T9-j p c-3 A,- Minutes Director Rogers stated that in the minutes of April Ilth, Motion 55-50, the Directors approved td a" replenishment bill instead of "Replenishment Bill AB 2908" as written, Also under the subject "Pacific Mutual", Mr. Eberhard had said he would +*write" the Pacific Mutual instead of "talk11 to them as stated. Also under the subject "Increase in Domestic Rates" Director Rogers requested the addition of the amounts he had suggested,- namely a raise from "15$ to 25$ for the 1st 1000 cubic feet; 15$ for the next 1000 cubic feet," .- . Letter from Attorney Ray C. Eberhard regarding San Luis Rey Conservation District suit, Attorney Starke requested that it be continued and they havetasked for the first Monday in October. Letter from Attorney T, Brrnce Smith regarding changes in the By-haws. The Manager reported that Mr. Eberhard had Phoned Assembly Si11 No. regarding AB 1389, saying that it is going to come up AB1389 tomorrow and he thinks someone from th.is area should be on hand in Sacramento to oppose it;, The committee meeting is at 3:OO P. M. There was a discussion of the matter and 3irector Robinson moved, seconded by Director Erilhart and carried unan- imously: BE IT 0RDE;IED that the Manager is hereby directed and instrxcted to send a telegram to Ray 6. Eberhard, Assemblymen Hegland and Schrade, recommending that they personally : oppose this bill by unanimous action of the Board of Directors of the Carlsbad Mutual. Water Company; and BE IT FURTHER ORDERED that the Manager is directed to get in to~ch with other interested Districts or Cities and ask: them also to send telegrams opposing the measure. Letter from the City of Oceanside dated. - Oceanside &K I3 44-CL Water April 8th to the CarLsSad Municipal Water Distri.ct, was Meter pqr 9 ;3 3 read. Discwsion followed and Xrector Robinson said that on the-basis of the situation as it exists, the best thing we could do would be to try to work out a better contract than we have had in the past. Laboratory The Manager prssented the laboratory reports of Reports Dr. Carl Wilson, The reports are all right as far as health standards are concerned, but show there is a great deal of bacteria in the lines. Bacteria which is not harmful to health, but is harmful to our pipelines. This can be removed from the pipe and then we can go ahead and give it a shot of chlorine. At the-present time, we are putting all the chlorine into the 1.ines"chat we can put in with our equipment, and Ocean- side is doing. a pretty good job at-present, The Manager said that the other laboratory reports we have are on the wells and show a wide variance in chlorides and total hardnessb The Directors then discussed the chloride content of the water supply and the Manager explained that it varied with the tine of day and the amount of Colorado River water released to .- us by Oceanside. iiirector Rogers moved, seconded by Director Anthony and carried unanimously?. ,- - 32-62 BE IT ORDERED that the Manager is hereby directed and instructed to cause to have a sample taken daily from a given fixed location, readings to be made into a log and posted for ready inspection at any time. Gallinger Attorney Bruce Smith then took the floor and said a SLR Water Eiights that the Company had been approached yesterday by Gallinger regarding OUT water rights in the San Rey. Mr. Gablinger wants to develop certain properties in the San Luis Rey Valley and wanted to know about 5: ej E, the rights of the Carlsbad Mutual Water Company. Fie is considering the purchase of some land out there for the purpose of subdividing, and asked whether the Garlsbad Mutual could crystalize their rights so that he might proceed with his subdividing. Girector Rogers stated he is not in favor of giving up any of our water rights, We cannot afford to jeopardize our rights by saying we are not going to put down a we11 in any given location. The land is subject to our water rights and will always be, Girector Robinson said that the San Luis Rey is our prime source of water and if vte jeopardize our rights ou-; there, we are through, Girector Rogers stated that he wou1.d make the suggestion that if Gallinger wants to submit a proposition to the Eoard, we will consider it, but the probabilities are that we wou:Ld not release any land from our right to drill wells, Director iiobirison said he felt that Director Rogers’ staternent was fair enough. If Gallinger wishes ,to submit a definite offer, that is fine, but we cannot give up any of our water rights at all. Director lngels said. that unless they installed a sewer and a pumpin,g plant, it would ruin our water supply. The Manager-‘ reported that during the month of ;ipril Water 2equirements the flow to us has varied in the main ncter from 1250 units per day up to 2482 units. !:!hen it got warm Last week, we were cut down. We are giving Terramar 1,2 acre feet per day and they want more. Last week we pumped 54 acre feet cut of the river. The lowest daily amourlt we have received from Oceanside was around 3 acre feet. The Manager said that he was planning on around $5,000, It costs about $3,000 to drill and then the pump and lines would make it around $5,000 to $6,OQO, The Manager stated that he was afraid we may lose the best well this week. Cceanside The Directors discussed the proposed letter of Contract the Municipal Water District to the City of Oceanside regarding Colorado River water contract. Nat er The Manager presenteci his report on water rates which Rates he had nade up in-line with Director Rogers’ sugges- tion at the East Board meeting o€ am increase in domestic rates. Director Rogers stated that he was opposed to making the irrigation rate 94 and also was opposed to changing the excess rate back to 20$. Director Erilhart said that he thought it was proper to consider that it is the duty of this Boa,rd under the Articles of incorporation to sell water at cost, If water is sold under cost to the shareholders, the Board is not doing its duty. If the Company is not run as a business, its fundamental principles are going to be questioned, The first thing to do is to consider that water is the prime requirement,- the prime facility in this area. Cirector Brilhart said that he certainly would not expect the Water Company to sell him water at a loss. He thinks the first requirement is to get the Company on a business basis where where there is enough money to run it. That is as basic as ABC. This is a non-profit organization, but-it-could at least run on an even keel, ._- President Ingels said that he uses plenty of water during rlrq 3 $!iJ April, 1955 ~ .. The chart shows the amount of water stock he1.d for each and the number of accounts in each classification, The second tabulation shows the number of accounts which received and paid for excess water during the year. This is based on entitlement of 820 units for the year. A review of this tabulation wi111 show that no commercial grower paid the excess rate during the year, It will also show that above .500 of a share, very few of ,our shareholders paid for excess water. Those that did pay for excess water, it is anticipated will not normally pay under the new entitlement of 1,000 units per year per share of stock, It should be noted that the majority of the people in the excess rate are those who have small holdings of land and can therefore be considered domestic users, These domestic users have received considerable benefit from the Company during the past few years, inasmuch as they are now for the most part receiving clean water under adequate pressure. During the last year, most of' the shareholders benefitted from the 5% reduction in fire insurance rate on their house, Inasmuch as some shareholders are already in the excess rate, it is respectfully suggested that the Board of Directors take immediate action to raise the price for excess water to a point compensatory with the benefits obtained therefrom. It is suggested that a rate of 259 or 304 per 100 cubic feet be considered.
