The motion carried mi- mollsly. Jennings was to be his recomps5ation to the Board of the Authority but that it had not yet been presented or approved. He also noted that since the opinion and recommendation of Xr. Jennings, the GhMD had paid its amscation fees in the mount of $33,376.85 . This money has bsen accepted placing the C&IKD in a more advantage- ous position so far as preferential right is concerned. Director Bwdd stated the opinion that this Board should & along with the rgcommngd.ationaof i3W.elveny & ?@ers, Directors Zahkr and Kelly concurred. airector Rogers said he was agreeable also but moved that the wording in the broclnure re t& Jennings opinion and r+xmanda- tion be referred to as thg opinion ad recommpgxiat ion of the Gemral. Couns~l of the Authority so as not to be misleading. The motion was seconded by Director Kelly and carried unanimously, preferential right. Director Rogers pointed out that the opinion Brochure Director Rogers then moved that the brochure should include other pertinent informtion regarding the pipe line program as gathered during the past few weeks. He referred to the fact that we my not hsve to build all the way to the dqtleduct since we are in the process of making an agreewnt with San Wcos, due to the fact that the state has recommended thg \?est line for the new aqueduct and the Authority bas agreed. 'Phis could shorten our pipe line by eight miles. The motion was seconded by Director Iilwald and carried unanimously. I Attorney Dennis said b thinks the info rmtion concerning the S.D. Gas & dlectric Company should be in the front of the brochure . On mot ion of Director aoger S, se- conded by Director flwald, it was unanimously agreed to Lave this decision up to Schwabachr & Conpmy, Bond It was not 4 that O'&lveny & Xyers had sent an ad to be placed in Buyer the Bond Buyer and that the Board had already agreed, aftsr conferring with Xr. Bafferty, that such an ad would not be mcessary. Director Zahler moved that the ad not be placed, that 0'2Ielv~ny & Eyers be notified accord- ingly, ard tht the Resolution be checbd on this subj&. The motion, seconded by Director Rogers, carried wlarnimously. 2. Bond Buyer - 1-10-57, request ing informat ion on bond sale. The? Secretary was instructed to tarn tk qunstiornaire over to Schwabacher & Compaq for disposition. 3. State Bmployees Ret iremgnt System -- 1-11-57, rendering opinioyl that it would be legal to rnake social security retroactive beyond. current fiscal year and enclos- ing agreement and resolution forms. I Director Rogers Boved that Werts & Isenoff be employed according to tha terms of their letter. The motion, secorded by Director Zahkr, carried wimously. 5. Irrigation Districts Association -- 1-8-57, enclosing resolutions adopted at Sari Jose. 6. Irrigation Districts Officers Association - 1-15-57, notice of meeting 1-28-57. The law states that wa- ter should be delivered to the agency for beneficial use within it s area.
