Letter dated September 13, 1960 from John I i Allan McKaig, Chairman of the Parks and Recreation : I Commission, regarding the Palm trees recent1.y planted i i at the City Hall and Holiday Park, he felt that any thanks I i or expression of appreciation the Council might feel due, ; i should be directed toward Bob Hardin, Forest Kruger, i : Ed McCann, Jack Kubota and Bob Watson, who planted : i these trees. Also Ted Westree whose technical assistancfe : was invaluable. Also the loan of a low bed truck by i Don Hubbard of Encinitas. It was further pointed out that; : approximately $3,100.00 worth of trees were donated to : I the Tri-City Hospital, Carlsbad High School, Holiday i I Park and the City Hall. By unanimous consent of the : : Council the City Manager was instructed to write a I i letter directed to all the persons who participated in this i ; project, stating the Council's appreciation and thanks I i for the fine work done.

BETZMER, 3870 Highland Dr., Carlsbad, read i \ a statement (which is on file in the office of the City Clerk) ; setting forth four major factors against the formation of : i a harbor district advocated by the proponents of the i Carlana Harbor District, which in essence are as followd: ; (I) The taxpayers of Carlsbad will underwrite the major i i portion of the cost of development of the Elijo Lagoon :
; and the Bataquitos Lagoon, without any assurance of I i reciprocal support to develop the Agua Hedionda Lagoon; ; : (2) The San Diego Gas & Electric Co. has made no I I commiOment to make available to the City the major : portion of the lagoon for development; (3) Mr. Betzmer i i advocated a harbor district to be formed having boundaries ; corresponding to the City of Carlsbad, to be controlled i i by the City without outside influence; and (4) Mr. "Gup" : : Allen and Mr. Max Ewald, both candidates for office as i i Directors of the Harbor District are motivated by ; interests which are detrimental to the taxpayers of i Carlsbad. In closing, Mr. Betzmer urged the Council : : to renounce their support of this scheme to have the I i taxpayers enrich a few individuals whose creed will i stop at nothing in order to accomplish their objectives. i

Bierce pointed out that according to the minutes i : of the previous Council when this matter was discussed, i i they indicated the plumbing was in place at the time the : : line on Garfield was constructed; also the Council at I I I that time went along with the idea that at such time as I : the Chinquapin sewers were installed the Lulls could tie : i into that line. MiE, LULL informed the Council that at the time the i assessment was spread on the Garfield sewers, the I I Engineer of Work guaranteed them they could hook on to i this line. Later when he came out to check the property, : he informed them they could not use the line without a i pump. Anderson and Robinson checked the property and : they informed them they could not connect without exces- i sive cost to them. He appeared before the previous I I Council for relief, and he was informed they could not do I anything about the matter as there property was in 8 I I 1911 Act District, but at such time as the chinquapin i sewers were installed they could connect to that line. I I They have connected two lots to the Garfield sewers, but i have paid their assessment on four lots. I I 4 ! i Mr. Thornton, Assistant City Engineer, stated he did : not know what the Engineer's intention was; in many i instances you may find one lot in a district that will call : for an 18' depth cut; however, the normal procedure is i to treat the district as a whole. Mr. Thornton also ; pointed out there were 16 other corner lots in this same I vicinity that may have the same problem, in fact there i are probably other properties in the city with the same i problem.

: After considerable'discussion it was agreed that this i matter be deferred in order that a field check could be i : made of the Lull's property as well as the other corner ; i lots in the vicinity. I I

! A report was made on the condition of Gary Gordon, who i i was injured by a tractor. He has two fractures of the i i pelvis and one fracture of the tail bone; also he is being i : treated for a blood clot. He is coming along satisfactory,: i but is in considerable pain. When he visited him today i : he stated he wished to thank everyone for thinking of him. I : Mayor Sonneman asked that a letter be sent to Gary I I : Gordon from the Council.
I The Council was informed that Gary Gordon was the prim4 i mover for the Water Department in the Chestnut Avenue : : project, The City Manager requested authorization to i i hire Mr. Keys, who has had experience in this type of : : work to fill this position on a temporary basis, as Gary i i will be out at least eight weeks. By common consent of : ; the Council the City Manager was authorized to employ i i Mr. Keys on a temporary basis to fill the position of I i i Gary Gordon.
i A memorandum dated September 20, 1960 from the : Director of Finance to the City Manager, pointing out a t i recent amendment to the Government Code which permits I : the payment of budgeted demands prior to approval of the i i Council, Section. 37208 was set forth.
