Arts Commission
December 6, 2001 • 4:00 p.m. • Carlsbad Council Chambers
The meeting was called to order at 4:00 p.m.
Present: Commissioners Held, Shaw, Lignante, Willis, Pynes, Hill
Commissioner Rutledge arrived at 4:20 p.m.
Approval of Minutes:
On motion by Commissioner Hill, The Minutes of November 26, 2001 were tabled to
the January 3, 2002 meeting.
Old Business
America Sculpture Donation by Artist Paul Weber
Chair Pynes announced that the FORMER Split Pavilion area was approximately 90' x
100'. She further stated she checked with the City's Traffic Engineer on the number of
cars that drove Carlsbad Village Drive in front of the Cole Library and City Hall. She
also reviewed the policy on accepting gifts and donations. She stated the policy does
not distinguish between temporary and permanent artwork.
Connie Beardsley clarified temporary/permanent artwork. She stated the Arts Office
works with the artist to find an appropriate site for the temporary piece. The City
does require the artist to sign a contract that states the City can remove or move the
piece on display at anytime with a sevenday notice.
Mrs. Beardsley stated that display boards of the proposed donated artwork were put
on display at both libraries and at the beach area. A number of comments were
received. (See tally sheet.) She explained that the comment forms were only an
indication of people's initial response to the piece and location. She also reminded the
Commission about permit requirements. Commissioner Willis asked if the piece were
to be located at Maxton Brown Park, would the same permits be required. Mrs.
Beardsley replied yes. Mrs. Beardsley then read the tabled motion of Commissioner
Lignante from the November 26, 2001 meeting to the Commission.
Chair Pynes asked for public comment:
Michael Diamond: Is a retired Carlsbad resident who spends his time at the beach.
He objects to the piece as a work of art. Feels it is a patriotic-type of sign and the site
is inappropriate. Prefers the site as it is now. Urges the Arts Commission to
reconsider putting the piece in the former Split Pavilion area.
Debbie Fountain, Manager of the City's Housing and Redevelopment Department,
explained that this item would go before the Design Review Board and then to the
City Council for Public Hearing. It is appeal-able to the Coastal Commission because
if the piece is placed in the coastal zone it falls under its jurisdiction.
Commissioner Hill asked Mr. Diamond if he would object to the piece being placed
elsewhere in the City. Mrs. Diamond replied that it would depend on the site and if it
blocked a view.
Commissioner Held asked Ms. Fountain how long the process would take before the
piece could be placed in the coastal zone. Ms. Fountain replied it could take between
60-90 days. Commissioner Hill stated that the other sites the Commission was
considering were at City Hall and the Cole Library. Ms. Fountain stated if the other
two sites were outside of the Redevelopment area and coastal zone it would not take
as long.
Commissioner Lignante wanted to know if permits would still be required if the piece
was placed on display for 10 months or less than a year. Ms. Fountain replied that the
determination on the process could be left for City Council to decide.
Barbara Diamond: Asked the Commission if other artists were allowed to offer
donations of art and what the process was. She stated she would rather see
something more open to interpretation instead of a sign. She further explained the
word would be backwards to people walking on the street and graffiti could pose a
problem. She would like to see community groups such as the Carlsbad Garden Club
have input into what is placed in this area.
Mrs. Beardsley responded that the America artwork was a specific donation and the
Arts Commission has a policy with criteria on how to accept gifts and donations of
artwork. Commissioner Rutledge explained how the donation was referred to the Arts
Commission for consideration.
Rick Smock: Operates two motels in Carlsbad. He feels the City has done an
exceptional job to the former Split Pavilion area. He likes the sculpture but is not sure
the location is the right place. It will be a "great read" in one direction but backwards
to people walking. Feels it would be better in another site, perhaps in front of a wall.
Barbara Howard-Jones: Feels the landscape is not conducive to this sculpture and
another site should be chosen. She feels it will not be appreciated as a patriotic
statement.
Chair Pynes asked Commissioners for their comments:
Commissioner Held stated she felt other ideas and alternatives should be discussed.
The placement of this piece at the former Split Pavilion area does not seem to be a
good idea given the public comment.
Commissioner Shaw stated she felt the Arts Office and Commission should work on
the donation policy. She cannot support the placement of the piece at the former
Split Pavilion site given the comments. People use the space for other reasons.
Commissioner Rutledge stated he addressed the evening Carlsbad Rotary Club
soliciting comments regarding the placement of this piece. He received a high
percentage of feedback ranging from concerns about temporary placement versus
permanent placement, blocking of the view, to open space issues. He also stated he
brought the issue before his homeowners association and received similar feedback.
Mr. Rutledge replied that given the public sentiment about the former Split Pavilion
area, he feels it is not the correct site and cannot support the placement of America
there.
Commissioner Hill thanked the Carlsbad residents for coming forward on this issue
and stated based on public comment the Arts Commission may have to explore other
options.
Commissioner Willis stated placing the sculpture at the former Split Pavilion area
would be an opportunity to break down the stigma of "nothing can be put there." He
felt it is the time to move forward. He also talked to people who did not particularly
like the sculpture but would like to see something in this location. He felt the sign
would not obstruct the view anymore than a vehicle that has surfboards stacked on
top of it.
Commissioner Lignante withdrew his motion made November 26, 2001, "the Arts
Commission recommends the City place the artwork America at the former Split
Pavilion area for a period of one year."
Commissioner Willis withdrew his second of this motion.
Commissioner Held suggested that a recommendation be made to give the piece to
the firefighters of Carlsbad and let them decide where to place the piece.
Chair Pynes suggested the Commission revisit accepting the piece.
Discussion ensued among the Commissioner on the donation policy and how involved
the artist should be on the deciding the location of the placement of the artwork.
Commissioner Lignante stated the Arts Commission should re-look at one of the three
remaining sites already discussed with the artist.
Commissioner Rutledge asked if Arts Commission could look at previous sites
discussed. Mrs. Beardsley replied that it would be a good idea for the Arts
Commission to look at the previous sites.
Commissioner Rutledge suggested an ad-hoc committee be created to determine
acquisitions and donations.
Commissioner Lignante again stated he wanted the Arts Commission to discuss the
three remaining accepted sites.
Commissioner Hill stated the Commission owed it to the community to consider all
possible locations.
Commissioner Willis stated the Commission had been through this before. A process
of elimination had been completed to come up with the four sites accepted by the
artist. He did not feel the Arts Commission should discuss this again.
Connie Beardsley asked how many members should be appointed to the committee.
Commissioner Rutledge moved the Commission create an ad-hoc committee of 5
Carlsbad citizens that included two Arts Commissioners with the remaining makeup
selected by staff for the purpose of the selection of a location to place this artwork.

Commissioner Shaw stated she wanted the Arts Commission to not keep considering
this artwork if no suitable location is found.
Chair Pynes stated she was uncomfortable about accepting the piece without a site.
Discussion ensued by the Commission on whether the piece was accepted at its last
meeting. It was determined by the minutes the Commission did accept the artwork for
a period of one year.
2002 Community Grants
Commissioner Lignante left the meeting at 5:21.
Commissioner Rutledge gave the presentation of the 2002 Community Grants Panel
recommendations to the Commission. He further stated the City had sent six
proposals to the Arts Grant panel to review that were part of the City's overall
community grant applications that were not applicable to that program. However,
they were not matching grants and the amounts requested far exceeded the amount
the Arts Office has allocated to award.
Discussion ensued by the Commission on limiting terms of granting to arts
organizations.
On motion by Commissioner Hill, the Arts Commission approved the
recommendations of the 2002 Community Arts Grants panel. Seconded by
Commissioner Willis.

2002 Sculpture Garden Exhibit
Mrs. Beardsley reported that the 2002 exhibit will be a retrospective of the late San
Diego artist Italo Scanga. It will be installed in January with a reception planned for
February.

Manager's Report
Mrs. Beardsley announced the Cultural Plan was on the December II, 2001 City
Council agenda for approval. There are several public art projects coming before the
Commission in the coming year.

Public Comment
35 were positive for the placement of AMERICA at the former Split Pavilion site
147 were opposed to placing AMERICA at the former Split Pavilion site.
Those figures represent 24% in favor, 76% opposed.
Several members asked how many were unsigned. There were 8 in favor and 54 opposed
that were unsigned. If the Commission chose to discount those, it would bring the total to
27 in favor and 93 opposed, or 29% in favor and 71% opposed.
Required Permits
If the Arts Commission approves the site by the beach, it will require a redevelopment
and coastal commission permit. The next step in the process would take the request to
the Design Review Board.
2002 CARLSBAD COMMUNITY GRANTS - COMMUNITY ORGANIZATIONS
The proposals were individually reviewed and numerically ranked by adding all panelists'
scores. Panel consensus was to fund the top three at 100% and to determine allocation of
funds to the remaining grantees taking into account rank, request amount/actual $$ need to
carry out project, and available grant funds remaining.
1) CARLSBAD PLAYHOUSE- Operating Support for 2001 Season
6 regular season play readings, plus 1 for children by local playwright & 1 with New
Village Theatre in the summer. Only North Coast organization regularly presenting new
works by local writers. All artists receive stipends.

2) NORTH COAST REPERTORY THEATRE / EL CAMINO CREEK SCHOOL -
theater residency at new elementary school: NCRT Education Outreach Program will bring

students to see a NCRT production in a 5-week program.

Carlsbad Cultural Arts Center. Includes Carlsbad Youth Theatre programs and workshops
for children and adults. Directors, designers, musicians paid.

7) MUSEUM OF MAKING MUSIC - Support for concert/exhibition/lectures program.
A traveling exhibit on the unifying power of American Song will be curated by the

and lecture will be provided free to Carlsbad senior centers, schools & libraries.

8) CARLSBAD STRINGS EDUCATION ASSOCIATION - Support for Mariachi Group

Teachers will receive a one-day training workshop in a 6-week after-school program for
students will be conductd by an instructor in the Monart technique for all grade levels.

ADDITIONAL PROPOSALS PASSED TO COMMUNITY ARTS FROM THE
CARLSBAD COMMUNITY ACTIVITIES PANEL:
These are grant requests to the City's annual social programs and special events fund.
They do not require matching funds, so most requests are for the full amount of the
proposal. The Community Activities fund contained $65,000 to distribute, which has been
awarded (pending City Council approval). Following discussion, the panel decided not to
award funding to any of these proposals; none supply matching funds, none address
demonstrated needs, several request unreasonable funding amounts.
1) GLENDA BONIN, STORY TELLER - support for "I'm Telling!" a 4-week summer
artist residency storytelling program at 4 Carlsbad parks & recreation sites, 20 hours per
site (4 hours per day). REQUEST: $5,000
2) SEAGATE CONCERTS - Support for 9-concert Carlsbad series, including indoor &
outdoor, educational, seasonal, and multi-disciplinary performances. REQUEST: $65,000
3) KELLIE FANKHOUSER - Support for year-long after-school photography program for

4) GUITAR CZAR PRODUCTIONS - Support for 56 performances in 14 Carlsbad senior
residence centers featuring popular American music of the 20th century arranged in
thematic programs. REQUEST: $5,600
5) NICOLE HENDRICKS - support for "Spirit of Carlsbad" festival of uplifiting music
and speeches for high school students. REQUEST: $7,500
6) DANA BURNETT - Support for "Chamber Music Carlsbad" four-day festival of
classical music, with concerts and workshops.

AMERICA
Background
The artist, Paul Weber is interested in donating the artwork AMERICA to the City of
Carlsbad. You will recall that the Arts Commission considered this piece last year and
turned it down unanimously. The primary reason was the Commission could not come
up with a satisfactory location.
Criteria used for recommending an artwork for the City are:
1. Quality of the art
2. Context for the City; historical, social, geographical etc.
3. Suitable location
4. Maintenance and safety issues
Arts Commissioner Bill Lignante asked City Council directly to consider accepting
AMERICA and placing it at the Split Pavilion site. City Council in turn returned the
request to the Arts Commission for a recommendation, with the added information that
they would consider the Split Pavilion site if that was recommended by the Arts
Commission.
Issue Statement
There are several issues that the Arts Commission should look at when considering the
acceptance of AMERICA.
1. Permanent vs. Temporary
If the artwork is temporary it may be placed in a recommended location for a period
of time (3 months to 1 year). Because it is temporary it does not need to go on
display for public comment prior to final recommendation by the Arts Commission
and then City Council. This would enable the piece to be installed more quickly,
addressing Commissioner Lignante's concern that the City needs to show its patriotic
support now. If the Split Pavilion site is recommended it may make it more palatable
to place it there for a shorter period of time. The issue of blocking the view, raised
previously by citizens, should also be considered at the Split Pavilion site.
If the artwork is permanent it must go on display for public comment prior to
recommending acceptance. The artist is required to sign a waiver that states that the
City owns the artwork, the artist waives his or her rights, and the City may move,
remove permanently or destroy the art if necessary. The artist has agreed to sign the
waiver. If the art is installed permanently it will be bolted to a concrete stand (more
like a wall - 3 Vi feet high and 1-3 feet deep, and 30 feet long) that is how the artist
envisions it. A temporary installation would be done with wood, building a similar
structure.
2. Location
Four possible sites are proposed for the Arts Commission to consider. These have
been agreed upon by the artist as suitable to display the artwork.
1. Split Pavilion
2. Maxton Brown Park (comer of State and Laguna Streets)
3. In front of City Hall (some shrubs may have to be cut back)
4. The grass strip between the Cole Library parking lot and Carlsbad Village Drive
Staff is in the process of getting estimates for both temporary and permanent installations.
