Present besides the Mayor were Councilmen Robinson, Helton, ~aird and Ledgerwood; City Manager Nelson, City Engineer Kubota, City Attorney Smith, Police Chief Pal kowski. WRITTEN CORRESPONDENCE : (1) Letter from San Diego County Office of Civil Defense giving figures anti i"nf ormation ori next year1 s Civil Defense budget (national ) and ask- ing that the Council support the budget request by writing Congressmen abd Senators. City Manager Nelson reminded members that it has been Council policy to refrain from recommending legislation not directly af- fecting the City, After some discussion, the letter was filed without action. (2) Letter from the California ~i~hwa~ om mission dated February 6, 1957, announcing hearing on the proposed new routing of' Freeway 101 south ?ram Carlsbad, on April 5th at 10:30 A. Me, and inviting Council and City personnel to attend. It was decided that thk City Manager and City Engineer should attend; also the City Attorney if his presence is deemed necessary, (3) ~ettcr from the SahrDEogo ,Gas & Electri~ Compafiyj .signhd by. Charles H.-Fprward, to the City Attorney, asking his ideas on the framing of a lease which would stay within the bestrictions of the Public Utilities Code, The letter also referred to newspaper articles which the Company felt carried a' misleading ' interpretation' of their stand in the matter. City Attorney Smith commented that he construed the leCter as meaning the lease should be approved by the Public Utilities Commission. After some discussion, it was decided that a meeting should be set up as soon as possible between top officials of the Gas Company and Mr. Nelson, City Attorney Smith, and possibly some Councilman, to discussa the matter fur- ther. (4) Petition signed by nine property owners of the east side of El Ar- bol Drive in ~erramar #s, asking "appropriate reliefu in the form of a permanent retaining wall along the shore of the irrigation reservoir to abate serious erosion of their property due to storm drainage. The city ' Attorney stated he felt it unwise for the City to enter into a matter of this nature, which would involve expenditure of public funds on pri- vate property, which is highly improper, It was also pointed out that the Subdivision Ordinance has no requirement as to compacting soil, etc., so no violation exists in that direction. It was suggested that the matter be approached through letters from property-owners to the Real Estate Commission, Cmn, Baird moved that the City Attorney, City En- gineer and City Manager co-operate in the drafting of letters to be sent to the Sacramento office of the Real Estate Commission, with copy for the San Diego office, after an inspection is made by the City En- gineer: Seconded by Cmn. Robinson. All ayes, no nays, motion carried, Cmn. Ledgerwood moved that the Planning Commission be apprised of the situation with the suggestion that they take action to prevent similar occurrences. Seconded by Cmn. ~aird, All ayes, motion carried. PARK & MONROE DRAINAGE. I*. and Mrs. Parsons of El Cajon ware present to protest against recent measures taken by the City to divert storm - water from Park 6 Monroe back to its natural channel, The Parsons gave a long, detailed history of the drainage situation in the area, dating back to County jurisdiction before incorporation of the City, and dis- puted the accuracy of the City survey which they claim resulted in lo- cating the drain ditch on their land, Mr, and Mrs. Bruce Jones, owners of property also directly affected, were present and expressed dissatis- faction with the diversion program and general agreement with the Par- sons, stating they are: convinced they have recourse at law. The Mayor emphasized, dur ing the ensuing lengthy discussion involving bitter criticism by the Parsons of earlier efforts, that the City's efforts are directed toward protection of the property owners, rathsr than to damage them, and that the Council will do everything possible to solve the problem, The property-owners present were asked whether they wished to recommend an outside engineer to make a further study of the area and, if so, if they would agree to accept his findings. Cmn. Ledgerwood stated he has a 1939 Soil Conservation Service map which he would make available to the engineer. After further discussion, it was agreed to have a re-survey made by the City Engineer. Cmn. Ledgerwood moved that Mr. Kubota be instructed to make a new survey of the entire problem and report back to the Council. Seconded by Cmn. Baird. All ayss, motion carried. PROPOSED SEWER EXTENSIONS. A petition signed by four property owners on the north side of Tamarack in the's00 block for extension of the public sewer to that area, was read. Mr. Nelson explained that the entire cost will be borne by the signing property owners and the money paid in before March 1st to obtain the $3.00 line cost; and a reimbursement contract en- tered into. After discussion, Cmn. Helton moved adoption of Resolution #247 authorizing the City Manager to begin proceedings on the Tamarack sewer extension. Seconded by Cmn. Robinson, Five ayes, no nays, Resolu- tion adopted. ORNAMENTAL STREET LIGHTS, The City Manager read a petition for ornamental street lights for the business district, bearing 56 signatures. The City Attorney outlined methods which might be used, and it was decided to re- circulate petitions to test the sentiment for 1911 Act proceedings, which petitions would bear the names of property-owners to be directly benefitted only. Glenn Feist, president of the Chamber of Commerce, assured the Council of the Chamber's full support and stated a committee, including Mr. Eddie Kentner who was present, would work out boundaries, circulate petitions, and work with Councilmen and City officials on the matter. Speaking of the street lighting already ordered, to be rented from the Gas Company, Mr. Nelson stated that installation has not begun but inasmuch as there will be some delay before the proposed ornamental lighting can be accomplished, and the rental cost is not high, he recommended that the .City proceed with the rental program. By common consent, tho City Manager 63 and City Engineer were instructed to work with the Citizen's committee on t--r the ornamental lighting project and bring in a report to the next Council 11'3 meeting. 9lr; 3 After a 15-minute recess, the Council was reconvened at 9:30 P. M. PARK 6 RECREATION COMMISSION. The City Manager read a request from the Commission"for $200.00 additional funds (not budgeted) to erect a base- ball backstop at the Jefferson Street School. During discussion, the City Attorney stated it would not be good practice to expend public funds on school property, but it was pointed out that if a responsible group wkshed to sponsor and take responsibility for care and maintenance of the equip- n?ent, the matter might be handled in that way. The City Manager was asked to convey the discushion to the Park 6 Recreation Commissian and advise them to re-submit the proposal on the basis discussed, for Council consid- erat3on. PROPOSED ANNEXATION. City Manager Nelson outlined progress of the pro- posed annexation of lands south of the City, presenting maps showing boun- daries and giving assessed valuation figures, etc. He stated that if the Council approves the boundaries, a title company or engineer would be asked to prepare the legal description for submission to the County Boun- dary Commission, after which the Council may pass a resolution of inten- tion to annex and set a hearing. During discussion it was decided to ex- tend the proposed boundaries to the east side of El Camino Real to facili- tate future annexations in that direction by providing contiguity. Cmn. Baird moved that the kity Manager and City Attorney be instructed to begin proceedings on the proposed annexation; and that El Camino Real be includ- ed from Vista Way to the northern boundary of the proposed Palomar Airport site. Seconded by Cmn, Helton. Four ayes, no nays, Cmn. Robinson ab- staining. MEW BUSINESS. Letter from Ocean Manor Apartments, dated February 15, 1957, was read, requesting permission to erect a sign containing 20 square feet on City property on the site of the sewage disposal plant. It was re- called that the City's agreement of purchase with Mr. Felt allowed him to ' have a sign on the property. After some discussion, Cmn. Robinson moved that the request from Ocean-Manor Apartments For erection of a sign be re- I ferred to the Planning Commission for their proper action. Seconded by Cmn. Ledgerwood. A11 ayes, motion carried. A petition was read requesting sewer extension south on Highland from Elm- wood approximately 260 feet. City Engineer -Kubota stated that another petition for extension north on Highland from Buena Vista was to have reached tihe Council, which could be tied in with this request, but that same had not been received. After discussion, Cmn, Robinson moved adop- tion of Resolution #248 authorizing the engineering on sewer extensions north and 'south on Highland Drive from the existing main. Seconded by Cmn. Ledgerwood. Four ayes, no nays, Cmn. Helton abstaining, Resolution adopted. A'petition was read requesting sewer extension west on Tamarack to Gar- field, and discussed briefly, Cmn. Ledgerwood moved adoption of Resolu- tion a249 authorizing engineering on proposed sewer extension along Tamarack west to Garfieldl. Seconded by Cmn. Helton. Four ayes, no nays, Cmn. Robinson abstaining, Resolution adopted. City Manager Nelson stated he has received several complaints re: smoke nuisance from th~e Personal Service Laundry on Elm Avenue, After discus- sion, Mr. Nelson was asked to talk the matter over with the proprietor and attempt to settle it by agreement. Mr. Robinson, residing on El Arb01 Drive in Terramar, requested that an arc light be installed at the south end of El Arbol. Mr. Nelson ex- plained that the City has no immediate plans for installing lights on residential streets but that gradually and eventually all street corners in the city would have at least minimum lighting. Mr. Robinson also asked whether anything could be done for the safety of youngsters in the area of the irrigation pond in Terramar, enclosed by a four-strand barbed wire fence, which he felt was dangerous to any child falling against it in play, and not adequate to prevent small children from getting through into the water, which is 8 to 15 feet deep. The City Attorney pointed out that the fence, on private property, is not in violation of any city ordinance and he did not believe it could be legally declared a public nuisance. The suggestion was made that the property owners petition Mr. Cannon to properly fence the pond, or to contact his insurance car- rier re: the matter, There was a brief discussion re: measures to control noise of unmuffled motor-boats on the lagoon, and Cmn. Baird moved that the City Attorney be instructed to prepare an ordinance requiring mufflers on motor boats. Seconded by Cmn. Helton. All ayes, motion carried. Cmn. ~aird 'moved authorization of payment of bills from February 5th to 19th, in the amount of $9,735.13, as certified by the City Manager and approved by the Auditing Committee. Seconded by Cmn. Robinson. All ayes, motion carried, Can. Baird moved ratification of the payroll for the first half of Febru- a-ry, amounting to $6,592,68, as certified by the Director of Finance and approved by the Auditing Committee, Seconded by Cmn. Robinson. All ayes, motion carried. Cmn. Helton move<d approval of the minutes of February 5th as written. Seconded by Cmn, Baird. All ayes, motion carried. Cmn. Helton rnovetd, Cmn. By common consent, responsibility for the requested report was laced upon the City Manager, City Engineer, Public Works Director and Planning Commission.
