the Board that a letter had been written to Mr. Eberhard as per ,
the Board's direction in August and reply had not been received.
Director Rogers moved, seconded by Director Robinson and carried *
unanimously:
BE IT DIRECT-ED that the Manager is hereby in- 54-107 strutted to telephone Mr. Eberhard regarding the matter of the sale of water at present stored in
Calavera Lake.
There being no further business to come before the Board,

1954 of the Company in the City of Carlsbad, County of San
Diego and State of California on September 21, 1954 at 1:00 P,M.

Fresident Hagen called the meeting to order at 1:15 F.M.
The Chair asked for the approval of the minutes of Minutes
the regular meeting of August 17th, the special meeting of September
/ 1st and the special meeting of September 14, 1954,

Director Rogers objected to the minutes of the
special xeetlng of September lst, stating that under the subject
"Carisbad Journali1, the last half of the ser?tence should read:

the last sentence should read: "The Directors decided to let the

Director Rogers also moved, seconded by Director
Robinson and carried unanimously:

might be worth a great deal, airector Rogers *' said that he been
attending a short course in Appraisals in Los Angeles and had
talked to ?Garshall & Stevens, Ke believes that an appraisal of
our system at this time would be desirable, Director 3obinson
suggested that we investigate the cost of such an appraisal of

our water system by Marshall 8 Stevens or some other similar
firm, Cirector Rogers said that such an appraisal should be
of material assistance in our financing,
The Manager was instructed to write our attorney, Mr..
Eberhard, and find out who he would recommend-to appraise the
entire system of the Carlsbad Mutual Water Company,
ADirector Robinson moved, seconded by %.rector Anthony and
carried unanimously:

Th-e Manager stated that the balance remaining due Assessments
on Assessment No, 47 is approximately $14,000,
Applications for the transfer and allo'tment of Stock
Transfers stock were presented to the Board and approved as follows:

Engineering Llirector Rogers stated that the.Municipa1 Studies engineers are not going to make any study of
the north line, He thinks the Mutual should wait until the
Boyle Engineering Company comes up with their solution of-the
Carlsbad water problem, and then the h?utual should go on with
their own study from there. He stated that the Xstrict's
plan is to bring the,line from the end of the Rincon barrel
to the Junction of Road 87 as a 3istric-t proposition. The
Mutual and Terramar would take off from that line. He said
that of course Boyle Engineering might come up with some other
idea. He thinks the question is whether or not the Mutual wants
to do any engineering now, or whether they want to wait until
Boyle Engineering have made their decisions, ,I
Director Robinson inquired whether the Water

I Authority is going to form a policy on what they are going to do,
and Director Rogers replied that MR. Heilbron had said that
when we joined, we agreed to bGild our own line. However,
Carlsbad is the only district that is not on a line, The
Engineering Conmittee of the Water Authority will consider the
matter at tlneix rnee,ting on October 14th.
Director Rogers then further discussed the cost of
the proposed line and the $40,000 earmarked by the Water Author-
ity for engineering studies. He stated that he did not believe
there was any chance of getting the Authority to finance the
whole line because if they did finance this one, they would have
to finance others,
The Directors discussed the matter of paying Bottled Water ,for the bottled water being used by Oceanside customers
above the temporary chlorinator. Director Anthony moved, seconded
by Director Robinson and carried unanirnously:r 54-112
BE IT ORDERED that the bill of the Arrow head and Puritas Water Company in t’he sum of $303.79 to August 31, 1954, be paid; and
- BE IT FURTHER ORDERED that these bills for bottled water be paid until the new chlorin- ator is installed.
It was reported that Mr. Neese, head of New Chlorinato~ the Water Department of the City of Oceanside, has said
that the new building for the chlorinator is being built now,
and that it should take just a few days to move the new chlor-
inator in when# the pump arrives.

Letter from the City of Oceanside to the Municipal
Water rec;arding water losses and the meter in present Losses use; *also reply from the Municipal dated September
21st. Director Rogers stated that he Iiad talked to the District's
engineer~,ll'ir. Boyle and Mr, Short, about the water losses, and
they said that if the meter is not set up right, we can get a loss
It is apparent from the opinions of a number of people that the
meter itself is all right if it is hooked up right and in proper
condition. If we could show that it is not correctly hooked up,
possibly we could get some relief, but we cannot prove that the
meter is wrong,
Mr. Trygg presented his further report on the matter
of water losses and stated that Neptune Meter Company had sent
one of their executives to check the matter af the Oceanside meter
The Neptune people suggested checkimg our power bills. The chart
incluided in Mr. Trygg's report shows how much electricity it took
to' pump the water,
Director Robinson asked whether it would be proper
if the two operating heads of the Mutual and Oceansi.de,- that is,
Atre Trygg and Mr, ?kese, should meet and discuss the matter of
the meter and the water losses, and try to get to some conclusion,
Surely they could get along without causing ill feelings between
Carlsbad and Oceanside, or the Municipal and the Mutual.

-. Director Anthony stated that the report indicates
that there is a substantial water lsss in the system.
The Manager said that he definitely has not con-
tacted hFr. Weese since this matter came up, because he reported

it to the Board and they took it up with the Ahunicipal,

seconded by Director Anthony and carried unanimously:
BE IT ORDEFLEa that the Manager is hereby 54-113 authorized and directed to consult with Mr. Neese of the Water ilepartment of the City of Gceanside and try to get %he matter of the q-eter and the water losses settled; and
BE IT FURTHER ORIIERED AND ZtRECTED -that
this discussion be kept on a personal level and a cordial basis.
Director Rogers then stated that the Municipal would do
n-othing about it until they are contacted further.
The Manager presented the laboratory reports of Dr. Laboratory Reports
Carl lqilson. All reports have beer, satisfactory except -
one in the sump which is on the other side of the chlorinator,
so everything is all right.
The Manager read a letter from Attorney Eberhard Calavera
regarding the sale of water of high chloride content

which is at present ir! the Lake, Carroll Kelly came to the office
recently and stated that he wants to buy 30 acre feet of this
water and offered to pay $5.00 per acre foot. Director Rogers

thinks we should getr'$20 per acre foot for it.
i3irector Robinson stated that we should try to sell it, but
it should be sold as is,- that is, as agricultural water only.
Director Rogers again suggested that we should ask Cannon
and the others to pay $20.00 per acre foot.
Director Robinson moved, seconded by Director Rogers and
carried unanimously: -
BE IT ORDE3ED that Attorney Eberhard be 54-114 asked to prepare the resolution he has suggested, authorizing the cleaning of the Calavera Reservoir by sellir,g the water therefrom; and also be asked to send a finished and signed report on the matter.

contract is 5255. per year, If we discontinue the contract, we
may make a new one at any time we wish, but as we are not using
the well at present, we could save on this minimum charge until
such time as we might wish to pump again. Sirector Rogers moved,
seconded by Director Anihony and carried unanimously:

San Luis Rey The Manager then read a letter from Engineer Conservation District Harold Conklinq regarding the San Luis Rey suit Suit with a list of suggested data he wants for the suit.
Director Flobinson noved, seconded by Director Ingels and carried
unanimously:

was necessary, and the hknager replied that Mr. Eberhard is going
to file suit with fictitious names and 9g-t the full information
required through legal sources,
Estimated The Manaqer presented his report on estimated pipe

Engineering Director Robinson said he felt we should wait with

our engineering until we knovv what the Yater Authority is
going to do, Director Rogers thinks we should wait on,thz
Municipalrs..- engineer, as he may come v,p with 20,000 acre feet,
or even 10,OCC o.r.possibly even 35,000. !-le also thinks the -
Board should request the Xanager to give the Municipal engi-
neer every assistance possible and to give him all the
information he needs,

and carried unanimously:
BE IT ORDERED that we postpone our engineering 54-117 study until the next neeting; and BZ IT ORDERED that the Manager is hereby authorized and directed to give the Boyle Engineering as engineer for the Carlsbad Municipal Water District all the information possible in order that they may arrive at proper conclusions for the whole area,
Mr, Trygg stated on the subject of water entitle- Water- Entitlement
ment that the shareholder is getting credit for the amount
of water stock €or the period in which he held it; - in other
VIOrdS, if he only held water stock for half a year, he only got
half a year's cred.it.
The Manager presented a letter from Attorney 2ay c*
Eberhard regarding the manner of handling water entitlement for --
shareholders who own more than me piece Of property to which
water stock is assigned. Zirector Rogers stated he felt it would
be in order to direct that Mr, Eberhard's suggestions be carried
out and Director Robinson asked whether the information should
be passed on to the shareholders. President Hagen said he felt
the matter of water entitlement shnuld be included in the next
newsletter, The Manager suggested that in order to avoid confusion,
we should wait until the 1st of January to gut the new system into

Since my reFort of August ISth, X have checked Qurthor into the matter of water lasscos for the month of July, 1994, Referring to Page 1 of my August 16th report, Xtem 1, Master Water Meter at #1 reservoir, 1 have checked the power consumption for the Booster Statim of this reservoir against the meter readings of water produced in the San Luis Rey to make a further check on the accuracy of such readings, Tabulation of the results is as followst

If we were tu assume that during the month of July there had b@en a normal loss of 40 acre feet of watby: instead of 112 acre feet, md that the difference, or 72 acre fee*, was caused by a mis- reading of our #1 rcoervoir, the chart shows that the, KWH per 1,000 gallons of water pumpad would be 2.21, which is over double that of the everage of .93 KWH per IeOOO gallons. This shows conclusively that the meter at #1 Ressrvoir was not over- registering during the month of July.

the past, our policy has been that the meters are the property

of the water company, and therefore we have charged people for
the meters, In these three cases, it would be a matter-of
deciding what we would charge-them for the part they could use.
Director Rogers stated we should charge them the depreciated
value of whatever they could .use, and that it is up to the
Manager to figure out the amount. Then if the party does not
agree, he can brin9 it up before the Board.

The Manager reported on water quality, both Water
Quality as regards the wells and regarding increase in Oceanside
deliveries of Colorado River water, He inquired how far the
Board wanted to pull down the chlorides. Last week, the chlorides
averaged about 162 ppm.
,* Direc,tor Rogers stated we shnuld use the best water
we can get and shnuld use Colorado River water alone if possible,
The only reason for mixing it at all, he said, is because we do
not have enough good water,
Director Robinson said he feels we,shnuld not turn
down any Colorado River water we are able to obtain, subject to
the correct operation of our San Luis Rey equipment. Ye suggested
shutting down thai equipment and only operating it one day a week.

The Manager stated that Gallinger had con- Carlsbad
tacted him regarding Phase 3 of Carlsbad EsBtes. The Estates
Tstimate, including moving pressure tank, installing pipe, one

Allan The Manager reported that Allan Kelly owns some Kelly Property land back of Carlsbad Highlands. Someone is buying
10 acres from him, and they want to build a house.
They are going to dedicate a street through Lot 47. Shareholder
Kelly wanted to know how much water stock he would have to have
and the Manager told him one share per acre. The Manager asked
whether it would be better to take the water service that is
already in and run it up to his house., Mr, Kelly had suggested
a 6 inch line up the dedicated street, and take it off there,
V?e would consider putting a line in at his expense and $1.00 per
share inclusion fee. ..
