O'Pkdveny In resgonse to an inquiry from the Secretary, & Nyers General Counsel stated that he had discussed the employment of C 'Kelveny & Nyers with Nr. Beebe relative to employing the firm to determine whether the Dis- trict was legally organized, ad. that they were willing to proceed on the basis of a charge of ,$35.00 an hour, with a maximum of ij5OO,OO, pa-gent to be made when money is available to the District. Also it would be wise to discuss the District's position with Col. Hagen, President of the Board of Directors of the Carlsbad Xutual Water Zornpany, prior to the proposed Oceanside confer- ence. Upon motion by airector Eogers, seconded by Director Evald ana unanimously carried as follows: AYZS: 3ISICT:ORS FRP , ROG3RS KSLLP, ZdHLEB, & E':]XLD f\JOZS: NeI$z ? the Board agreed to arrznge with the Directors of the Zarlsbad Kutual Water Commny for a- meeting to discuss the feasibility and possibility bf using portions of the Carlsbad ktual Vater CompanyPs water distribution system and water storage system for the transmission and storage of Colorado ftiver water to be obtained through the City of Oceanside's facilities in such a manner as would benefit the ilLy or" Oceanside as well as the Bistrict. Resolution General Counsel then presented to the 3oa.rd the No . 4 * proposed fom of Resolution calling for an election ff ' & to be held on Kay 20, 1954, entitled: "R3SOLUTION OF THS BOARD Op DIR~C~~~~S OF THz CAZLSj3LqD J)/mNiCIPAL 1vATz;R DISTRICT7' which was read by the Secretary. General Counsel then called the 3oard's Attention to the fact that one of the N oy terms of annexation required that the District 13-300 execute a copy of a contract heretofore entered into betwen other members of the Authority with the United States of herica, which is generally known as Contract ROY-13-300, Collateral Agreement to supplement Agree- ment No.4 between the United States of -4merica and the San Diego County *+iater Authority. That said contrwt required and a11 water that might be delivered by- the Authority for use in Government installations located within the District. In response to request fron the B,oard, General Counsel stated that it does not require the District to construct additional d-istri bution lines at all. that the United- States Governnent had a -orior right to take any - General Counsel then presented to the Board. a certi- fied copy of Sa.n Diego County Water Authority Resolution No.302: and upon motion by Director Rogers, seconded by Director Zahler and carried unanimously as follows: 4TTjpJ. Printing In response to an inquiry frori the Chairman, Gen- sleetion ballots and polling place cards have already been for era1 !Sounsel reported that sample ballots, official ordered. " Nailing of General Counsel also stated that the Secretary of S amp1 e the District was required by law to commence mail- Ballot s ing sample ballots and precinct cards or polling place notices to the voters more than fifteen days prior to the date set for the election, and to complete such mail-ing prior to ten days before the election, which means that the mailing will have to be completed on the 10th day of Nay. I Index of General Counsel also stated that Index of Voters Voters had been ordered from the Eegistrar of Voters and that in his' opinion, the envelopes in which these are mailed should be printed and contain the return address of the office of the Secretary of 'che 3istrict. Election Director Rogers stated that he thought it was ad- Canpaign visable to arrange an election campaign, and. sug- gested that each airector jot ~GWTI. his ideas, which could be incorpora.ted in a bulletin to be sent out addressed to the voters.
