Chairman Fry called the meeting to order at 9:05 A.M. and directed the Executive Secretary to call the roll: Present: Mrectors: Ewald, %, Rogers, Zahler, Kelly Absent : None I Also present were Attorney Wm. B, Del.llis; Engineer Donald Short; Secretary-Manager of the Cgrlsbad Mutual Water Company, W, Dennis Wood; Robert Mn; and a locd representative of the press. Pipeline A letter from the Carlsbad Mutual Water Company dated March 28, 1956, Terninus was read in wbich it was proposed that the Board give consideration termfnate In the vicinity of Mntual* s #2 Reservoir in lieu of building a storage reservoir at Y&. Kelly. Engineer Short stBted that Director Qgers had called to ask if there were aqy tech- nical reasons wh2y this proposal would not be feasible. Short said that *om an op erating standpoint a reservoir at the end of the line is an integral part of the system, and it would be necessary that the CNWD have control of the operation of tha reservoir. to the building of a Be tbrongh the proposed a. Kelly Engineer Short said it is possible that a specSal control valve ?nay However, he reminded that the kding plan calls for stopping the Municipal system at Mt, Kelly. Director Rogers said that with the construction as proposed by &, Harding, Carlsbad proper still would have no water and some construction would still be necessq to make water available to Carlsbad, and shce Carlsbad has no immediate runds for this purpose we should hold the building of the reservoir in abeyance. M.r, Mood affirmed that terminating the line at Mt. Kelly would not make water avail- able to the Mutual. and that the proposal now under consideration would put water into the main lfne fromwhich the whole &tual area could be served. Under this plan, the #2 Reservoir could be *-passed to get to #l Reservoir when not pumping from San Luis Rey. Director Rogers said we could make a contract with Mutual in order that they would take care of #1 and #2 Reservoirs, He said nurther that in case of rain, the Authority could cut down the flow of water on 24 hours notice. Engineer Short said that with proper coordination with the MutM reservoir system, this proposal. could be carried out, but he emphasized that coordination would be necessary and availability of space in reservoirs for water coming from the que- duct. He pointed out that the reason for locating the reservoir m Mt. Kelly-.is that it is the highest point serving the Mutual area. A control valve would have to be installed to maintain the hydraulic gradient and this would be technically feasible. Pipeline Director Rogers stated that there is not only a question of building a lfne but also haw big a line to build, Since the Mutual would use the line for di&ribut;fon, there is also the question as to whether we should a& the &tual to pay for it and he was of the opinlon that the Mutual should pay for it million gallons. Attorney Dennis pointed out that this is not only an engineering problem but ~,SO one of practical politics and pubUc relations and we should be sure the citizenry is in back of any action t&en by the Board, Director Rogers replied that the btual Board would support this ~a~e, And Attorney Dennis reminded that they had supported the last bond isme and it had failed. Engineer Short reviewed the dewlopent of the plan for the CMWD which revealed that it was originally felt that water should be =de available to all meas of be required on I+%. Kelly, but that this is no particular problem. I I over a period of time, He suggested that CEylwD should reserve capacity for 1 1/2 service including lines to North and South Carlsbad. The plan now before the Board could be developed but it would leave out the people to the South and there is doubt in the minds of the people of North Carlsbad that they would get satisfactory sercrice. The problem, Mr. Short stated, is not one of engineering but of whether this is the proper thing to do. Hrector Ewald affirmed that we are mixing the responsibilities of two differenb bards and leaving ourselves &de open to the building of other laterals that might be demanded. Chairman Fry said he felt that the question is whether to charge the Mutual. for the line and stated we should make a contract so we would have money to build a reserv- oir in the f'uture, Erector KeUy pointed out that this assumes North Carlsbad wants this sedce, Vut supposing they do not?" Director Rogers stated that the alternatives shdd be put before the people of North Garlsbad at this evening r s meeting, Chairman &y questioned the Attorney as to whether a line can be built on 8 basis of repayment by the Nutual and the Attorney stated that a contract could be made or a different rate established which could repay the GMWD. Director Zahler expressed the fear that we are upping the bond issue since we would have to be prepased to build for others what we proposed to build for Morth Carlsbad. ification, Mt. Kelly Director Rogers questioned what is so sacred about the Mt. Kelly site except for the fact that the Wing report recommends it. Engineer Short pointed out that tbe responsibility of the C%?D is to bring water *om the aqueduct into the District and make it available on a subarea basis and the reawn for termination on Mt. Kelly is that it is the highest point and most logical loc& tion for a regulating reseraoh, and that this was considered not only by Harding but also by the kyle Engineering Compmy, Legal Status Director Ewald questioned the &torney as to whether we would be 13,- Carlsbad. Attorney Deds said we would not; the rule is that as:.,long as the Board is not guilty of fraud, the court will not dishrb its judgment. He sadd also that there will always be some people dissatisfied and a law suit my be filed but its success is unlikely. Attorney Dennis reaffirmed that we should be sure the people who will be called upon to back this issue will be behind the move. Director Ewald pointed out that if tfiis had come up before the North Carl&@ argue meat had occured it would not look so suspicious and the way in which the matter was brought before the Board does not seem right. chaim Fqy enquired as to whether it is not possible that when a new situation develops something might not be developed to make it better, I Director ~walcl insisted that the line propsed is the reaponrjibilJtF of: the Nutua bmd md not tkiis one, & said he though% this would not have Gome up if it were not for the Worth Carlsbad situation and pointed out that two firms of engineers had come to conclusions that we are now attempting to abandon. Chairruan Fry asserted that the engineers may have overlooked something in the situ- ation. He said he thought it the duty of the Board to cooperate with qone in any way we can, and that we should work with the Mutual in this matter, Director Rogers noted that at the last rep-lar meeting of the Board it had been North Citizens' Committee was called to discuss Kforth carlsbad. The Harding Carlsbad report, Rogers sdd, &e no statement about excluding North Carlsbad but members of the Steering Committee had brought up this subject, and that a North Carlsbad resident had immediately said a law suit would be started. Director Rogers said he believed that if we could show North Carlsbad that they will be served with water they might go along with the bond issue. And until such time as North Carlsbad is excluded legally, he was of the opinion that we should make every effort to deliver water to that area if it is wanted, Director Ewald noted that there is no evidence of organization in North Carlsbad and that Mr. Matthiessen had spoken only for himself, Director Kelly observed that the whole District, including North Carlsbad, is entitled to the right to get water but we have to have money to get it to them; the logical thing is to find out whether North Carlsbad wants this line before we risk including voted to call a bond election. Director Kelly noted that this could hardly be regmded QS a fim commi4Amen+, After further discussion, the following notion was proposed ly Director bgers: That in reply to the letter from the Carlsbad Mutual Water Company (dated March 28, 1956) this Board advise the bard of the Mutual'dater Company that it is prepared to con- sider cooperating in the construction of a line to #2 Reservoir at %em Vista Way and bland Road; provided a firm contract can be made to guarantee the nedessary termlnal storage capacity for regulating purposes and subject to repayment of costs over a period of ten years, with interest at a rate of four per cent; size and loca- tion of the line to depend upon future engineering studies and the area or areas to be served; with repayment to be used for construction of the originally proposed Mt, Kelly regulating reservoir; and furt5er that this question be referred immediately to the Citizens' Water Committee for consideration andrecomendations, The motion was seconded by GM.rman Fry and brought the following discussion: Dir- ector Ewald reminded the Board that it has an established policy of not distribuang water and furthermore it has already accepted the Harding report. Any deviatlon would require a conference with the Citizens' Committee, Rreotor Zahler was a;lm in favor of having this Committee Mly advised before taking any action. Director Rogers said he felt that if we duck the issue by dumping it into the laps of the Citizens' Committee we would not be doing our duty. Director bald said he thought the kt& is shoving its responsibility off onto the CMWD.
