HomeMy WebLinkAbout1958-11-28; Harbor Commission Ad Hoc; MinutesHINUves OF B30ULAE HSBTIHO OF THii CARLSBAD HA1BOR COMMISSION November 20, 1953 The regular meeting of the Carlsbad Harbor Commission was an Informal luncheon meeting held at the Pantry Shelf in Carlsbad at 12:00 noon. Chairman Weeks presiding. Cmrs. Present: Jeffers, Allen, Osbum and Zahler Cmrs. Absent: Lamb, Betzmer Others Present: Mayor Ledgerwood, Own. Sonneman, H. J. Stevens, Chief State Small Craft Haifcor Commission, City Manager, Max Palkowski, and City Engineer, Clyde Jenkins. Chairman Weeks called the meeting to order and introduced Mr. H. J. Stevens, Chief, State Small Craft Harbor Commission, who presented inforoation relative to the establishing and developmentof a Harbor. Mr. Stevens discussed various agencies which could be employed for the development of the Agua Hedionda Lagoon. He stated that a Harbor District is considered the best agency by the State as its sole function is to create and maintain boating facilities. This allows direct dealing with the State and Foderal Governments. In forming a District, any boundaries may be established but must have the vote within those boun- daries at which time Commissioners are elected who are supervised by the County. The Harbor District also has the power to tax to create funds with which to operate. Mr. Stevens further stated that the State Small Craft Harbor Commission can deal with either Cities, Counties or Districts. Question - Car. Allen: If a 25 mile radius district were created, would an Improvement District be better? Answer - Mr. Stevens; A Harbor District would still be best as evidenced by Newport and Balboa Question - Mr. Glissnam What advantage is there to a large district over a small district. Answer - Mr. Stevens: It is necessary to ceolde the amount of funds necessary to do what is desired and keep things as simple as possible. Keep the District as small as possible to accomplish the designated purpose. Sometimes, however, it is necessary to reach out further. Question « Mr. Glissnan: What size district did Fir. Stevens recommend for the development of the Agua nedionda Lagoon? Answer - Mr. Stevens: Could only estimate: there were certain costs involved, around §600,000 to 0700,000, and it was necessary to determine where enough people could be gathered to provide these funds. Mro Stevens stated it was necessary to Include people and oitles which would give solid backing and to include at lease one large community or city. Question - Own, Sonneman:Would a City Commission be eligible for engineering funds before a Harbor District formed? Answer - Mr, Stevens:Application could be made prior to forming a District and that the obligations could be transferred to the Harbor District after its formation if so desired. He further stated that a Harbor District Is more appealing to the Arny Engineers, the State and the Federal Government as it has only one job to do and can function more adequately. Question - Chairman Weeks:Mr. Stevens had mentioned the figure of 0700,000 while the preliminary report callsfor 011,000,000. Answer - Mre Stevens: 0700,000 was merely Intended to be applied to the operation with an entrance to the ocean.Full development tjould have to come in stages and that he xias thinking only of getting into the preliminary stages. Question - Cmr. Osburn: Answer - Mr, Stevens: Question - Cmr 9 Allen: Answer - Mr, Stevens Question - Cmr, Allen: Is the last opportunity to apply for a loan at the Blythe Meeting on December 9th? Yes, in order to be ready for the Legislature in January,, What are the differences between a Municipal Revenue and a General Obligation Bond? An obligation bond looks to general agencies backed up by general credit and revenue bond specifically states repayment of bond only out of certain projects, while State funds are loan- ed out with a three-way build up. Which is recommended - General Obligation or revenue bond? Answer - Mr. Stevens" Revenue bond if you can do it. Question - Cmr9 Allen: Answer - Mr. Stevens: Question - Mr, Click; Answer - Hr. Stevens: Hot-; much land is necessary to be owned by a district in order to provide repayment of a loan? It Is necessary to control enough area to repay the loan in 20 years, tfduM the State advance money or is it necessary to sell bonds in advance on the open market? Funds oan be borrowed from the State and then float a 010,000,000 bond issue to repay. Question- Mr. Click:What is the Improtaaoe of the ratings and priorities and how does the State determine what priority and rating apply. Answer-Mr. Stevens: They are determined by (1) the need, (2) the Question-Mr, Click: eoonomio feasibility of repayment, and (3) if the project is qualified for funds* Mill there still "be funds available for loan with in the next year? Answer- Mr, Stevens: Yes there would be« Question- General: Answer- Mr, Stevens: QuestIon-Mr. Ewald: "What is required from the City before it is eligible for State Funds?" Before receipt of funds, the State has to be assured that the City has done all it can possibly do in order to support this project. He further stated that planning loans ban be applied for any time. No obligation is assumed by the City for the construction loan until a note is signed and further that the engineering staff would come In to help* Would passing a bond issue be sufficient to show participation and qualify for State funds? Answer-Mr. Stevens: It very well could be. Question-Mr. Click: What is planning money? Answer-Mr* Stevens: Question- An swer-Mr, Stevens: It is money used to determine an estimated cost and the feasibility of the project* It Is not a speculation. Would the Patterson Report constitute necessary qualifications to obtain planning loans? It shows that the City has community interest and has put a certain amount of funds into the project but doubted that it would be sufficient to say that it is all the City needs. He further stated that it is not a necessity to take planning funds but the State has to know that the City has an accurate estimate. Quest!on-Crar. Allen: IIow much of a planning loan would it take to have this accomplished* Answer-Mr, Stevens: Hot more than j!0,000 to hire a private engineer. The State engineers only act In the capacity of consultants* Questlon-Omr. Zahler;Would the existing dredging constitute any local qualification? Answer-Mr. Stevens: Yes, other than that done by the San Diego Qas and Electric Co. Question-Cmr. Allen Answer-Mr. Stevens: Question-Mr. Click: Answer-Mr, Stevens: At what floint does the Army Engineers enter into the program? The Army Engineers works only on the outside ap- proach* After all have agreed how much everyone is going to put in, then is the time to go to the Federal Government Next year would be the timeto go to the Federal Government for survey and they will recommend asking Congress for funds. The entire proceedure usually takes about five years to obtain Government funds, however, it is possible to get survey funds earlier. What is the merit of the Patterson Report? At the time it was done, it was very effective, but although it is not exactly outdated and may still fit the situation, if it did not, it would have to reappraised. The engineering detail comes later. Question-Own. Sonneman:Would an apprlasal of the surrounding property at this time be of assistance to the City in obtaining a construction loan? Answer-Mr. Stevens: Yes it would and the City might also find out what the attitude is of the property owners totrards selling or contributing land to the project. QuestlonaCmr. Osburn: Answer-Mr. Stevens: Questlon-Hr. Click: Would the opening to the sea be maintained by the Government as to the dredging, etc.? It is hoped that it would. If Ooeanside gets its limited type of harbor,would it affect the harbor d evelopment in Carlsbad? Answer-Mr. Stevens: It should only aid the Carlsbad Harbor Development. Question-Mr, Tad Pahl: Answer-Mr. Stevens: Cjjestion-Cmr. Allen; Answer-Mr. Stevens: How long would it take to have a preliminaryfund loan passed after applying? About 3 months. Would there be any objection to Including Ooean- side in a Harbor District? It would be a good idea if they were willing to goalong. Hot?ever, only Interested communities should be included and the others may defeat the project. guestlon«-i-lrs. Gllssmon:If the Army Engineers have money for preliminary surveys8 and are putting that entire fund into the Oceanalde area, could any of this be applied to the Carlsbad area? Answer-Mro Stevens: There Is no harm in asking and he recommends thatCarlsbad ask for a survey as soon as possible. He also stated that the State could help obtain this surveyo Question-Mrs. Gllssman: Are the funds now only allocated to Ooeanslde? Answer-Mr. Stevens: Question-Mr, iiwald: Answer-Mr. Stevens: The fund is flexible and can be moved from one survey area to another. It Is In order to request a survey at any time* A survey had been requested two years ago and that the two projects have always been tied together. It was set up that way for convenience but oan be separated from Ooeanslde or can be done Jointly* He again said that the State oan easily start a request for same which is very much in order0 Mr. Stevens informed the City that the necessary steps to form a HarborDistrict were: (1) Establish boundaries, (2) Petition obtaining a 50$ voters acceptance anci (3) Petition the Board of Supervisors to hold an election and to elect commissioners* Mr. Stevens further stated that the State desired a Resolution from the City requesting construction funds and if a survey or planning loan was required, that a resolution requesting survey funds be sent to the State Small Craft Harbor Commission. The request of a construction loan should be applied for by sending the Resolution to him prior to the meeting at Blythe on December 9, 195Stf Chairman Weeks established a special Harbor Commission meeting for December 1, 1958 at ?':30 P.M.
