MINUTES 3uly 1, 1987 DESIGN REVIEW BOARD PAGE 2 MEMBERS ' In answer to query regarding the policing of this amendment, Chris Salomone responded staff would notify anyone in violation, have a hearing and a court appearance, and take action. Assistant City Attorney Ron Ball concurred with Mr. Salomone's explanation. There was discussion whether this was City-wide or just Redevelopment Area, with staff indicating this Board has no jurisdiction other than in the Redevelopment Area. The suggestion was made this was a precedent-setting situation and it might be well for the Planning Commission to suggest this be City-wide. Another point to be covered was the amount of right-of- way the people could use. be proper to have over 5o[x of the right-of-way encumbered- -and in no case less than a five-foot width on the right- of-way left clear. It was suggested it would not Staff clarified they were referring to food service only. They were not including drinks or finger food. Other facilities, such as walk-up windows and places for strolling musicians should be checked into, but not included at this time. Board Member McCoy stated his concern about parking lots, particularly where parking spaces have been eliminated to build patios, and whether that type of thinq could be controlled. The Board discussed present parking and the consensus was that restaurants should not eliminate any of their parking spaces in order to provide outside dining. Chris Salomone stated the downtown merchants favor the outdoor eating areas. Design Review Board directed staff to bring back an appropriate amendment to the Design Manual to set up guidelines for outdoor eating areas where there is food Service. DEPARTMENTAL: 1. RP 86-138 - BULLY'S Request for a minor permit to allow the construction of a 254-square foot wood deck at 2858 Carlsbad Boulevard. Chris Salomone gave the staff presentation on this item as contained in the staff report, using wall charts to show the site and the proposed deck. Mr. Salomone explained 259 square feet had been removed by the demolition of the storage shed. With the addition of the 254 square feet of wood decking, the applicant would still be five feet short of the original footage. They did that, and now have a total of 34 spaces onsite. Staff feels the deck would be an amenity to the restaurant and should be approved, with an added condition to prohibit meal service there. Since the applicant striped 34 parking spaces, this is now more than the requirement for the square footage of the restaurant. Also, when the streetscaping is completed, the area recommended for decking would be completely useless as far as parking. The suggestion was made to state drinks and finger food would be allowed on the deck, but no meals; in other words, no menu service. Board Member McFadden inquired why there was no condition on improvement of Grand Avenue. The parkway is not being maintained, and she felt this should be included, as well as widening the sidewalk and installing new plantings. Also, the lighting in the parking lot should be checked, and a trash enclosure installed in the parking lot. Dave Hauser stated parking space W23 would not meet standards, as there should be five feet before the retaining wall. counted as a parking space, and staff agreed that space should be removed. Board Member McFadden asked why that was Nick Banche, 810 Mission Avenue, Oceanside, representing the applicant, agreed with staff recommendation to include Conditions #I and 82, and eliminate #3 and #4. Mr. Banche stated in reading the Minutes, this Board did not have an illegal use of any kind. This was a legal use and he questioned whether conditions could be imposed with regard to parking on a change of ownership. The new owner tried to create more parking spaces, and now wants to provide a convenience for people waiting to be seated, instead of having to stand on the sidewalk. In answer to Board query regarding whether the owners would agree to join a parking district, Mr. Banche stated he felt certain they would, but he could not commit them without discussing the matter with them. Design Review Board adopted the following Resolution: RESOLUTION NO. 102, APPROVING A MINOR REDEVELOPMENT PERMIT TO ALLOW THE CONSTRUCTION OF A 254 SQUARE FOOT WOOD DECK GENERALLY LOCATED ON THE NORTHWEST CORNER OF CARLSBAD BOULEVARD AND GRAND AVENUE. Additional conditions: Eliminate parking space #23 and make a trash enclosure. If that does not work, use another appropriate spot for trash enclosure. Parking to be to the satisfaction of staff. No meal service included on proposed decking; exterior lighting to be improved and Grand Avenue to be improved. Rombot is Hall Holmes McCoy McFadde n .. . .. , -. SANTA FE DEPOT PROJECT Oral report updating the Board on the status of the Santa Fe Depot Project. Chris Salomone gave the staff report, using a wall chart to show the depot and a transparency to show the site. The project is out for bid at the present time, and will comply with State architectural standards. The roof will be replaced and the building brought up to code. The State has decided the original Santa Fe colors are to be used in painting the depot. This will be burgundy, cream and green. 4. CASA BLANCA/REHABILITATION Chris Salomone stated this was an information item, and a transparency was used to indicate the site. structure is in poor condition and the applicant is proposing to rehabilitate the structure and intensify use. He is asking this Board for direction. The project will not meet parking requirements. The Mr. Salomone asked for the Board's feelings on rehabiliting this structure, rather than redesigning the entire site. He recommended staff work with this applicant and allow him to participate in a parking authority. This would be a mixed-use project, with rental units provided. The consensus of the Design Review Board was to allow this applicant to proceed with plans to rehabilitate the structure at 2685 State Street.
