Cans, Lamb and Zaliler
contact civic organisations to stimulate their interest*
Cmn, Weeks stated that the Hayor should not be bothered
with minor cetails.
Cmiu Lamb stated thr.t lie -would withdraw from this committee
if nothing shall be done unless it is done by the commit-
tee, and that he was interested to Irnow whether or not
the Mayor wanted a Harbor„
Chairman Betzmer stated that the Mayor is involved in a
very delicate situation in the City at this time«
B, (1) Cmn0 Zahler reported on existing conditions adjacent to
the Lagoon and referred to the progress report submitted to
the City Council on Oct, 7th,
Ccm. l/eelrs stated that no action had boen taken by the City
Council on Can. Zahler's report relative to establishing a
five-*nile an hour .speed limit. •
After discussion a motion was made by Cnn« Zahler, seconded
by Cmne Allen that:
"A fornal request be sent to the City Council outlining
Cmn. Zahler's report, to include copies of the letters
received from the Sailing Club and the Chamber of Com-
merce, and that a representative be sent to follow up
at the next regular meeting of the Council."

(2) Discussion was held relative to Hr. Bairds complaint on
noise at the lagoon* The Chairman Informed the Commission
that Hr. Baird had been requested to file a formal written
complaint to the Commission before action was taken and
that a committee was active to study the conditions at the
present timoa Cmne Zahler stated that the suggestion had
been made to establish the hour of 9 A,II, on Sunday mornings
for starting of motors. However, no formal statement had
been made to date from this committee,
C, (1) Chairman Betamer reported for the committee investigat-
ing the navigability of the Lagoon and made the recommenda-
tion that a letter be sent to the Army Snginoers in Long
Beach requesting information on the status of the Lagoon
and the possibility of meeting with the Engineers.
(2) A discussion was then held relative to the original
motion previously passed on Sept. 0, 1958, recommending a
meeting with the. San Diego Gas and KLeotric Co. Cnn, Lamb
Suggested that it might be possible to negotiate a lease
from the San Diego Gas £ Electric Coa in order to qualify
for State and Federal Construction loans,
Cnna Allon referred to a letter received from II. JeStevens stating that in applying to the State for loans for
harbor projects, all property shall be owned or fully con-
trolled by the Cits'" °^ Harbor District»
D, Cmn« Osburn reported that Ms committee recommended that
each member of" the Harbor Commission investigate the Harbor
Commission files in order to be brought up to date on pre-
vious developments and efforts*
E0 Discussion was held relative to the types of administration
types of districts, etc. IIo notion recommended at tliis time,
as the Commission felt more time ma needed for study and
investigation,,

le Letter from Chamber of Commerce including trio resolu-
tions adopted by the Chamber of Commerce relative to the
formation of a Harbor District and its boundaries, and the
opening up of Hoover Street designating a swimming area
and five mile an hour spped zones*
2. Copy of letter sent to the City Council on Ocfc8 3S 195G,
filing a protest against the Harbor Commission Chairman for
"his dictatorial action against Ilr. Torres as President of
the Chamber of Commerce and as a private citizen."
Cranr. Allen requested to go on recorded as stating that
the Harbor Commission has an agenda and Hr. Torres was out
of order and that he felt that the Chairman was perfectly
within his rights.
Cmnr. T/eeks stated that he was sorry it happened and
that he agreed that Hr. Torres was out of order. He in-
formed the Commission that he had called lir. Torres prior
to this meeting to determine if he had anything he wanted
to discussa I-Ir. Torres was not at home but the message
was left with Mrs. Torres for him to calle Cmnr* Weeks
reported that ilr. Torres did not return his call,,
Cmnr » Lamb reported that Ilr. Torres was attending a
School Board meeting. Cmnr. Lamb further stated that it
is the responsibility of the Harbor Commission to make
aure that everyone leaves the Harbor Commission meetings
happy and that it is essential that everyone attending a
public meeting receive proper treatment as previously
stated by liayor Lough, Cranr. Lamb said it was part of the
Harbor Commission's job to hear anyone tiho comes before
tho Commission,
Cmnr. Weeks pointed out that Hr. Torres load interrupted
the meeting and refused to stay to make his report at a
later time in 'jhe meeting,
Cmnrs Zahlor informed the Commission that Hr, Torres
had been granted a minute and a half and that no effort
was made to inform Hr. Torres what time was proper to
mako MB report, Cnnr, Cahler further stated that he
could see nothing in Hr, Torres report to warrant the
treatment given to Hr. Torres 0
At this point Chairman Betsmer entertained a motion to re-
primand the Harbor Commission Chairman. IIo motion was made o

"The Harbor Commission scad a letter of apology to the
Chariber of Commerce of Carlsbad to the effect that the
incident of October 2nd referred to in llr, Torres' letter
of October 3*'<3. was a misunderstanding and encourage the
continued support of the Chamber of Commerce*"
Chairman Bctzmer turned the chair over to Seofy VJeelrs and
moved to amend the motion, seconded by Cmnra Allen that:
Amendment to the notion ,-,':l:
"If the proceedure of the Harbor Commission is such as
to send a letter of apology to the Chamber of Commerce,
that it include a minority report and the reason for
Chairman Betzmer's stand in the matter and that he uill
exceed to an apology,"
Ayes - 3 Hays -3. Amendment to the notion ,,"1 was not
carried due to the lack of a majority vote*
It was further noved to amend the motion by Cmnr* Allen
and seconded by Cmnrc Betzmer that:
Amendment to the notion ?/2:
"The letter of apology to the Chamber of Commerce be ac-
companied by a copy of the minutes of tills meeting which,
will definitely erplaln what the feelings are in the matter*"
Amendment to the iiotion »'2 was carried by a majority vote
of ifr ayes and 2 nays.
At this point Cmnr* Bctzmcr requested that the minutes show
his statements as an individual and that he will not apolo-
gize and docs not exceed in any respect to any apology to
the Chamber of Commerce« Prom that point on the ilarbor
Commission may do anything it desires*
A third amendment to the motion was made by Cmnr. Betzmer
and seconded by Cmnra Sahler that:

"The letter be read to the Harbor Coar.iission in order to
approve its wording and text."
The amenclnent to the motion ;,"3 died due to the lack of a
majority vote,, three votina aye and three voting nay.
The original notion made by Cmnr. Lamb and 2nd by Cmnr*
Osbnrn was caroled by a majority vote of ty with Conrs.
Betzner and Allen voting nay.
The chair was turned back to Chairman Betzmer*,
3« She reading of the letter from the Sailing Club was
dispensed with as having already been acted upon.
4 a Letter was read from 11 c J. Stevens, Division of Snail
Craft Harbors relative to construction loans and stated
that applications must be made prior to the llov. 20th
meeting in Monterey,
Sec'y Weeks read the requirements for construction IOPJGIS
under the provisions of Snail Graft Harbor Lavr also known
as Section 5001, et seq, of the Public Resources Code.
After discussion relative to qualifying for a construction
loan, Cmntfo Osburn requested that each member be supplied
as soon as possible with a copy of the requirements as
read*
Discussion was hold relative to paying of a loan through
revenue bonds as suggested by Ilr. Stevens, contemplated
development in order to qualify for a construction loan,
inspection of boats, and the extension of the seaward
jettye Chairman Betzraer then requested the aid of lir.
Glissman to work with the committee previously formed to
investigate these natters.
Cliairnan Betzmer then requested that all neribers give a
great deal of study to the problem and have suggestions
ready for next meeting. He also recommended that they
study Hr« Kelly's Harbor District report, consider con-
tacting the San Diego Gas <T; illecgrlc Go, and have sug-
gestions ready for next meeting,, The Chairman requested
the Gommissior. to lend its best efforts to these points
and try to come up with the best answers in order to re~
commend to the City Council the stand the Harbor Commis-
sion will take in these matters,
IV. ORAL DISCUSSIOIIS:
As Discussion wa^ held by the Commission, supplemented by HraGiissman, relative to the feasibility of contacting theSan Diego Gas & Electric Co* at this time relative to
Harbor Development and the removal of booms and the original
motion passed on Sept, Oth being sent through to the City
Council recommending a meeting with the San Diego Gas &Electric Go,
It was moved ley Cmnr, Allen and 2nd by Cmnr, Weeks that:
"Tiic motion passed on Sept. 0^ 195G recommending to the
City Council that a meeting be arranged -with the San Diego
Gao £ Electric GoB be tabled*"

A. Cliairman Betzmer called to the attention of the Commission
Orclino^ce 1032 creating the Carlsbad Harbor Commission, its
duties and functions in respect to other city activities,
specifically Sec. ?: Duties: to make recommendations to
the City Council.
Chairman Betzmer recommended tint the Commission recon-
sider tlie natter of the letter of apology to be mailed
to the Chanber of Commerce as not being recommended to
the City Council,, He further stated that correspondence
should be nade through tlie City Council and with their
approval as the Ilarbor Commission was merely an advisory
group,
Chairnan Betzman then turned the chair over to Secfy l/eelcs.
It was moved by Cmnr, Betzmer and 2nd by Cmnr. Allen that:
"The matter of writing the letter to the Chanber of Commerce
as a letter of apology be stricken from the record unless
approved by the City Council."
An. amendment to the motion was made by Cmnr. Lamb and End
by Cmnr« Osburn to:
"Table Cmnr* Dotsner^s notion to strike the writing of the
letter of apology to the Chamber of Commerce unless ap-
proved by the City Council,"
The amendment to the motion was carried by a majority vote
of *!• ayes and Cmnre Betzmer and Cmnr, Allen voting "no".
The Chair was turned back to Chairman Betzrner.
B» Cmnr8 Lamb reported that his committee had met and discussed
the feasibility of a Harbor District and requested suggestions
as to how large a Ilarbor District should be.
Chairman Betzner then turned the chair over to Sec9y Ueeka*
A motion was made by Cmnr. Betsmer that:
"The Ilarbor Commission recommend to the City Council that
they revise Ordinance 1032 to encompass the recommendations
being made by the Ilarbor Commission" so that they may be
able to act independently of tlie City Council without being
a recommending or advisory body."
She motion died due to the lack of a second,

Upon a motion made by Cmnr,, Weeks, seconded by Cnnr. Osburn and
unanimously passec.* the meeting was adjourned at 10:05 P«H»
