The meeting was called to order by President Fky, Present: Directors FRY, EwALi), KELLY, ROGERS , ZAHUR Absent : None Also present were Attorneys Dennis and Feist, Engineers Short and Clayton, Wm. Cannon, Mr. Owen of the S.D. Gas & Electric Company, Wm. Baldwin, Mr. Ayres, Ihn. Garland, Robert Hadin, C. R. Helton, et al. Minutes : Minutes of the June 18th meeting were approved on motion of Director 6-18-56 Ewald, seconded by Director Kelly, Minutes of the July 5th meetkg I 7-5-56 were apprmd on motion of Director Ewald, seconded by Director Zahler, 5-16-56 Ninutes of the meetings of May 16th ard June 13th were ordered held 6-13-56 for the next regular meeting, Election This being the tke and place fixed for the can.vass of the returns of Canvass the special election held on July 24, 1956, the returns of said electio: canvassed as provided by law, It was moved by Director Rogers, seconded by Director Kelly, that the fallawing Resolu tion, declaring the result of said canvass, be adopted and that it, together with a Secretary's statement, be set forth in full on the minutes: (and the absentee votes cast at said election) were duly and regularly AYES: Directors: FFtY, EWALD, KELLY, ROGERS, ZAHLER NOES: Directors : None ABSENT: Directors: None RESOLUTION NO. 25 RESOLUTION OF THE BOARD OF DIRECTORS OF CUBAD MTNE IPAL WATER DISTRICT DECLARING THE RESULT OF TEE CAlWASS OF ELECTION 3ETTJRNS OF ELECTION HELD IN SAID DISTRICT O& TUESDAY, JULY 24, 1956 I The Board of Directors of CAXLSBAD "I.CIPAL WATER DISTRICT DOES HEKEBY RESOLVE, DETERMINE AND ORDER as follows: Section 1, That a special bond election was duly called and regularly held in said district on the 24th day of July, 1.956, at which election there was submitted to the qualified voters of said district the following proposition, to wit: PROPOSITION: Shall the Carlsbad Municipal Water %strict incur a bonded indebt- edness for Improvement District No, 1 thereof in the principal sum of $1,350,000 for E purpose of the acquisition and construction of a water transmission pipeline with appu tenances and appurtenant works from the facilities of the San Diego County Mater Autha ity located in the San Marcos, Escondido area (at a point to be approved by the San Di, County Water Autllority) to a point within the Carlsbad Municipal Water District east o Highland Avenue, incluiing works, machinery and other property (including lands and easements) useful and necessary to store, convey, supply and otherwise make use of wate for the lands and inhabitants within the exterior bdaries of said Improvement Distr No, 1, and including expenses of all proceedings for the authorization, issuance and s' of the bonds2 Section 2, That the returns of said election have been duly and regularly can- vassed by this Board as provided by law, and all absentee ballots have been returned and canvassed, I Section 3. Bldwin presented a letter from a Citizens' group stating that the Committee . loss of the recent election is a vital blow to the community and urging resubmission of the proposition to the imters at the earliest possible mament, The letter was signed by 34 leading citizens. Baldwin said he beliebs it would bring additional hard&p to have another Improvement District formed. I Citizens ' Director Rogers reported 011 a meeting held on Friday, July 2%h, at whit Meeting -. 30 persons were present representing various groups interested in Carls bad's water problems, He stated that the action of the group was as follows: The vote .in favor of resubmission of the same proposition was 27 in favor am 4 against; it was agreed that resubmission shdd be as early in October as possible. Only one person (MrD Metka) was in favor of connecting with the QIF lateral, It was agreed that Carlsbad should coopezate with Oceanside on a conservation program and tha zens' Committee shauld conduct the campaign aryJ. that there should be one or more public meetings to give everyone an opportunity to express his views. A package deal suggesti by Bruce Smith which would submit a proposition to inclde fuzlds for the acquisition 0: the Mutual and TexTamar by the City and a pipe line as recommended by the Hading repa and including sufficient funds for the rehabilitation. of the present Mutual system was rejected. the Mutual should consider measures to conserve water. It was also moved that a Citi- South N~o spes said he now feels it useless to hold another election a3#l Carl sbad requested that the Board withhold action at this time and allow his SOU to bring in a petition for the formation of a District South of H&ionda I s, D, Mr, Owen of the San Diego Gas and Electric Company read a memo represent Go it Eo, the duly cowidered official opinion of his company,which is seriously concerned because of the threat tothe operation of the Encina station ad stating that there appears to be no certainty of a third proposition being approved A third failure, he said, would be dangerous; that failure of an assured supply of water had already caused inconvenience and that the new contemplated unit may have to be placed elsewhere, His company does not oppose a separate District on the part of th so-called Itdry lands" since it appears that such an election has a better chance for success. He requested that the Board consider permitting the formation of a County Water District, . &, Baldwin stated that it is entirely possible that a delay of 65 or 70 days would not be particularly detrimental to the future of the SOD, Go& E, and said that the proposal from the South Carlsbad group might actually help get the third effort passed, He pronised a door to door campaign, Director Rogers asked the attorney how long it would be before the people to the South could get a pipeline election passed. The attorney said they would be lucky if they could do it within six months; that it would be four or five months at the very least, Mr. Cannon stated that he was sure a third try would fail unless there were drastic changes in the management of the CMWD. Director Ewald asked the attorney $at interest rate we might iixpect on revenue bonds, The attorney answered probably 4 to h of 1% more than on Go bonds, He expressed doubt that Carlsbad could set up a revenue bond issue that would be attractive to bond buyers: To Ewald's question as to whether we should hire a bond consultant, his advice was "NO11 He remiixied that a revenue bond issue would have to be fore the entire District and must i nclude North Carlsbad. Director Rogers pointed out that for revenue bonds, the tax would have to be paid from revenues and those with high assessed valuation would ge virtually a free ride, Wm. Garland suggested that thought be given to an issue for Carlsbad alae and mid he is in favor of resubmitting the proposition and thinks we should get a 20" pipeline, Director Rogers noted that if we grant permission for a County %ter District to the South, Carlsbad would. stiU be without water, He suggested holding an election early i: October, He reported on a meeting of the Mutual Board held earlier in the day: they raised the water rate from 8# to 3.26; cut the hntitlement to 60,000 cubic feet and levi an assessment of $10.00 per share to finance the digging of a new well and pay current bills, A plea for water conservation measures is being made since the Mutual is re- ceiving less than one acre foot per day from Oceanside, Rogers reported that the water now being taken from the San Luis Rey contains 267 ppm., and that North Carlsbad is getting no water from Oceanside, Director Ewald reported that the Registrar of Voters had advised that registration win have to close on August 8 €f the election is held Oct, 2, bk. Baldwin stated that five new deputy registrars will canvass the district and it,is expected that 200 new regis- trations will be secured by August 8th, The chairman called for a vote of those in the room as. to how many would favor calling another election. Of about 32 present, 15 were in favor. Three were in favor of some other proposal, Director Rogers asked what the people of South Carlsbad expect Carlsbad to do for water have to go to the 0-F lateral and that they could purchase any excess on the proposed line to the Sauth, He said the 0 plan is still the best solution but doubts it will carry. Director Kelly pointed out that the difficulty with a third election is that there is t much possibility for a small minority to upset everything again at the last minute, He suggested giving the people to the South a couple of weeks in which to work out a solut Attorney Dennis advised that a County District can sell water only when there is an exc so Carlsbad would still be on the same basis as it now is with Qceanside, I I %, Aves said that since the people of Carlsbad had voted against water they would now TelTamar Director Kelly asked the attorney about the possibility of the area to ' Santf3 foming an Improvement District; he wanted to Inrow whether it wou then be possible to amex to Terramas. The attorney said it would be possible prda the areas concerned are contigum. Director Rogers remided that if the CNMD calls another election in October, the resi- dents to the Smth would be delayed in their plans for only three weeks at most, and that if the election fails he would be in favor sf the Southfs plan with the addit&= of areas in Carlsbad wanting to jarin, Wm. Garland pointed out that the District is entitled to one free connection to the aqueduct and asked if it would be possible, if the dry lands comect in the San boos area, for Carlsbad ever to conuect. The attorney stated that they conld but would hav to pay for it, Electiaa Director Fbgers reportRd that the idea of holding the election at the Pridayts meeting, In answer to a qusstion from the floor, the attorney expleined that it would not be possible to hold an election on two isaues at the same the became it wotxld require dirrerent forms aad notices, etc., an3 the time element would also preclude it. &E, Iateral In response to a suggestion from the floor that we sharrla connect with that there is not enough water in the lateral, Robert Hardin stated that every drop of water coming to Carlsbad canes from the lateral and the San Luis Bey wells; the lateral source is naming at capacity and the wells are rapidly running dry, he said. Director Ewald pofnted out that for the past two years, the Boa14 has been studying the possibility of com8cting with the lateral and that the small amour& of water that I same the as the general election in November had been -os& at last the 0-F lateral became we would have a hard time convincing the voters udd rersult would not justify the cost of the line. Mr. Cannon stated that the intention of his group is to build 8 line that will carry IUQ~ water than they would need so, for the present, Carlsbad could get water. Attorney Glsnn Feist advised against Direcrtar Bogem motion saying he felt part of it, regaxding the Scmth Carlsbad ocumdtxuent, is out of order. Mr. Netka said he had heard nothing from the Board as to how much water there will be if the pipeline preposition is passed and said that shoe we am so short 6p water we shdd not be giving so much to Mr, Cam=. Engineer Short said that people who do not know what they are talking abmt have been putting out dsinfmuaticxa and that Mr. Netkafs statements are completely untrue; that ' there is a suZ'plu8 available from &tropditan which wanld be available to CarlsbeLd; that the Authofity had allocated $96,ooO for the engineering of a third barrel, and that the State Legislature had appropriated $Z~,OOO for the stdy of am aqueduct to serve San Diego Catmty. Mr. Hetka referred to the Arizona suit. The attorney pointed out that even if that suit shdd be sucoessfhl it would not effect Southern Wj.tornfp =til 1%5, accdfns to engineering reports he hsd. seen. Director Rogers pointed aut that b this time we codd expect to have Feather River water. Engineer Short reported that the water maste had decided against the Arizona proponents according to information he had received.
